I II In Anderson v, cemennial.~s. Inc;.J.., 406 Pa,supor. 513, 594 A,;ld 737 (1991). the Superior Court, when discussing the term "good cause", first referenced Black' sLaw Dictionarv for a deHnition thereof, and then went on to statel while the term good cause may be difficult to detine, it is clear that Centennial must proffer some legally sufficient reason for the trial court to reinstate its appeal, . , , Centennial, however, offered no explanation to the trial court, or to this court, for its failure to file proof of service of copies of its notice of appeal and rule to file complaint within five (5) days after filing its notice of appeal. Clearly, in attempting to demonstrate good cause for reinstating an appeal. Centennial should explain its reasons, if any, for failing to comply with the provisions which caused the appeal to be stricken, Centennl.al, rather than attempting to explain its reasons for not complying with rule 10058, merely claims that since it acted as diligently as possible under the circumstances and since the Anderson's rights were not substantially affected by its noncompliance, its appeal should be reinstated, 594 A,2d at p, 739, Further, after explaining that Rule 1006 (Pa.R.C.p.D,J,) is 7 discretionary with the Trial Court and, further, that Pa,R,C,P, 1~6 allows the Trilll Court to disregard procedural errors which do not substantially af~ect the rights of the parties end that the same is likewise discretionary with the Trial Court, the Superior Court heldl '" that while the trial court may ignore procedural noncompliance, it is not required to do 190, See, Pa.R,C.P, 126, 594 A,2d at p, 739, The Court goes ont We find that simply stating that the instant noncompliance did not substantially affect the rights of the Anderrsons is not alone sufficiant to demonstrate good cause to reinstate the appeal, In short, we cannot find thst under the circumstances the trial court abused its discretion when it refused to reinstate Centennial's appeal. 594 A,2d at p, 739-40, While it is accurate that Courts of Common Pleas, whose decisions have been affirmed on appeal, have found sufficient good cause to reinstate stricken appeals even though technical requirements of the rules were not fully satisfied, the same relate in the main to Notices of Appeal from District Justice Judgments which have either been timely filed but Proofs of Service of the same not timely filed, or where the NotJ,c;e of Appeal itself was filed late but Appellee received actual notice of the appeal within the requisite time period, See, Ouarato v, Facelifters. Centennial Homes, Ine,. supra, with approval, holdsl Although appellant offers no justification for its failure to comply with the rules, appellant asserts that the noncompliance nonetheless shoulr;i be disregarded because 9 appellee has suffered no prejudioe, As recognhedby this court, llsimply stating that the ,'. noncompliance did not substantially dffect the rights of the (adverse party) is not alone sufficient to demonstrate good cause to reinstate the appeal. Pa,R,C,P, 440 relating to service of legal papers other than original process. each of which provide that service be made only after the Complaint is filed, Thus, Commonwealth's faint suggestion that merely because it mailed to Tavern a copy of a Complaint, purportedly filed, and subsequently of a Rule 237,1 Notice, purportedly filed, the same cannot be taken as "service" in accordance with the Pennsylvania Rules of Civil Procedure inasmuch as the requisite prior filing of the Complaint 10 was not accomplish$d, commonweelth Wl)Ul,d have thia Court tollow the libQrat construction philosophy set fort.h in Delverme v, Pavlinsk~, 406 P8,Super. 443, 592 A,2d 746 (1991), wherein although the Trial Court concluded that the Rules Qf Civil Procedure governing appeala from magistratea dedaions must be strictly complied with, on appeal the Superior Court opined that the Rules of CivJ.l Procedure must be liberally construed so as to guarantee that actions auch as the present one are resolved in a juat, speedy, and inexpensive manner consistent with the mandatee of Rule 126, 592 A,2d at 747-748, Delverou:' s liberal theme il3 predicated on what that Court , concluded ia the "modet'n trend" which "haa tended toward a more liberal interpretation of these ruleo", rJel verJll!:, aupra, at 748, but quotes in support thereof Ouarat.2- v, Facelifters, L~. supra I J<ataantonis v, Freels. supraf and mk v, Weitzen~.offer, supra. each of which relate to the timelineaB of filing Notice of Appeal and/or filing Proof of Service of the Notice of Appeal. but not to the filing of thp. required Complaint on appeal from District Justice Judgment aa in the instant case, and, therefore. Pelverme, supra, is inapplicable to the case sub judice, Furthermore, in Pelverme, supra, the