equipment forming an integral part thereof and/or the equipment
installed by Plaintiff at Pefendant' e;J premises malfunctioned and/or the
system provided by and installed by Plaintiff at Pefendant's premises
malfunctioned and was not repaired or replaced in accordance with the
provisions of the contract entered into between the partiee;J, only a
portion of which is attached to Plaintiff.'s complaint as Exhibit "A",
Further, the purported system provided by, installed by, and/or
monitored and maintained by PJ,aj nt if f at Defendant. s premises failed t,o
work in the manner as represented by Plaintiff to Defendant that it
would, and any <lnd <Ill attempts at repair failed to restore the system
to full and acceptable operating condition, As a result, Defendant was
required to seek the exper.t intervention by another provider of
security systems for premises such as that of Defendant due to the
failure of the equipment and/or installation and/or maintenance and
repair services provided by Plaintiff to Defendant for said security
system to cause it to work in an acceptable manner and provide that
degree of security Which Plaintiff was obligated to provide, but which
Plaintiff failed to provide in accordance with the contract,
It is further denied Defendant has any obligation,
whatsoever, to pay to Plaintif f any "cancellation charges" inasmuch as
Defendant did not "cancelli the contractl rather, by Plaintiff's own
failure to install machinery and equipment forming the security system
in accordance with its contract to do so (Exhibit "A", attached to
Plaintiff's Complaint) and, further, as a result of ~laintiff having

by counsel, as well as was the Notice of Appeal from District Justice
Judgment and all succeeding documents.
Neither in its Brief, nor at allY time prior thereto has
Commonwealth aat, forth any reason or reasons whatsoever for its failure
to have filed the complaint required by Pa, R, C. p, D, J, 1004A, other than
to assert in its Brief. without factual support, the followingl "That
the complaint was either timely filed with the prothonotary and
misplaced by that office. or was inadvertently not filed by

clear that Centennial must proffer some legally sufficient
reason for the trial court to reinstate its appeal, . , ,
Centennial, however, offered no explanation to the trial
court, or to this court, for its failure to file proof of
service of copies of its notice of appeal and rule to file
complaint within five (5) days after filing its notice of
appeal. Clearly, in attempting to demonstrate good cause for
reinstating an appeal. Centennial should explain its reasons,
if any, for failing to comply with the provisions which
caused the appeal to be stricken, Centennl.al, rather than
attempting to explain its reasons for not complying with rule
10058, merely claims that since it acted as diligently as
possible under the circumstances and since the Anderson's
rights were not substantially affected by its noncompliance,
its appeal should be reinstated,

It appears clear, therefore, that the Pennsylvania Rules of
Civil Procedure will apply to n~tters on appeal from District Justice
JUdgments wher.e, in the first instance and as a triggering mechanism,
a timely appeal is filed,
Thereafter, the issue of service of legal papers must be
considered,
In the instant matter, regardless of whether one
oharacterizes the fi ling of a Complaint by an appealing Appellant'. I
Plaintiff as "original process" or "other than original process," both
Rule of civil Procedure 401 relating to the service of original process

and Rule 0140 relating to set'vice of legal papel;'s other than original
process require that service be mude after the Complaint iff liild, In

Procedure which require both for original process and legal papers not
comprising legal process that a Complaint must be first. f Hed before

It follows, therefore, that if no proper Complaint was ever
filed of record in the Prothonotary's Office, that no "service" of the
same can be meaningfully effected,

7, Notwithstanding the averments set forth in paragraph 7 of
Plaintiff's Petition to Reinstate District Justice Appeal, the same are
denied as having :Uly affect whatsoever on the instant case inasmuch as
without there having first been a Complaint filed in the Office of the
Prothonotary, there can be no default, Thus, a Pa,R,C,P, Rule 237,1
Notice of praecipe for Entry of Judgment by Default for Failure to
Plead is of no effect where there is no Complaint filed of record
either in the paper filed maintained in the Prothonotary's Office or
entered in the computer docket entry system also maintained in the
Prothonotary's Office (see Exhibit "B") ,

