county, Pennsylvania.
3. Plaintiff is a bona fide resident of the Commonwealth of
Pennsylvania and has been so for at least six months immediately
previous to the filing of this complaint.
4. plaintiff and Defendant ~ere married on June 2, 1989,
in Dauphin county, Pennsylvania,
5. There have been no prior actions for divorce or
annulment between the parties.
15. The Defendant is not a member of the Armed Forces of
the united States of America or its Allies.

counseling and the right to request that the court require the
parties to participate in counseling. Knowing this, Plaintiff
does not desire that the Court require the parties to partioipate

1. Petitioner, Linda W. Moles, is an adult individual
residinq at syoamore Apartments, Apartment 8,
Pennllylvonia.
~. Respondent, John R. Molee, i. an adult individual whoae
Schellsburq,
current whereabouts is unknown, but who is represented by
counsel, Hubert X, Gilroy, Esquire.
3, On or about July 3, 1996, Petitioner made the decision
not to return home from a business trip because of Respondent's
bizarre behavior,
4. Petitioner so informed Respondent that she was not
returninq home.
5. On or about July 30, 1996, Petitioner filed a Complaint
in Divoroe oiting irretrievable breakdown and indignities.
6. In that divoroe Complaint, Petitioner sought equitable
distribution of the marital property, as well as the distribution
of the real estate located at 329 Garland Drive, Carlisle,
Cumberland County, Pennsylvania,
7. The real estate located at 329 Garland Drive, carlisle,
Cumberland county, Pennsylvania, was the marital residence.

B. up until sunday, September B, 1996, Petitioner was under
the impre..ion that Re.pondent .till resided at the marital
re.idenoe.
9. on or about septomber B, 1996, Petitioner went to the
marital residenoe to piQk up hor remaining personal item. and her
premarital property, as well as to remove some living room
furniture.
10. On that date, she and four other adult. and
Petitioner'. grandohild entered the marital residenae.
11. At the time that they entered the marital residenoe, it
was obvious that the residence had been stripped of the
furniture, all the marital property, Petitioner's premarital
property, Petitioner's business items, and doouments whioh Ms.
Moles requires for her work.
12. At that time Officer Kotz, an employee of the Carlisle
Polioe Department, was oontaoted beoause one of Petitioner'.
premarital items missing from the marital residenoe was a pistol
registered in Ms. Moles' name.
13. A business card belonging to Craig Shilling tor "Let'.
Move It" moving oompany was discovered by Petitioner in the
residenoe.
14. Mr. Shilling oonfirmed to her that his company had
removed the items at the request of Petitioner.
15. Mr. Shilling could not recall when his company removed
said items, but believed it was appr.oximately one month before
Petitioner appeared on Septomber B.

marital property listed on Exhibit "13" plaoed in storage for
whioh Petitioner would be willing to pay FIFTY (50') PERCENT of
the storage fee per month until the divorce matter is settled.
20. Petitioner also requested through her counsel that all
of the premarital items be returned to her immediately, as well
as her busineos items which were missing,
21. Respondent's counsel was informed that should these
items not be returned to her uy the end of. business on September
13, 1996, a Petition for Special Relief would be filed.
22. To date, Petitioner has not had a response from the
~espondent regarding either the marital property or the
premarital property,
:13. Due to the bizarre oondition of the m"rital reeidenoe
when Petitioner entered it on september 8, 1996, Petitioner
believes that the Respondent may destroy the marital prop"rty, as
well as Petitioner's premarital property,
24. Respondent has sent faosimiles and first olas. mail to
Petitioner, leading her to fuar for her life. oopies of which are
attaohed hereto and incorporated herein as E~libit He".
2a. It is Petitioner's wish that this divoroe matter be
settled as oivilly as possible.
26. Petitioner believes the best way to settle this matter
is to, first, have the marital proper.ty plaoed in a storage unit.
27. Petitioner believes that the marital property should be
appraised so that a Property Settlement Agreement can aocurately
refleot the Value of the marital property,
WHEREFORE, Petitioner requests this Honorable Court to order
the following t
(a) That Respondent return the premarital property of
Petitioner to Petitioner through the parties' attorneys. Baid
property will be returned to Petitioner in the same oondition as
it was when Petitioner left in June of 1996 for her business
trip.
(b) That the marital property removed by or at the
request of the Respondent will be placed in a storage unit and
inventoried.
(0) That said marital property in the storage unit
will be appraised by a professional appraiser.