appellant was unrepresented by counsel, The recurrent theme in theae caaea is that the liberal interpretation of Rule 126 is to apply where appellants are unrepresented by counsel but, as in the instant case where counsel was 11 ."i involved, and in those CBBeB where counsel are involved and know the procedure, the failure to follow roquhito procedure is not countenanced all "good caUlle" lind, all a result, the failure to file required documentll in a timely manner which directly affect the right of appeal has been held to be, in and of itself, prejudicial to the appellee and, in those calles, insufficient good cause is demonstrated and the appealll are not reinstated. It is admitted that the paper file maintained in the office of the Prothonotary of Cumberland County contains a copy page of the Notice of Appeal form from District Justice Judgment, time-stamped by thp. Prothonotary's Of f ice July 24, 1996, However, it is further admitted that the computer docket entry system maintained in the prothonotary's Office contains an entry as to the date on which Plaintiff's appeal was filed as "7/15/96 APPEAL FROM DIS'l'RICT JUSTICE Jt1DGMENT" , See true and correct copy of print -out from Cumberland County Prothonotary'S Office, attached hereto as Exhibit "8", incorporated herein by reference. It was upon the aforesaid computer 1 entry (Exhibit "13") that Defendant averred in its Rule 1006 Praecipe to Strike Plaintiff' s Appeal that tho filing of Proof of Service of Notice cf Appeal on July 29, 1996, was untimely and on a date beyond tile ten (10) day period require<1 for the same by Rule 100sa of the RUles of civil Procedure relating to District Justices - Appeal, as said date (July 29, 1996) also appears on Exhibit "a" entitled "PROOF OF SERVICE OF NOTICE OF APPEAL IIND RULE TO FII,E COMPLAINT, II It is further admitted that Plaintiff filed a "PRAECIPE FILrm PURSUIINT TO RULE 1006 OF THE RULES OF CIVIL PROCBDURB RELATING TO DISTRICT JUSTICES - APPEAL - TO STRIK&: THE APPEAL OF COMMONWEALTH SECURITY SYSTEMS INC PLAINTI FF I APPELLANT HEREIN". the same fi led pursuant to and in conformity with Rule 1006 of the Rules of civil Procedure relating to District Justi~es - Appeal, pursuant to which on the same date the Prothonotary of Cumberland County did strike the appeal, A true and correct copy of the Rule 1006 Praecipe filed by Defendant is attached het'eto as Exhibit "C", incorporated herein by reference, Said Praecipe was f Ued on behalf of Defendant in accordance with the Rules of civil Procedure relating to District Justices _ Appeal, and for the reasons averred therein, the same was not filed as an unpermitted or non-designated instrument of civil procedure as suggested in Paragraph 1 of Plaintiff's petition to R~instate District Justice Appeal where the same is referred to by counsel for Plaintiff "", upon the ex parte application of Mark S, Silver, Esquire," See Plaintiff's Petition to Reinstate District Justice Appeal filed September 9. 1996, 2 2, 1. upon chlllcking with the Prothonotary's otf ice by telephone to determine the date on which Plaint it f' s Appea 1 from Diat l'ict Just ice Judgment was filed, counsel for the Defendant was advised that the Appeal fl'om Pistrict Justice Judgment was filed '1/15/96 as the same appears in the computer docket entry system maintllined in the Office of the Prothonotary of Cumberland county and as set forth on Exhibit "13", attached hereto, It was for that reason Pefendant averred in its Rula 1006 Praecipe, at paragraph 3 thereOf. that Proof of Service of Notico of Appeal filed July 29. 1996, wali a date beyond the ten (10) day period required for the Bame by Rule 100581 further, the 7/29/96 date on which Proof of Service of Notice of Appeal and Rule to File Complaint were filed in the Office of the prothonotary of Cumberland County iB as Bet forth on Exhibit "13", attached hereto, 2, Moreover, a diligent examination of both the paper (ile in the Office of the Prothonotary of Cumberland County and, as well, of the entries in the computer docket entl'y sYBtem maintained in the Prothonotary' B Office, a complete copy of which is attached hereto aB Exhibit liB", demonBtrate that no Complaint whatsoever waB filed in the Office of the Prothonotary of Cumberland county, Pennsylvania, within twenty (20) days of the date on which an appeal waB (allegedly) taken. whether the Bame waB July 15, 1996. as shown on Exhibit "13", or on July 24. 