O. With all due respect to this ~onorable Court and to
Plaintiff/ s counsel, tho undlH'signed attorney is aware of no
Pennsylvania RUle of civil Procedure, either relating to civil actions
or to appeals from Entry of Judgment by District Justice requiring him
to make inquiry of Appellant's attorney to advise that the original
Complaint was not in the Prothonotary's f. ile. Moreover, foot.note 1 at
Paragraph 8 of Plaint iff's Pet it ion to Reinstate District Justice
Appeal is wholly irrelevant to the involved issues as at no time has
Defendant denied receipt of mailings from Plaintiff's counsel (proposed
copy of Complaint and proposed Rule 237.1 Notice) I rather, the issue
now before the Court is whether or not there is good cause why the
Plaintiff's Appeal from the District Justice Judgment, stricken by the
Prothonotary upon Rule 1006 Praecipe for the same, should be
reinstated. It is Defendant's position that for the factual reasons
set forth above, the appeal as stricken by the Prothonotary pursuant to
Defendant's Rule 1006 Praecipe should not be reinstated and the Appeal
shOUld remain stricken from the record in accordance therewith.
9. With respect to the alleged Complaint itself, the same is
deficient in that it fails to comport with Pennsylvania Rule of Civil
Procedure 1019 (h) as the body of the Complaint makes reference to a
contract (Exhibit "A" of Complaint) and charges incurred (Exhibit "B"
of Complaint) but the Complaint does not have attached to it said
Exhibits as the Complaint avers it does and, as well, the Complaint
fails to state any reason why said Exhibits which are averred in the
Complaint as having been attached thereto, are not attached, or not

accessible to Defendant and, further, no reason or substance of the
writings themselves are set forth.
Defendant's counsel is not unmindful that the foregoing
Paragraph is more suggestive of averments which would be plead by way
of Preliminary Objection to the Complaint, had the same been filed in
accordance with the Rules of civil Procedure and service of the same
appropriately effected upon the Defendant I however, the averment points
out another of the many deficienci es.
10. It is noteworthy that in the proceeding before District
Justice Manlove, the same brought about and scheduled by and on behalf
of Plaintiff herein, neither the Plaintiff nor any representative or
witness on its behalf, nor counsel appeared in a good faith ~ffort to
prosecute the case.
11. Plaintiff has failed to comply with the RUles of Procedure
relating to Appeals from District Justice Judgments and Complaints
rllquired in pursuance of an appeal taken therefrom and, further, has
demonstrated no conduct on the part of the Prothonotary'S Office in
complicity therewith and, as a result, it can only be concluded from
the facts averred that no Complaint whatsoever was ever filed in the
instant case. Plaintiff/Appellant herein is, therefore, not entitled
to have its appeal, previously and properly stricken by the
Prothonotary on August 23, 1996, (pursuant to Defendant's Rule 1006
Praecipe for the same) reinstated. The appeal taken on behalf of
Plaintiff/Appellant herein was not accomplished in conformity with the
applicable Rules and Plaintiff/Appellant is not entitled to the
reinstatement thereof.

12. Defendant herein will suffer pr'lfjudice and great harlll in the
event the instant appeal, previously and properly st.ricken by the
Prothonotary pursuant to the RUle 100~ praecipe, iR reinstat~d in that
by its effort to demonstrate good cause why the same ahliuld not be
reinstated, Defendant has averred facts and matters to this Honorable
Court wh~ch may serve to its detriment in defending allY action as the
Plaintiff now knowa them, and as well, Defendant has incurred legal
fees

Inc.) respectfully requests this Honorable Court to discharge
Plaintiff/Appellant's Rule, refuse to reinstate its appeal, and uphold
the decision by the prothonotary of Cumberland county, Pennsylvania, on
August 23, 1996, that the appeal was stricken in accordance with
Defendant's Rule 1006 Praecipe for the same.

