attorneys, the Law Office of Darrell C. Dethlefs, and in support of
the within Complaint avers as followsl
1. Plaintiff is Mark Hoopert, an adult individual residing
at 959 Pine Road, CarliSle, PA 17013,
2. Defendant is Gary G. Griffith, an adult individual
residing at 143 Red Tank Road, Boiling Springs, PA 17007.
3. Plaintiff, Mark Hoopert, is the owner, with his wife, of
the premises located at 959 Pine Road, CarliSle, PA 17013.
4. On or about November 8, 1994 Plaintiff, Mark Hoopert,
contracted with Defendant, Gary Griffith, Custom Builder, for
certain upgrading and repair work to be done to Plaintiff's home
located at 959 PJ.ne Road, Carlisle, PA 17013. A copy of sl1id
contract is attached hereto as Exhibit "A" and made a part hereof.
5. The Plaintiff, Mark Hoopert, has fulfilled all the
provisions of the agreement on his part to be performed.
6. The Deflilndant has not fulfilled the provisions of the
agreement on his part to be perfot~ed.

S. Defendant has performed in a poor, improper, and un-
workmen like msnner certain things which were expressly or by
necll8l1\ry implication required by the agreement to be done and
performed in a proper snd workmen like manner, IIll folloWl1
a. The rear 11 iding door was improperly and poorly hung
and would not properly 010B8.
b. The Beventeen (17) inch weather Btrip tor the front
door we. improperly installed causing said door to olose
impropeI'l y.
c. The Ular patio and kltchen door overhang and railing
and spouting ware improperly installed 80 to cause it to completely
collapse.

d. The thirty-six (36) square foot at twelve (l~) inQh
vinyl tile for the bathroom was improperly installed resulting in
said tile not to evenly meet the wall at the bathroom.
e. The bath....oom floor WBI!I not properly nailed and
secured cauQing the tloor to move and shift when walked upon.
f. The one (1) piece plenum near the r.urnaoe was
improperly and poorly made so as to cause it to collapse.
g. The smoke pipe to the furnace leaked.
h. The entire furnace was improperly installed cBusing
it not to work properly and to collapse.
i. The roof overhang above the kitchen and patio was
poorly installed so that the v-crimp does not match the standing
seam.
j . The front door overhang and spouting were improperly
installed so as to cause it to pull away from the house.
k. Defendant improperly used Plaintiff's wheel barrow
causing it to break.
1. Defendant, without permission, cut a limb from
Plaintiff's hickory tree in order for his truck to gain access to
Plaintiff's property.
m. Defendant improperly disposed of construction
materials and concrete by dumping it upon Plaintiff's property.
n. Defendant while worldng in the kitchen broke the
kitchen faucet and sink cross drain.
o. Defendant used incorrect size trim with respect to
the patio door frame and failed to varnish said trim.
p. Pefendllnt naused roof to tear and beQome damaged
while installing the kitchen overhang.
9. Pefendant has failed and refu~ed and still refuses to
cure the aeoresaid breeches, despite ~laintifr's repeated demand.
10. A reasonable cost of remedying the aforesuid breeohes is
$7,525.00.
WHEREFORE, Plaintiff demands judgment against Defendant in the
amount of $7,525.00 plus costs, interest and attorney's fees.

11. Paragraphll 1-10 above are hereby incorporated as if fully
set forth her~in.
12. On or about July 22, 1994, Plaintiff, Mark Hoopert,
contracted with Deeendant, Gary G. Griffith, Custom Builder, for
certain upgrading and repair work to be done to Plaintiff's home
located at 959 Pine Road, Carlisle, PA 17013. A copy of said
contract is attached hereto all Exhibit "B" and made a part hereof.
13. Thf.! Plaintiff, Mark Hoopert, has fulfilled all provisions
of the aforesaid agreement on his part to be performed.
14. Defendant has not fulfilled the provisions of the
agreement on his part to be performed.
15. The Defendant has wholly neglected to do and perform
certain things which were expressly or by necessary implication
required to be done and performed by the agreement, as follows;

door was improperly installed causing said door to close
improperly.
c. 'l'he rear pat~o and kitchen door overhang and railing
and spouting were improperly installed so to cause it to completely
collapse.

vinyl tile tor the bathroom was improperly installed resulting in
said tile not to evenly meet the wall of the bathroom,
e. The bathroom floor was not properly nailed and
secured aausing the floor to move and shift when walked upon.
f. The one (1) piece plenum near the furnace was
imprapA,rly and poorly made so as to cause it to collapse.
g. The smoke pipe to the furna~e leaked,
h. The entire furnace was improperly installed causing
it not to work properly and to Gollapse,
i. The roof overhang above the kitchen and patio was
poorly installed so that the v-crimp does not match the standing
s~am.
j, The front door overhang and spouting were improperly
installed so as to cause it to pull away from the house,
k. Defendant improperly used Plaintiff's wheel barrow
causing it to break,
1. Defendant, without permission. cut Ii limb from
Plaintiff's hickory tree in order for his truck to gain access to
Plaintiff's property.
m. Defendant improperly disp~sed of construction
materials and concrete by dumping it upon Plaintiff's property.
n, Defendant while working in the kitchen broke the
kitchen faucet; and sink cross drain.
o. Defendant used incorrect size trim with respect to
the patio door frame and failed to varnish said trim.
p. Defendant caused roof to tear and become damaged
while instBlling the kitchen ov.rhang,
~. Defendant has failed and refused and still refuses to
cure the aforesaid breeches, despite Plaintiff's repeated demand.
10. A reasonable cost of reme~ying the aforesaid breeches is
$7,525.00,
WHEREFORE, PlIIintiH demands judgment against Defendant in the
amount of $7,525.00 plus costs, interest a~d attorney's fees,

