PRELIMINARY OBJP-CTION IN THE NATURE OF A MOTION TO STRIKE FOR FAILURE TO CONFORM TO LAW OR RULE OF COURT 6. In addition to oeeking to void the lease of the real estate at issue, Wife requests that she be granted possession of said real estate. 7. In order to do so, Michael Kadenko would of necessity be required to be removed from the demised premises. 8. Notwithstanding that the Court has already rejected this requested relief (see Exhibit "N" to Plaintiff's Complaint, oopy of Judge Oler's Order of July 5, 1996), the Plaintiff was required to bring an action in ejectment in order to secure the desired - 2 - relief, purluant to Rulul 1051-106U of the PQnnlylvania RuLe. ot civil Procedure. 9. There is a prior action, still ongoing, between Tammy Stambaugh as Plaintiff and stanley Stambaugh, o. Defendant, tn divorce, which focuoes in part on the real estate at i.sue. This action is docketed at 96-1709 civil Term in the Court of Common Pleas of cumberland County, Pennsylvania. 12. The Defendant in the present action, Michael Kadenko, is in privity with the Defendant in the prior action, Stanley Stambaugh, as both are the parties who executed the lease which Plaintiff Tammy Stambaugh is challenging. 13. The real estate at issue - 713 Sherwood Road, New Cumberland - is a part of the marital estate to be equitably distributed in the divorce action docketed at 96-1709 Civil Term. - 3 - A hearing is scheduled tor October 5, 1996, to determinu, nmong other matters, what occurs with regard to the marital residence. 14. Th. precise reliet s~ught by virtus of th~ instant complaint - an award ot possession of the "~rita1 residence to Wite - has been denisd by Judge Olsr in the prior aotion (see Bxhibit "N" to Plaintiff's Complaint). 15. Not only is the present action barred by the dootrine of res judicata or claim preclusion, it is subject to the asserticn of a Preliminary Objeotion because the subject matter is part ot a proceeding still pending, .~, the equitable distribution forming a portion of the divorce action. WHEREFORE, it is requested that the Ccurt grant the Preliminary Objection founded upon the pendency of a prior proceeding and, accordingly, dismiss the Complaint filed by Plaintiff Tammy stambaugh. IV. PRELIMINARY OBJECTION IN THE NATURE OF A DEMURRER 16. Plaintiff's effort to invalidate the lease between Stanley Stambaugh and Michael Kadenko, as well as to diApossess Kadenko from the demised premises, aseumes two legal conclusions, ~ ~, al that Stanley Stambaugh possessed no authority to bind wife in the leasehold transaction I and, bl that Wife has authority to both evict Kadenko and to possess the marital home herself. 17. Detendant, MICHAEL KADENKO, is an individual currenl:ly residing at 713 Sherwood Road, New cumberland, cumberland county, Pennsylvania 17070, as a lessee ot the premises. 3. Plaintitf is currently married to Stanley R. Stambaugh, an individual incarcerated at the Cumberland County Prison, 1101 Claremont Road, Carlisle, Pennsylvania l701J. 4. Plaintitf and Mr. Stambaugh are the owners by tenants by the entireties of real estate located at 7lJ Sherwood Road, New cumberland, Cumberland county, Pennsylvania 17070. A copy of the Deed to said real estate is attached hereto and incorporated herein as Exhibit "A". 5. On or about March 4, 1996, Plaintiff was forced to I:emporarily remove herself trom the marital residence due 1:0 an incident of physical abutie by Mr. Stambaugh. 6. Atter removing herself from the marital residence, Plaintitf temporarily moved in with her parents at 5 Penny Lane, Bnola, Pennsylvania 17025. .. " . . 7. Plaintiff believel and therefore avers that Mr. stambaugh entered incarceration at I:he oumberland county Prilon on or about April 19, 199&. 