Please strike the appoal of commonwealth security systems, Inc.,
plaintiff/Appellant, from the record in accordance with Rule 1006 of
the Rules of Civil Procedure Relating to District Justices - Appeal.
In support of the instant praecipe to Strike Appeal, the following
facts of record are set forth I
1. District Justice Robert V. Manlove entored judgment in favor
of Defendant on June 27, 1996.
2. Notice of Appeal was filed by plaintiff/Appellant in the
Office of the Prothonotary of Cunmerland County, Pennsylvania, on July
15, 1996.
3. Proof of Service of Notice of Appeal was filed by Plaintiff/
Appellant in the Office of the prothonotary of cumberland County,
Pennsylvania, on July 29, 1996, a date beyond the ten (10) day period
required for the some by Rule 100SB of the Rules of civil Procedure
Relating to District Justices . Appeal.

(ZO) days after filing his notice of appeal.
6. Rule 1006 of the Rules of civil Procedure Relating to District
Justices - Appeal, provides!
Rule 1006. Striking appeal,
upon failure of the appellant to comply with rule 1004A or
rule 1005B, the prothonotary shall, upon praecipe of the
appellee, mark the appeal stl:icken from the record. The
court of common pleas may reinstate the appeal upon good
cause shown.

2. Commonwealth timely filed an appeal of the Diatrict Justice
jUdqment on July 24, 1996, in the Court of Common Pleaa of Cumberland
County.
3. Commonwealth aerved a copy of the complaint on Defendant on

4. Commonwealth timely filed ita Proof of Service of the Notice
of Appeal on July 29, 1996.
5. On Auquat 19, 1996, Commonwealth acnt to Tavern the 10 day
notice required before judqment (par Pa. R.C. P. 237.1).
6. (commonwealth either did not file its complaint in the
Pro,t-honotary's off ice wi thin the 20 days required by R. C. P. D. J. 1004 (I\) ,
su: it did file same and was not properly docketed or filed by the
Prothonotary. )
7. On Auquat 23, 1996, without any inquiry or warninq not.ice
from Tavern's attorney to Commonwealth'a attorney, Tavern filed ita ex
parte praecipe to the Prothonotary to strike Commonwealth's appeal, and
it was so stricken on that date.
8. Commonwealth thereafter on September 9, 1996 filed its
petition to reinstate the apPflal, which l.ncludes as Exhibit "AU a copy
of the complaint (not heretofore in the file of this caae) .
9. On September 11/ 1996, the Court issued a Rule upon Tavern
to show oaUSe why the appeal should nut be reinstated.
10. On October 2, 1996, Tavern tiled Its AnSWer to the Rulo.
II. Issue Presented
Where a party has timely filed its District Justice Appeal and
served it upon Defendants alon9 with a copy of the complaint, but where
throu9h inadvertence the ori9inal was not timely filed and the Defendant
ex parte causes the appeal to be stricken, should the appeal be
reinstated upon the appellant's prompt application therefor?

A. ON 'rHE ABOVE FACTS, THE APPETlL SHOULD BE REINSTATED. I
In Primis, we shOUld note that all of the r/jlcited facts in
section I of this brief have been admitted and/or are tacts of record,
save possibly for Commonwealth's averment that the complaint was either
timely filed with the prothonotary and misplaced by that office, or was
inadvertently not filed by Commonwealth. ordinarily, we assume that the
Prothonotary's file and docket entries are sacrosanct and do not inquire
into their accuracy. However, as Tavern itself points out, in Section
I of its Answer to the Rule, the prothonotary's docket entry that the
appeal was filed on July 15, 1996 misstates the truth, which is that the
appeal was filed on July 24, 1996.
More importantly, and regardless of the correct explanation for
the errant oriq\nal of the complaint, the salient fact remains that the
appeal was timely filed, timely served and thera is no showinq of any
prejUdice that has or will befall Tavern if it now has to defend on the
Ipa. R.C.P.D.J. 1006 provides for reinstat/jlment of the appeal 'upon good
cause shown. I