JlRliACH 011 CONTRACT
11. Paragraphs 1-10 above are hereby incorporated as if fully
set forth herein.
12. On or about July 22, 1994, Plaintiff, Mark Hoopert,
contracted with Defendant, Gary G, Griffith, Custom Builder, for
certain upgrading and repair work to be done to Plaintiff's home
located at 959 Pine Road, Carlisle, PA 17013. A copy of said
contract 113 attached hereto as Exhibit "B" and made a part hereof.

13. The Plaintiff, Mark Hoopert, has fulfilled all provil3ions
of the aforesaid agreement on his part to be performed.
14. Defendant has not fulfilled the provisions of the
agreement on his part to be performed.
15. The Defendant has wholly neglected to do and perform
certain things which were expressly or by necessary implication
required to be done and performed by the agreement, as followst

moves this Court, pursuant to Pa.R,C.P, No. 1034 for judgment on
the pleadings as follows I
1. Plaintiff conunenced this action against Defendant on
August 20, 1996, seeking to recover damages due to Opfendant' s
breach of contract as set forth in Plaintiff's complaint, a GOPy of
which is attached hereto as Sxhibit "A".
2. Defendant filed a response with the Cumberland County
Prothonotary's office on September 9, 1991$, a copy of which is
attached hereto as Exhibit "B".
3. Defendant failed to serve Defendant or Defendant's
attorney with said response.
4, Defendant's response is in violation of the pennsylvania RUles

1. Plaintiff is Mark Hoopert, an adult individual residing
at 959 Pine Road, Carlisle, PA 17013.
;2. Defendant is Gary G. Griffith, an adult individual
residing at 143 Red Tank Road, 8~iling Springs, PA 17007.
3. Plaintiff, Mark Hoopert, is the owner, with his wife, of
the premises l\,cated at .959 Pine Road, Carlisle, PA 17013.
4, On or about November 8, 1994 Plaintiff, Mark Hoopert,
contracted with Defendant, Gary Griffith, Custom Builder, for
certain upgrading and repair work to be done to Plaintiff's home
located at 959 Pine Road, Carlisle, PA 17013, A copy of said
contract is attached hereto as Exhibit "A" and made a part hereof,
5. The Plaintiff, Mark Hoopert I has fulf illed all the
provisions of the agreement on his part to be performed,

WHERBFORJi:, Plaintiff demands judgment against Defendant in the

and would not properly close.
b. The Beventeen (17) inch weather strip tor the front
door wa. improper,ly installed causing said door to close

c. The rear patio and kitchen door overhang and railing
and spouting were 1mpropet'lY installed so to cause it to completely
collapse.

d. The thirty-six (36) I9quare foot of twelve (12) inch
vinyl tile f.or the bathroom was improperly inotalled resulting in
said tile not to evenly meet the wall of the bathroom.
e. The bathroom noor was not properly nailed and
secured causing the floor to move and shift when walked upon.
f. The one (11 piece plenum near the I!urnacl!l was
improp~rly and poorly made so as to cause it to collapse.
g. The smoke pipe to the furnace leaked.
h. The entire furnace wal9 improperly installed caul9ing
it not to work properly and to collapse,
i. The rooL overhang above the kitchen and patio Was
poorly installed ~o that the v-crimp does not match the standing
seam.
j. The front door overhang and SpoUtil1g were improperly
installed so as to cause it to pull away from the house.
k. Defendant improperly used Plaintiff's wheel barrow
causing it to break.
1. Defendant, without permission, cut a limb from
Plaintiff'S hickory tree in order for his truck to gain access to
Plaintiff'S property.
m. Defendant improperly disposed of construction
materials and concrete by dumping it upon Plaintiff's property.
n. Defendant while working in the kitchen broke the
kitchen faucet and sink cross drain.
o. Defendant used incorrect size trim with respect to
the patio door frame and failed to varnish said trim.

cure thll aforesaid breeches, despite Plaintife's repeated demand.

amount of $7,525.00 plus costs, interest and attorney's fees.

1, plaintiff is Mark Hoopert, an adult individual reoiding

2. Defendant is Gary G. Griffith, an adult individual
residing at 143 Red Tank Road, Boiling Springs, pA 17007.
3. plaintiff, Mark Hoopert, is the owner, with his wife, of

4. On or about November 8, 1994 Plaintiff, Mark Hoopert,
contracted with Defendant, Gary Griffith, Cue tom Builder, for
certain upgrading and repair work to be done to plaintiff's home

contract is attached hereto as Exhibit "A" and made a part hereof.

