15. The Plaintiff's position Qn oustody hI ss follows: The parties entersd Into
a Stipulation and Order dated 27 June 1996, The Father Is requesting e ohange
awarding him primary physical custody. Specifically, he Is requastlng that the ohlld
ba with him from Wednesday through Sundey. His primary concern Is thet he
believes that Mother's Involvement with a married men Is detrimental to the child.
His other ooncerns relate to the Mother's work schedule. He Indicated that he
bellevee he Is available for his son more often than his wife given the feot that he
works out of his home.
6. The Defendant's position on custody Is as follows: Defendent believes
that the current Order correotly was entered Into based upon the clients' respective
work schedules end that It was working well. She Indlcetas that the Order beceme
sn Issue only when she sot Involved with her paramour. She Indlceted thet her
work schedule Is such thet she works In the evanlngs es e bar tender from
Thurfldey through Sunday, but otherwise Is available during the day to take care of
the child. She did offer to axtend Thursday evening es enother period of time for
the Fether to have the child as Ions as she got the ohlld back during the dey on
Friday and then the ohlld would return In eccordance with the Order.

March of 1996, They were able to work out on ogroemont on custody. The
custody Order In effect essentlelly dove.tolls with the clients' respective work
sohedules.
Father's meln concern at the concllletlon was the effect of the Mother's
Involvement with e merrled man upon the child. Fether felt quite strongly that the
Mother's Involvement with 0 married man should not be In front of his son end he
believes thet this relationship Is detrimental to his son's best Interosts.
The Conciliator sussested to the parties thot they consider medletlon In ordor
to try to work through this. The portles, unfortuncttely, ore at 0 stata that they
cannot deal with each other at 011. Mother wos receptive to mediation, but Father
was not. Father felt quite strongly that he was best suited to be the primary
custodial parent of the child.
The current schedule that the pertles ore under fits perfectly within their
work schedules. Mother Is available during the day to core for the child from
Monday through Friday, and Father Is available on the weekends. It seems to the
Conciliator that the dispute centers around Mother's lifestyle more than whet fits
best for the child,

AND NOW comes the above-named Defendant, by her attorney, Samuel L, Andes,
and meke, the following Answer and Countercletlm to Plaintiff's Petition to Modify
Custody In this matter:

2, Admitted except the Defendant's name Is Linda Kessler,
3, It Is admlttad that Plaintiff seeks prlmery custody of the parties' son but It Is
denied that he Is entitled to have custody or that such a change would be In tha bast

Defendant hereby raises the folloWing Countar.Clalm In this mattar:
12, The minor child who Is the subject of this litigation, Mitchell Buffington Is a
minor child who was born on 20 May 1993 ond who has resided In tha primary custody
of the Defendant Illnoe his birth,
13, Up to tha present time, the Plaintiff has had physical custody of tha child
every weakand from Friday until Monday, Otherwise, except for vacations end holidays,
the child has been with the Defondent,
14, The Defendant has recently remarried and moved with her new husband to
Marysvllle, She and her new husband halVe a new Infant child so the household consists
, of the four people,
16, Bacause of the change In circumstances, the present custody schedule Is not
workable and will not provide for the best needs of the child, As a result, Defendant
requests this court modify the current custody schedulo to provide es follows:
A, The Defendant will have primary physical custody of the child who will live with
her and attend school In the school district In which Defendant and her family reside; end
B, The Plaintiff/Father will have periods of temporary custody conslstlns of
alternating weekends from Friday after school until Sunday even Ins at 6:00 p,m" the
holidays provided In the prior orders, and each perent will have two weeks of vacation
tlma with the child each summer,
Defendant believes that such a schedule will provide for the best Interest of the said child
and stili maintain a close relationship with both parants,
WHEREFORE, Defendant prays this court to modify Its prior orders to award her
primary physical custody of the child and to award the Plaintiff periods of temporary
custody three weekends out of four, some holidays, and two weeks each summer,