B. RULES OF CIVIL PROCEDURE ARE 1'0 BE LIBERALLY CONSTRUED
Such rules IIrIl to be liberally construlld to secure tho just,
speedy end inoxpensive determinetion of ections. 'I'his sentiment has been
held specifiC;l.Illy eppliceble to tho District JUlltici! Rules, end even more
specifically to Pa. R.C.I'.D.J. 1004(1\) relatinll to the requirement of
filinll a complaint within 20 days after filinll the appeal, Delverme v.
pevlinskv, 592 A. 2d 746 (1991) I Seo also ~td. Pa. Prectice, 51.12 et seQ,
wherein it is stated (at 1113) with eppropriatll supportinq citations I
"Thll trial of a lawsuit is not a sportinq event whllre the
substantive lllqal issueB are subordinated to the rules of the 'lame, and
procedural rules are not ends in themselves, but moans whereby justice,
liS expressed in leqel principles, is administered, they are not to be
exalted to the status of substantive objectives reQuirinq riqid
adherenclI. Thus the courts will not enforce technicalities to defeat
apparently meritorious claims".
The Delverme case involves the same rule (10041\1 as instantly
with the Commonwealth Court reversing the trial court and orderinq the
reinstatement of the appeal, notwithstanding the party's failure to file
a complaint. The court rel ied on the promptness of the appellant's
movinq to rectify and reverse the striking of his appeel end the lack of
eny prejudice to the other party. Further, the notico of appeal had been
timely filed and served.
Our instant case goes one step further, makinq it an a fortiori
situation. Here, and additionally, Tavern wes timely sent end received
a copy of the complaint.

R.C.P.D.J. 1006) weret
1. That Appellant failed to comply with R.C.P.D.J. 1005 B,
in that its proof of service of the Notice of I\ppeal wasn' t filed within
10 days followinq the fninq of the appeal, and
2. 'rhat Appellant failed to file a Complaint within 20 daYIl
of the takin\l of tho l'.ppeal.
3. The praecipe filed by Attorney Silver incorrectly states July
15, 1996 as the date the appeal was filed, when in fact July 24, 1996 was
thll date filed, as clearly appears from the docke~ records of this case.
4. By virtue of the foreqoin\l, the Proof of Service was timely
filed on July 29, 1996.
5. Appellant believes and therefore avers that. the Complaint wall
filed in the prothonotary's office on the same day the Notice of I\ppeal
was filed. However, a search of the calle file in said office didn't
locate this document nor does the computerhed docket include such an
entry.

Please strike the appeal of Commonwealth Security Systems, Inc.,
Plaintiff/Appellant, from the record in accordance with Rule 1006 of
the Rules of Civil Procedure Relating to District Justices - Appeal.
In support of the instant Praecipe to Strike Appeal, the following
facts of record are set forth:
1. District Justice Robert V. Manlove entered judgment in favor
of Defendant on June 27, 1996.
2. Notice of Appeal was filed by Plaintiff/Appellant in the
Office of the Prothonotary of Cumberland County, Pennsylvania, on July
15, l:i96.
3. Proof of Service of Notice of Appeal was filed by Plaintiff/
Appellant in the Office of the Prothonotary of Cumberland County,
Pennsylvania, on July 29, 1996, a date beyond the ten (10) day period
required for the same by Rule 1005B of the Rules of civil Procedure
Relating to District Justices - Appeal.
4. No Complaint was timely filed on behalf of Plaintiff/Appellant

within twenty (20) days after filing said Notioe of Appeal, further, no

of filing the instant Praecipe to Strike, some thirty-nine (39) days
after the Plaintiff/Appellant filed its Notice of Appeal in said
prothonotary's Office,

District Justices - Appeal, provides I

district justice, he shall file a complaint within twenty