Plaintiff, Mark Hoopert, by his undersigned counsel, respeotfully
moves this Court, pursuant to Pa.R,C,p, No, 1034 for judgment on
the pleadings as follows;
1. Plaintiff commenced this action against Defendant on
August 20, 1996, seeking to recover damages due to Defendant's
breach of contract as set forth in plaintiff's complaint, a copy of
which is attached hereto as IExhibit "A",
2, Defendant filed a response with the Cumberland County
prothonotary's office on September 9, 1996, a copy of Which is
attached hereto as Exhibit "B".
3, Defendant failed to serve Defendant or Defendant's
attorney with said response.
4. Defendant's response is in violation of the pennsylvania Rules
of Civil procedure 1029 as follows I

AND NOW, comes Plaintiff, Mark Hoopert, by and through his
attorneys, the Law Office of Darrell C. Dethl~fs, Bnd in support of
the within Complaint avers as followsl
1. plaintiff is Mark Hoopel't, an adult indJ,vidual residing
at 959 Pine Road, Carlisle, PA 17013.
2. Defendant is Gary G, Griff.ith, an adult individual
residing at 143 Red Tank Road, Boiling Springs, PA 17007,
3. plaintiff, Mark Hoopert, is the owner, with his wife, of
the premises located at .959 Pine Road, Carlisle, PA 17013.
4. On or about November a, 1994 Plaintiff, Mark Hoopert,
contracted with Defendant, Gary Griffith, Custom Builder, for
certain upgrading and repair work to be done to Plaintiff's home
located at 959 pine Road, Carlisle, PA 17013, A copy of said
contract is attached hereto as Exhibit. "A" and made a part hereof,
5, The Plaintiff, Mark Hoopert, has fulfilled all the
provisions of the agreement on his part to be performed.
6, The Defendant has not fulfilled the provisions of the
agreement on his part to be performed,

S, Defendant has pertormed in a poor, improper, and Ull-
workmen like manner eertain things which were exprellllly or by
neeeuAry implieation required by the agreement to be done and
pertormed in II proper and workmen liko manner, as tollowSI
II. The rear sliding door was improperly and poorly hung
and would not properly olose,
b, The seventeen (17) inch weather strip for the tront
door was improperly installed causing said door to close
impropel'ly.
c. The rear patj.,o and kitchen door overhang and railing
and spouting were improperly installed so to cause it to completely
collapse.
d, The thirty-six (36) squar~ root or twelve (12) inch
vinyl tile for the bathroom was improperly installed r~sulting in
oaid tile not to evenly meet the wall of the bathroom.
e. The bathroom noor wall not properly nailed and
secured causing the rloor to move and shift when walked upon.
f, The one (1) piece plenum near the rurnace was
improperly and poorly made so as to cause it to collapse.
g. The smoke pipe to the furnace leaked.
h. The entire rurnace was improperly installed causing
it not to work properly and to collapse.
i, The roor overhang above the kitchen and patio was
poorly installed so that the v-crimp does not match the standing
seam,
j. The front door overhang and spouting were improperly
installed so as to cause it to pull away from the house.
k, Defendant improperly used Plaintirf's wheel barrow
causing it to break,
1, Defendant, without permission, cut Ii limb from
Plaintiff's hickory tree in order for his truck to gain access to
Plaintiff's proper.ty,
m, Defendant improperly disposed of construction
materials and concrete by dumping it upon Plaintiff's property.
n. Defendant while working in the kitchen broke the
kitchen faucet and sink cross drain,
o. Defendant used incorrect size trim with respect to
the patio door frame and failed to varnish said trim,
p, Defendant caused roof 1.:.0 tear and become damaged
while installing the kitchen overhang,
9, Defendant haa failed and refused and still refuQ8a 1.:.0
cure the aforesaid preechea, deapite Plaintiff's repeated demand.
10. A reasonable cost of remedying the aforesaid breeches is
~7,525.00.
WHBREFORE, Plaintiff demands judgment against Defendant in the
amount of ~7,525,OO plua coats, interest and attorney's fees.
COUNT II
BRBACH OP CONTRACT
11. Paragraphs 1-10 above are hereby incorporated as if fully
a~t forth herein.
12. On or about July 22, 1994, Pla1ntif f, Mark Hoopert,
contracted with Defendant, Gary G. Griffith, Custom Builder, for
certain upgrading and repair work to be done to Plaintiff's home
located at 959 Pine Road, Carlisle, PA 17013. A copy of said
contract is attached hereto as Exhibit "B" and made a part hereof.

13, The Plaintiff, Mark Hoopert, has fulfilled all provisions
of the aforesaid agreement on his part to be performed.
14. Defendant has not fulfilled the provisions of the
agreement on his part to be performed.
15, The Defendant has wholly neglected to do and perform
certain things which were expressly or by necessary implication
required to be done and performed by the agreement, as follows I

WHEREFORE, Plaintiff demands judgment against Defendant in the
smount of $7,525.00 plus costs, interest and attorney's fees,
