COMPLAINT IN MORTGAGE FORECLOSURE
1. Plaintiff Federal National Mortgaqe Association is a
corporation chartered under IIn Act of congress entitled "Federal
National Mortqaqe Association Charter Act" (Title III of the
National Housinq act, 12 U.S.c. 1716 et se~.) havinq an offioe at
3900 Wisconsin Avenue, N.W., Washington, D.C.
:I. Defendants Carl D. Lori and Marqaret S. Lori are believed
to be residing at 1216 Mitohell Drive, Mechaniosburg, PA 1701515.
3. On April 20, 1990, th$ defendants made, elCecuted and
delivered their note and Mortqage to Landmark Mortgage services,
Inc. (hereinafter Landmark) in the amount of $78,300.00 with
interest at annual rate of 10.5 peroent, payable in monthly
in8tallments of principal and interest of $716,24 plus one-twelfth
(1/12th) of the yearly real estate talCes and hazard insuranoe
premiums tor a hrm ot 3110 monthe, 'l'he monthly installment.
inoludinq one-twelfth (1/1a) of the yearly raal e.tate taxe. and
halard inluranoe premiume a. of June a8, 1996 are $863. A oopy of
the mortqaqe i. attached hereto a. Ewhibit "A,"
4. The mortqaqe was recorded in the Office for Recorder of
Deed. for cumberland county, Pennaylvenia in Mortqaqe Book 974,
Paqe a47, and i. on the premiae. at 1a16 Mitohel1 Drive,
Mechan iClburq, cum\)er 1ftnd county, PA leqa lly dllloribecl in the
mortqaqe attaohed hereto as Exhibit "A,"
15. Landmark subsequently usiqned the mor.tgaqe document. and
plaintiff is the ourrent ownMr of same, however, comNet Mortqaqe
service.., has oontinued to Bervioe the mortqagQ on plaintitt's
behalf.
6. The d~tenclents are the real owners ot the land subjeot to
the mortqaqe and their last known mailing address iB set out in
paragraph 2 above.
7. Default has been made by the defendantB in the payment of
the monthly installments ainoe February 2, 1996, and as of June 20,
1996 the acoount is delinquent $4,1147.10 ($8815.00 per month for the
period February 1, 1996 through Maroh 31/ 19961 $863 per month for
the period April 1/ 1996 through June 28, 19961 late oharges in the
amount of $288,10)1 whereupon, under the terms of the mortqage/ the
entire balance at principal beoame duo and payable.
B. In aooordanoe with the pr.ovisions ot the mortgage
documents and/or the Act of January 30, 1974, P.L. 13, No.6,
Seotion 403 (41 P. S. 403) It Notioe of Intention to Foreclose
Mortgage dated May 2a, 1996, was forwarded separately to both
defendant. by oertified mail and regular mllil on or about May 22,
1996 by oertified and regular mail. ^" Affidavit of Notioe ill
attached hereto III Ellhibit "B" and a oopy of the "otioe ie attaohed
hereto al Exhibit "C". The default has not been oured. In the
alternstivl, the aforesaid Aot does not apply since the original
principal amount ot the mortgage elloeeded $~O,OOO.
9. In acoordanoe with the provisions of the Act of December
23, 1983, P.L. 3B~, No. 91, Seotion 2 (3~ P.S, Section t6BO.4020.)
a Notice of Homeowner's Emergenoy Assistanoe Act of 19B3 datsd May
22, 1996 was forwarded separately to both defendants by certified
mail and regular mail on or about Mfty 22, 1996, sinoe the mortgage
Will more than sixty (60) days oontraotually delinquent. An
Affidavit of Notioe is attached hereto as Ellhibit "B" and a oopy of
said Notioe is attaohed hereto as Ellhibit "D", No notioe hu been
reoeived by plaintiff advising that defendants have applied for
aleiatanoe, nor have def$ndants arranged for a face to face meeting
with a representative of the plaintiff during said period. In ths
alternative, the atoresaJ.d Aot does not apply since the mortgaged
property may no longer be defendants' prinoipal residence.
10. The mortgage is in detault because of defendants' failure
to make the payments due and the fOllowing amounts are due on the
mortgage I