1996. as stamped by the Prothonotary on the District Justice Appeal form contained in the paper file at the Office of the Prothonotary of Cumberland County, Even as recent as September 30, 1996, no Complaint whatsoever appears of record in the Office of the Prothonotary of 3 Cumberland County, Pennsylvania, in this case, t\lither in the paper file or in the computer docket entry aystem, (Ji:)thibit "a", attached heJ:"eto and incorporated herein, compriaed of a copy/print -out of the computer docket entry ayatem maintained in the Office of the prothonotary of Cumberland county, pennayl vania, was printed at the r.equest of Defendant's counsel and hand-delivered to him by an employee of the Office of the prothonotary of Cumberland county on Monday, September 30, 1996,) 3, Denied. It is denied that July 24, 1996, "clearly appears from the docket records of this case" aa the date on which the appeal waa f Hed inaamuch aa Ji:xhibit "a", compriaed of a print -out of the computer docket entry system maintained in the Office of the prothonotary of Cumberland COIlllty, Pennsylvania, and relating to the instant case, contains no entry whatsoever as to a date on which any Complaint was filed on behalf of the within Plaintiff and against the within Defendant, It is admitted, however, that upon the personal inspection cf the paper fHe maintained in the Office of the prothonotary of Cumberland County, Pennsylvania, a copy of the Notice of Appeal from District Justice Judgment form is endorsed on its reverae aide by a stamp from the Prothonotary's Office evidencing its having been filed , July 24, 1996, 4, Without admitting or denying the averments set forth in paragraph 4 of Plaintiff'a Petition to Reinstate District Justice Appeal, it may well be accurate that Proof of Service of the appeal was timely filed on July 29, 1996, if the appeal was indeed filed July 24, 4 1996/ however, the print -out of the Prothonotary' B computer docket entry system does not substantiate the same, See Exhibit "8", 5, Denied, It is denied that Appellant can demonlltrate any reasonable basis upon which it can aver that it "believes and therefore avers" that it filed a Complaint at the prothonotary's Office on the same day the Notice of Appeal was filed, Appellant admits at Paragraph 5 of its own pleading (Petition to Reinstate) that "a search of the case file in said oHice didn't locate this document nor does the computerized docket include such an entry," Moreover, a copy of the Complaint allegedly filed, but denied by Defendant as having in fact been filed, but Which was served upon the Defendant bears no date of signature by counsel for the plaintiff, bears no date of signature on the Verification signed by Lisa J, GlaSB, Accounts Receivable Manager of the Plaintiff, and perhaps even more importantly, the same bears no time-stamp from the prothonotary's Office nor certification that the same is a true and correct of an original Complaint filed in the Office of the Prothonotary nor is the Bame certified as a true and correct copy from the record by the Off.ice of the Prothonotary, 6, It is admitted that Defendant t'eceived by mail a copy of what is purported to be a Complaint filed on behalf of Plaintiff and against Defendant, the same without time-stamp from the Prothonotary's Office and without certification as being a true and correct copy from the record by either Plaintiff's counselor the Office of the Prothonotary and, further, the same is undated at the place of signature by Plaintiff' B counsel and, as well, the Verification signed by Lisa J, 5 Olass, Accounts Receivable Manager of Plaintiff, ill undated, Moreover, and as averred hl~reinbet'ore, no entry of the filing of a Complaint on behalf of Plaintiff and against Pefendant appears in the computer docket entry system maintained in the Office of the prothonotary of Cumberland County (see !Exhibit "B"), and no Complaint whatsoever is contained in the paper f Ue maintained in this cl\se in thft Of fice of tht! Prothonotary of Cumberland County, Pennsylvania, Moreover, pursuant to Rule 1004A of the Rules of Civil Procedure relating to Districts Justices - Appeal, "ti)f the appellant was the claimant in the action before the district justlce, he shall file a complaint within twenty (20) days after filing his notice of appeal" [emphasis added} The Note which follows the provisions of Rule 1004 provides as follows r The twenty days allowed the claimant-appellant under subdivision A will give him time to consider, among other things, matters under Rule 1007B, The procedure upon failure to file a complaint pursuant to a rule to do so entered under subdivision B will be governed by the Rules of civil Procedure (Pa,R,C,P, No. 1037(a)), It appears clear, therefore, that the Pennsylvania Rules of Civil Procedure will apply to n~tters on appeal from District Justice JUdgments wher.e, in the first instance and as a triggering mechanism, a timely appeal is filed, Thereafter, the issue of service of legal papers must be considered, In the instant matter, regardless of whether one oharacterizes the fi ling of a Complaint by an appealing Appellant'. I Plaintiff as "original process" or "other than original process," both