8, Plainl:itt filed a Complaint in Oivorce on April 1, 199&, which included a count for Equitable Distribution. 9. A copy ot the Amended Complaint and Petition tor Exclusive Use and Possession ot the Marital Residence were forwarded to Mr. stambaugh by tirBt class mail on May 17, 1996. Bee Exhibit "a" attached hereto and incorporated herein. 10. A copy ot the Amended complaint was forwarded to Counsel tor Mr, Stambaugh, Herschel LOck, EsqUire, by first closs mail on May 22, 1996. See Exhibit "C" att4ched hereto and incorporated herein by reterence. 11, In attempts to directly serve Mr. Stambaugh with th~ Complaint in Oivorce, certitied copies were forwarded to Mr. Stambaugh c/o the Cumberland County Prison by certified mail, restricted delivery. Sell Exhibits "0" anti "E" attached hereto and incorporated herein. 12. Counsel for Mr. Stambaugh, Herschel Lock, Esquire, accepted I8rvice of the Complaint in Oivorce on May 29, 1996. See Exhibit ifF" attached hereto and incorporated herein. 13. Plaintiff tiled an Amended Complaint in Oivorce on May 20, 1996, which included counts tor Equitable Oistribul:ion and Exclusive Possession of the Marital Residence. 14. Plaintitf tiled a Petition for Exclusive Use and Possession of the Marital Residence on May 22, 1996. . . - . lS. counsel for Mr. stambaugh/ Herschel Look, Esquire, accepted service ot the Complaint in Divoroe on May 29, 1996, 16. An Order of Court Wall Qntered on JunQ 4, 1996, whioh soheduled a hearing for the Petition for Exclusive possession on Friday, July 5, 1':/96, l7. On or about June 4, 1996, Plaintiff learned that Mr. stambaugh had leased tha marital home to Defendant without Plaintiff's consent or authorization. 18. On June 4, 1996, Pluintiff's counsel forwarded a letter to Mr, Stambaugh's counsel, via facsimile and first class mail, clearly stating that the marital residence had been leased without Plaintiff's ccnsent or authorization. See Exhibit "G" ettachlld hereto and incorporated herein by reference. 19. On or about June 7, 1996, Mr. stambaugh's counsel fcrwarded a ccpy of the "lease" for the marital residence. See Exhibit "H" attached hereto and incorporated herein by reforence. 20. Said leose incorrectly lists Mr. stambaugh as the sole owner of the real eBtate, and omits Plaintiff's name entirely. 2l, Said leaBe is dated May 28, 1996. 22. Said leose was not signed directly by Mr. Stambaugh, but was signed by Susan Rudy, Mr. stambaugh's Power of Attorney, 23, Susan Rudy is Mr, Stambaugh's ex-wife. 24, Plaintiff believes and therefore avers that said lease was entered into after the Petition for Exclusive Possession was filed and forwarded to both Mr. Stambaugh and Mr. Stambaugh's Counsel. 25. Subsequent to receiving a copy of said "loase", Plaintiff's counsel forwarded two (2) letters to the lessee, Defendant Michael . . . ~adenko, by certified mail, restricted delivery. See ~Khibit8 "I" and "J" attached hereto and incorporated herein. ~6, The letter to Petendant datod June LOt 1996, indicated that Plaintift had tiled a Petition for Exclusive Use and Possession of the Maritlll Residence, lind that the "lease" WllIl blling leglllly disputed. See Exhibit "K" attached het'oto and incorporated herein by reference. 27. Tho letter dated June 12/ 1996/ indicated that Mr, Stambllugh had attempted to lease the marital residence without Plaintiff's knowledge or authorization, The letter further stated that the lease was void and informed Defendant that he muet vacate the premises within fifteen (15) days form the date that he received the letter. See Exhibit "L" attached Ilereto and incorporated herein. 20. Plaintiff believes and therefore avers that Mr. Stambaugh was aware that Pefendant had filed a Petition for Exclusive Use and POBsession of the Marital Residence, but proceeded to surreptitiously lellse the marital residence. 29.
