"OWNER"). The parties have entered into an agreement (herein "AGREEMENT") whereby the CONTRAC'l'OR undertook Ilnd agreed to erect and con.truct a Mixed Use nuilding on that certain lot of ground owned by OWNER and situate in Dorough of Shippensburg, cumberland County, Pennsylvania, more particularly described in schedUle "A", which is attached hereto and which is incorporated herein by reference, whioh has an address of 26-42 East King street, Shippensburg, Pennsylvania 17257. UNDER AND SUBJECT to Public street rights-of-way, conditions concerning support and overlap of building to West (now 1824 King Street Partnership) as created in Deed Book "E", Volume 0, Page 533 and mentioned in Deed Book "E", Volume 36, Page 504, Also under and subjeot to any conditions and notations as noted in the above referred to Land Development Plan. .'