Rule of civil Procedure 401 relating to the service of original process 6 and Rule 0140 relating to set'vice of legal papel;'s other than original process require that service be mude after the Complaint iff liild, In thfj instant matter, Plaint if f/Appeilant' 13 Petit iOIl to ReinstAte Oistrict Justice Appeal avers at paragraph 6 that" [n]otwithstandillg the foregoing, [preceding paragraphs of its own pleading conf i rming thllt no Complaint appears of record either in the paper file or entry in the computer docket. entry system), Appellant's attorney did serve a copy of the Complaint '" on Defendant by a letter (spend memo) dated and mailed to Defendant on July 26, 1996," Simply stated, the same ,does not conform to the requisites of the Pennsylvania Rules of civil Procedure which require both for original process and legal papers not comprising legal process that a Complaint must be first. f Hed before any "service" of the same can be ef fected (or claimed) , It follows, therefore, that if no proper Complaint was ever filed of record in the Prothonotary's Office, that no "service" of the same can be meaningfully effected, , 7, Notwithstanding the averments set forth in paragraph 7 of Plaintiff's Petition to Reinstate District Justice Appeal, the same are denied as having :Uly affect whatsoever on the instant case inasmuch as without there having first been a Complaint filed in the Office of the Prothonotary, there can be no default, Thus, a Pa,R,C,P, Rule 237,1 Notice of praecipe for Entry of Judgment by Default for Failure to Plead is of no effect where there is no Complaint filed of record either in the paper filed maintained in the Prothonotary's Office or entered in the computer docket entry system also maintained in the Prothonotary's Office (see Exhibit "B") , 7 O. With all due respect to this ~onorable Court and to Plaintiff/ s counsel, tho undlH'signed attorney is aware of no Pennsylvania RUle of civil Procedure, either relating to civil actions or to appeals from Entry of Judgment by District Justice requiring him to make inquiry of Appellant's attorney to advise that the original Complaint was not in the Prothonotary's f. ile. Moreover, foot.note 1 at Paragraph 8 of Plaint iff's Pet it ion to Reinstate District Justice Appeal is wholly irrelevant to the involved issues as at no time has Defendant denied receipt of mailings from Plaintiff's counsel (proposed copy of Complaint and proposed Rule 237.1 Notice) I rather, the issue now before the Court is whether or not there is good cause why the Plaintiff's Appeal from the District Justice Judgment, stricken by the Prothonotary upon Rule 1006 Praecipe for the same, should be reinstated. It is Defendant's position that for the factual reasons set forth above, the appeal as stricken by the Prothonotary pursuant to Defendant's Rule 1006 Praecipe should not be reinstated and the Appeal shOUld remain stricken from the record in accordance therewith. 9. With respect to the alleged Complaint itself, the same is deficient in that it fails to comport with Pennsylvania Rule of Civil Procedure 1019 (h) as the body of the Complaint makes reference to a contract (Exhibit "A" of Complaint) and charges incurred (Exhibit "B" of Complaint) but the Complaint does not have attached to it said Exhibits as the Complaint avers it does and, as well, the Complaint fails to state any reason why said Exhibits which are averred in the Complaint as having been attached thereto, are not attached, or not B accessible to Defendant and, further, no reason or substance of the writings themselves are set forth. Defendant's counsel is not unmindful that the foregoing Paragraph is more suggestive of averments which would be plead by way of Preliminary Objection to the Complaint, had the same been filed in accordance with the Rules of civil Procedure and service of the same appropriately effected upon the Defendant I however, the averment points out another of the many deficienci es. 10. It is noteworthy that in the proceeding before District Justice Manlove, the same brought about and scheduled by and on behalf of Plaintiff herein, neither the Plaintiff nor any representative or witness on its behalf, nor counsel appeared in a good faith ~ffort to prosecute the case. 11. Plaintiff has failed to comply with the RUles of Procedure relating to Appeals from District Justice Judgments and Complaints rllquired in pursuance of an appeal taken therefrom and, further, has demonstrated no conduct on the part of the Prothonotary'S Office in complicity therewith and, as a result, it can only be concluded from the facts averred that no Complaint whatsoever was ever filed in the instant case. Plaintiff/Appellant herein is, therefore, not entitled to have its appeal, previously and properly stricken by the Prothonotary on August 23, 1996, (pursuant to Defendant's Rule 1006 Praecipe for the same) reinstated. The appeal taken on behalf of Plaintiff/Appellant herein was not accomplished in conformity with the applicable Rules and Plaintiff/Appellant is not entitled to the reinstatement thereof. 