1. Patitioner is Linda W. Moles an adult individual

3. on or about September 20, 1996, Petitioner filed a
Petition For Special Relief seeking, among other things, that
marital property removed from the marital residence at or by the

stllrage unitr and that Petitioner's pre-marital property be
returnert to Petitioner through the parties' attorneys.
4. On or about September 20, 1996, an Order was entered by
Judge Wesley Oler, Jr. ordering that an accounting would be
prllvided within thirty (30) days ot the date at the Order by both
parties as to all the marital and pre-marital property removed by

the partie. trom the marital residence ~nd each party shall
indicate the property'. present location. Each accounting was to
be acoompanied by a verifioation. A copy ot said Order is
attached hereto and inoorporated herein as Exhibit "A".
&. Petitioner'. aooounting was fiLed on or about October
lIS, 1996.
6. To date no aooounting has been filed by Respondent.
7. Petitioner's counsel has received a handwritten list
enclosed with a letter from Respondent's counsel. Said list is
not an aooounting of pre-marital and marital property removed
from the property by Respondent. A oopy of said list is attaohed
hereto and incorporated herein as Exhibit "B". A list of pre-
marital and marital property not aooounted for by Respondent is
attaohed hereto and incorporated herein as Exhibit "C".
8. HUbert X. Gilroy informed Petitioner that an accounting
would be tiled by Respondent by october 28, 1996.
9. Petitioner's accounting is the only aocounting of reollrd
of any marital and pre-marital property in this matter.
WHEREFORE, Petitioner requests that the Court Order that
Petitioner's acoounting is the final accounting of said marital
and pre-marital property, that a hearing be held as to the
location ot the remainder of the marital and pre-marital property

attorneys requestinq the Court Order the Accounting tiled by
Petition~r on or about October 16, 1996 be declared a final
Accounting and in support thereof aver~ the following,
1. Petitioner is Linda W. Holes an adult individual
re.iding at Sycamore Apartments, Apartment 8,
Pennsylvania.
2. Respondent is John R. Holes an adult individual whose
Schellsburll,
ourrent whereabouts is unknown, but who is represented by
counsel, Hubert X. Gilroy, Esquire.
3. On or about September 20, 1996, Petitioner filed a
Petition For Special Relief seeking, among other things, that
marital property re~oved from the marital residence at or by the
request of Respondent would be inventoried and placed in a
storage unitr and that Petitioner's pre-marital property be
returned to Petitioner tilrough the parties' ~ttorneys.
4. On or about September 20, 1996, an Order was entered by
Judge Wesley Oler, Jr. ordering that an accounting would be
provided within thirty (30) days of the date of the Order by both
parties as to all the marital and pre-marital property removed by

5. Petitioner's accounting was tiled on or about Octob.r
16, 1996.
6. To date no accounting has been tiled by Respondent.
7. Petitioner's counsel has received a handwritten list
enclosed with a letter trom Respondent's counsel. Said list is
not an accounting ot pre-marital and marital property removed
trom the property by Respondent. A copy llt said list is attached
hereto and incorporated herein as Exhibit "B". A list ot pre-
marital and marital pr.llperty not accounted tor by Respondent i.

8. Hubert x. Gilroy intormed Petitioner that an accounting
would be tiled hy Respondent by October. 20, 1996.
9. Petitioner's accounting is the only accounting ot reoord

Petitioner's accounting is the tinal accounting ot said marital
