A, , On or about July 29, 1996, at the horn a of Defendant's parents, after
an argument, Plaintiff attempted to leave Defendant In order to oalm
down, Defendant pursued her, lifted her by the shirt, and threw har
aoross the back yard. When she fell to the ground, Defendant
approached her again, lifted her by the arms and threw her once
again, He took hEIr by the arms or by the shirt et least six (6) times,
lifting her off her feet each time and throwing her to the ground 50 that
she lost her shoes and her hat, At one point, he dragged her, lying on
the ground, down a gravl:lllana, During the attack, Defendant shouted
at Plaintiff, "You want abuse, I'll show you abuse," Plaintiff was In fear
for her safety. After the attock by Defendant, Plaintiff was taken to
Carlisle Hospital where bruises were revealed on her upper arms, her
buttocks, and her leg, The bottom of her feet were In pain from being
thrown onto the hard ground after her shoes were lost In the attack.
Defendant was arrestad by the Pennsylvania State Police and charged
with simple aSfiault.
B, In the course of their marriage, on two separate occasions, Defendant
has, In a fit of tamper, hit Plaintiff on her arms, In addition, In a fit of
temper, Defendant has been violent In and around the parties' home,
punching holes In the walls and throwing dlshas on tha floor, Within
the last year, Defendant has, In anger, kicked through the screen on
the partlns' door, These bursts of anger and violent actions have
made Plaintiff afraid of Defandant,
6. Plaintiff believes and therefore avarsthat she will be In Immediate and present danger
of abuse from the Defendant, and that she Is In need of protection from such abuse,
7, The Plaintiff desires the Defandant be ordered to refrain from any contact with her,
8, The Plaintiff desires the Defendant be ordered to refrain from any harassment or
stalking of her,

1, Denied, Admitted as to Wife's name, however al all times relevant to this action,
Wife resided with the Husband's FalhtJr and Mother, Daniel R. and Sandra K.
Eckenrode allhelr home al1818 Walnut Bottom Road, Carlisle, PA, having moved
out of the marital residence on or about July 16, 1996,

1984, and has never moved out l)f that home,

5. Denied, H\Jsband specifically denies ~ striking Wife or threatening, menacing or
causing Wife any bodily harm, let alone serious bodily InJuries,
a) Denied, On July 29, 1996 at the home of Daniel & Sandra Eckenrode and In
the presence of Wlfe'tS Father, Bobby Ray, Wife became verbally abusive to
Husband's Falher, who asked Wife 10 leave, stating "Get your bags and
leave, you're no longer welcoma here", Wife refused and beceme even more
abusive to Husband's father, and also 10 her falher who was attempting 10 get
Wife Into his car, and to Husband, Wife's falher finally succeeded In getting
Wife Into his cer to leave, when Wife, wllhout warning, Jumped from the cer,
ran around the house, and hid, crouched under lools In a workshop,
Husband assisted his father in removing Wife from the workshop and
escorted her back to har falher's car. Wife resisted the entire way, and at
one point lost her balance and fell. Wife was plcked,up by Husband's father

car, Wife again attempted to get out of the cor, but was forcibly restrained by
her father, who was finelly abll'l to leave wllh Wife, Husbend speclficelly