9 12. Defendant herein will suffer pr'lfjudice and great harlll in the event the instant appeal, previously and properly st.ricken by the Prothonotary pursuant to the RUle 100~ praecipe, iR reinstat~d in that by its effort to demonstrate good cause why the same ahliuld not be reinstated, Defendant has averred facts and matters to this Honorable Court wh~ch may serve to its detriment in defending allY action as the Plaintiff now knowa them, and as well, Defendant has incurred legal fees and expenses, to secure the striking of date, to plaintiff/Appellant's appeal on August n, 1996, and in responding to the instant Rule to Show cause, all occasioned as a result of Plaintiff's erroneous appeal and its failure to have followed the Rules of civil Procedure relating to the same. WHEREFORE, Defendant/Respondent (Appellee 'ravern on the Hill, Inc.) respectfully requests this Honorable Court to discharge Plaintiff/Appellant's Rule, refuse to reinstate its appeal, and uphold the decision by the prothonotary of Cumberland county, Pennsylvania, on August 23, 1996, that the appeal was stricken in accordance with Defendant's Rule 1006 Praecipe for the same. Commonwealth aerved a copy of the complaint on Defendant on .; r IA..I" Ju.l:X.2E.I. 1996. Ii" ' i ( . v I ,/ 4. Commonwealth timely filed ita Proof of Service of the Notice of Appeal on July 29, 1996. 5. On Auquat 19, 1996, Commonwealth acnt to Tavern the 10 day notice required before judqment (par Pa. R.C. P. 237.1). 6. (commonwealth either did not file its complaint in the Pro,t-honotary's off ice wi thin the 20 days required by R. C. P. D. J. 1004 (I\) , su: it did file same and was not properly docketed or filed by the Prothonotary. ) 7. On Auquat 23, 1996, without any inquiry or warninq not.ice from Tavern's attorney to Commonwealth'a attorney, Tavern filed ita ex parte praecipe to the Prothonotary to strike Commonwealth's appeal, and it was so stricken on that date. 8. Commonwealth thereafter on September 9, 1996 filed its petition to reinstate the apPflal, which l.ncludes as Exhibit "AU a copy of the complaint (not heretofore in the file of this caae) . 9. On September 11/ 1996, the Court issued a Rule upon Tavern to show oaUSe why the appeal should nut be reinstated. 10. On October 2, 1996, Tavern tiled Its AnSWer to the Rulo. II. Issue Presented Where a party has timely filed its District Justice Appeal and served it upon Defendants alon9 with a copy of the complaint, but where throu9h inadvertence the ori9inal was not timely filed and the Defendant ex parte causes the appeal to be stricken, should the appeal be reinstated upon the appellant's prompt application therefor? IU. Araumet\1 A. ON 'rHE ABOVE FACTS, THE APPETlL SHOULD BE REINSTATED. I In Primis, we shOUld note that all of the r/jlcited facts in section I of this brief have been admitted and/or are tacts of record, save possibly for Commonwealth's averment that the complaint was either timely filed with the prothonotary and misplaced by that office, or was inadvertently not filed by Commonwealth. ordinarily, we assume that the Prothonotary's file and docket entries are sacrosanct and do not inquire into their accuracy. However, as Tavern itself points out, in Section I of its Answer to the Rule, the prothonotary's docket entry that the appeal was filed on July 15, 1996 misstates the truth, which is that the appeal was filed on July 24, 1996. More importantly, and regardless of the correct explanation for the errant oriq\nal of the complaint, the salient fact remains that the appeal was timely filed, timely served and thera is no showinq of any prejUdice that has or will befall Tavern if it now has to defend on the Ipa. R.C.P.D.J. 1006 provides for reinstat/jlment of the appeal 'upon good cause shown. I merits, by vir-tulI of the oriQinal complail,t not bllinQ in the Prothonotary's file within the twenty day period. The Delverme case involves the same rule (10041\1 as instantly with the Commonwealth Court reversing the trial court and orderinq the reinstatement of the appeal, notwithstanding the party's failure to file a complaint. 'rhat Appellant failed to file a Complaint within 20 daYIl of the takin\l of tho l'.ppeal. 3. By virtue of the foreqoin\l, the Proof of Service was timely filed on July 29, 1996. 5. Appellant believes and therefore avers that. the Complaint wall filed in the prothonotary's office on the same day the Notice of I\ppeal was filed. However, a search of the calle file in said office didn't locate this document nor does the computerhed docket include such an entry. 6.
