1. corey BeI1nej:t, the minor Plaintitt, is the son or Teresa
Bennett, Petitioner herein, Corey is nearly 2~ years old, havinq
been born on February la, 1994,
2, On January 11, 1994, Teresa Bennett sustained injuries in
a motor vehicle accident.
3, At the time or the atoresaid motor vehicle accident,
Teresa Bennett was 6~ months preqnant,
". The racts and occurrences hereinafter relllted took place
on or about January 11, 1994, at approximately 7130 a,m., on
Interetate 83 near Exit 18, York county, Pennsylvania.
15. At that time and place, Plaintitt Teresa Bennett was
operatinq a 1983 Oldsmobile Cutlass ciera and was travellinq north
on Interstate 83, York county, pennlylvania.

directly behind Plaintiff 'fereaa Bennett,
7. At that time and placo, traffic was moving slowly and
Plaintiff Toresa Bennett had applied her brakos to stop in the line
of traffic,
B. At that timlil and place, Defendent Kirk A, Wright operated
hie vehicle at a high rate of speed, failed to stop for the Hoo of
atopped traffic, and struok the Bennett vehicle.
9, As a result of the aforementioned accident and injuries
au stained by Plaintiff 'feresa Bennott, minor Plaintiff corey
Bennett sustllined severe and serious inj ur ie6 which include but are
not limited to 11 week premature bi.rth resulting in an intracranial
hemorrhage placing minor Plaintiff Corey Bennett in NICU for 10 1/2
weeks. Hinor Plaintiff also suffered from motor ski lls def icit and
learning disabilities, chronic asthma and lung disorders,
10, As a result of the acoident, a claim was brought against
Defendant Kirk A_ Wright. said action is still pending to No, 95-
SU-05132-01 in the Court of Common Pleas of York county,
11. At the time of the aforesaid motor vehicle accident,
Teresa Bennett had automobile insurance issued by Defondant state
Farm Fire and Casualty company.

12. Said polioy included under insured motorist benefits in
the amount af $13,000 per person, $30,000 per oocurrenoe. A oopy
of the Declaraticn Page is attached as Exhibit A,
13, The Defendant herein has agreed, subject to the approval
of your Honorable Court, to compromise the claim of corey Bennett
for the sum of $15,000.00, said sum representing the insurance
policy limits.
14. lour Petitioner and his counsel b~lieve it io in the best
interests ot corey Bennett that the proposed settlement be aocepted
and approl/ed,
15, Petition through oounsel will oontinue to pursue all
claims versus the tortteasor,
16, should the Court deem it necessary to sohedule a hearing
to approve the settlement and, if a hearing is schoduled, corey
Bennett and Tereoa Bennett, parent of the Minor Plaintirf and
Plaintiff'. counsel will be present at the hearing,
17, lour Petitioner has retained the law firm of Angina ,
Rovner, P,c. to prosecute this action and has entered into a
contingency flle agreement with said attorneys whereby said
attorneys are to receive, for professional services, thirty percent
(30') of any amount recovered after suit is filed.

Hundred Ninety-Three and 315/100 Dollar. ($693.35 ) tor out-ot-
puoket expenses incurred in prosecuting this claim.
20. Petitioner avers that the remainder ot the settlement,
Nine Thousand Eili/ht Hundred Fifteen and 00/100 Pollars ($9,8115.00)
i. to be held in trust tor Corey Bennett in an aooount in a Bank,
a dapoeitory which is insured by the Federal li/overnment, provided
that no withdrawal will be made theretrom until Corey Bennett
reache. majority, except as authorized by Court Order.
WHEREFORE, Petitioner requests your Honorable Court to approve
the Minor's oompromise settlement and authorize the payment ot
attorney's fee. and expenses trom the fund due the minor and direct
pl\yment of Nine Thousand Eight Hundred Fitteen and 00/100 Pollars
($9,815.00) due to the mincr to be deposited in a bank in trust for
corey Bennett.

1. corey Dennett, the minor Plaintiff, is the Bon of 'rue.a
Bennett, Petitioner herein, corey iB approximately 2~ yearB old,
havin9 been born on February la, 1994,
2, January 11., 1994, Teresa Bennett was involved in a motor
vehicle accident. At the time of the accident, Ms. Bennett waB 5~
monthB pregnant,
3, Thereafter, TereBa Bennett sustained a placenta abruption
roquiring an emergency C-section on February 10, 1994,
4, AB a result of the accident, a claim was brought against
the tort feasor for liability coverage and state Farm for
under insured motoriBt coverage.
4. A settlement was reached betwelln 'l'erllsa Bennett, as
parent and natural guardian of Corey Bennett, and state Farm to
resolve minor Plaintiff's claim for the underinsured motorist
benefits of $15,000,00,
5, By Order dated August 5, 1996, th", Honorable Harold E,
Sheely approved the settlement, approved the payment of attorney' 8

fee. and expen.ee, and directed the balance of $9, Bll!, 00 to b.
deposited in an interest earning account in a bank for minor
Plaintiff, A copy of the Order is attached hereto ss Exhibit A.
7, The Order further required that the aforementioned
deposit be in a bl\nk or other account which is il1surec1 by the
federal government and that no withdrawal would be allowed until
minor Plaintiff attains majority or as authorized by Order of the
COllrt.
B. Minor Plaintiff's mother wishes to borrow $1,000,00 from
minor Plaintiff's account to pay oome overdue bills,
9, If approved, Teresa Bennett agress to repay the $1,000 in
26 monthly payments of $40.00 per month.
10, Petitioner herein requests your Honorable court for an
Order authorizinq the withdrawal of $1,000.00 from the
aforementioned account,
WHEREFORE, Petitioner Teresa Bennett respectfullY requests
your Honorablo Court to approve the instant Petition and authorize
th~ withdrawal of $1,000.00 from the minor Plaintiff's account to
be repaid in 26 monthly payments of $40.00 per month,
