'l'he Fathe~'s position on Custody ia as follows I The Father at"9ued that the Mother had aigned an agreement to sha~e custody of the Child on a weekly bads and then refused to honor the sgreement by denying him contact with the Child after Novembe~ 1996. According to the Fathe~, the Mothe~ changed the Child's daycare provide~ without hia consent and has refused to pr'ovidll him with the new daycare prOVider's identity and location. The Fathe~ also stated that when hI! had come to the former babyaitter' a home to aee the Child, the babyaitter contacted the poHce without any just.ification. The Father stated that the Mothe~ sttempts to place unreasonable conditions upon his abiHty to have contact with the Child. The child was born during wedlock and presently ia in the unauthorized, sole custody of Respondent who resides at the marital residence located at 1121 York Road, Mechanicsburg, Pennsylvania. 5. During the past three (3) years, the child has resided with both parents at 1121 York Road, Mechanicsburg, Pennaylvania. The natural mother of the child is Tracy L. Clouser, who currently resides at 1121 York Road, Mechanicsburg, Pennsylvania 17055. 6. The natural father of the child ia 'rimothy F. ClOUser who lives at 126 West Green street, Mechanicsburg, Pennsylvania, 17055. 7. The relationship of Petitioner to the child is that of father to son. Oerendant believes that mother ourrently resides with un- related adult, non-family member, male partner named Ted VanPelt. 9. Petitioner has not participl!ted as a party or witness, or in another capacity, in other litigation concerning the custody of the ohild in this or another court. Petitioner has no information of a oustody proceeding concerning the child pending in a court of this Commonwealth. Pet itl.oner docs not know of a person not a party to the prooeedings who has physical custody of the child or claims lo have oustody or visitation rights with respect to the child. 10. On or about, November 5, 1996, Petitioner and Respondent entered into a oustody ar.rangement ar1d agreement where the parties would share physical custody on a alternating, seven day period. A copy of the relevant portion of the Agreement is attached hereto as Exhibit "A". 11. Shortly after entering the agreement, wife improperly and blatantly refused to allow Petitioner any custody contact, and has acted in a manner contrary to the best interest of the child by failing to provide Petitioner with a timely and consistent custody contact in accordance with the terms of the agreement. 12. Respondent, for no justifiable basis, refuses to allow Petiti- oner any reasonable custody oontact or comply with the terms or the Agreement. 2 13. The best interests and permanent welfare of the child will be ..rved by ordering that both partieo share legal custody of the ohild and direoting that the present oustody order be modified with an Order entered governing the child's care, custody and control, providing Petitioner with primary physical custody for the following reasonSI (A) Petitioner is a fit parent who can take care of his ohild and who can provide him with a supportive, safe and healthy enVironment, (B) Respondent's conduct and behavior in not in the best interest ot the ohild in thatl (i) Respondent has failed to pr.ovide Petitioner with any custody of the child since November of 1996, has caused Petitioner substantial embarrassment by attempting to have him arrested for contacting the child at a daycare facility and has denied Petitioner with reasonable and telephone ond personal contact, and (ii) Respondent has disparaged Petitioner's reputation in the presence of the child ond haB failed to allow any contact between Petitioner and the child during the holiday season, and (iii) Respondent has placed the child in an uncertain environment without Petitioner's consent and Respondent continues to aot in an irresponsible manner by refusing Petitioner any oontact wi.th the child, and 3 (iv) Re.pondent has allowed unauthoriled per.ons to remove the ohild from daycare facilities and providers without Pet- itioner's consent, and (v) The past circumstances implemented by Respondent are unnecessarilY restrictive as to a custody contact period between Petitioner and the child, and (vi) The present Agreement, which was signed ab.ent legal representation, needs to be modified to provide more speoificity in reference to reasonable summer vacations, holidays and tele- phone oontacts between Petitioner and the ohild, and 15. Each parent whose parental rights to the ohild have not been terminated and the person who has physioal oustody of the child have been named as parties to this aotion. WHEREFORE, Timothy F. Clouser, Petitioner herein, requests that your Honorable Court grant modifioation of a prior custody Order dated Ootober 17/ 1995 and enter an Order of Court whioh grants Petitioner joint legal custody and partial custody on the following basis!
