and between R S MOWERY' SONS, INC (hereinafter referred to as
"CONTRACTOR"), and SHIPPEN PLACE PARTNERS (heuinathr reterred to
a. "OWNER"). The parties have entered into an agreement (herein
"AGREEMENT") whereby the CONTRAC'l'OR undertook Ilnd agreed to erect
and con.truct a Mixed Use nuilding on that certain lot of ground
owned by OWNER and situate in Dorough of Shippensburg, cumberland
County, Pennsylvania, more particularly described in schedUle "A",
which is attached hereto and which is incorporated herein by
reference, whioh has an address of 26-42 East King street,
Shippensburg, Pennsylvania 17257.
NOW THEREFORE, 'l'IHS AGREEMEN'l' WI'l'NESSETH I
'L'hat the
CONTRACTOR, for and in consideration of the sum or ($1,00) Dollar
to CONTRACTOR in hand paid by OWNER, the receipt whereot is hereby
acknowledged, and the further consideration mentioned in the
Agreement between the parties,
for themselves and their
subcontractors, and all parties acting through or under them,
covenant and agree that no mechanic's liens or claims shall be
filed or maintained by them or any of them against the buildings
and the lot of ground appurtenant th~reto (as referred to above)
for or on account of any work done or materials furnished by them
or any of them under the Agreement or otherwise, for, towards, in,
or about the erection and construction of the building(s) on the
lot above described, and the CONTRACTOR, tor themselves, their

BEGINNING at a railroad spiku at the intersection of
South Apple AVellue and East Neff Avenue at the southeast
corner of the within described property, thence South

The foregoing description was taken from a plan entitled "Land
Development for SHIPPEN PLACE" prepal."ed by CarlO. Bert,
protessional Land Sur.veyor, dated October 27, 1995, which plan has
received approvals frcm the appropriate municipal Author.ities as
and for a Land Development Plan and is recorded in the office of
the Recorde~ of Deeds, in and for Cumberland County, Pennsylvania,
in Plan Book 71, Page 96.
UNDER AND SUBJECT to Public street rights-of-way, conditions
concerning support and overlap of building to West (now 1824 King
Street Partnership) as created in Deed Book "E", Volume 0, Page 533
and mentioned in Deed Book "E", Volume 36, Page 504, Also under
and subjeot to any conditions and notations as noted in the above
referred to Land Development Plan.
