AND NOW comes the above-named Plaintiff, Jol1n Pt!ter Herbert, by Ills
attorney, Samuel L. Andes, and petitions this Court to enforce and to modify Its
custody order of 24 October 1996, based upon the following:
1. The Petitioner herein Is the Plaintiff, John Peter Herbert, an adult Individual I

who resides at No.9, Randale Court In New Cllstle, Delaware,
2. The Respondent herein Is the Defendant, Annmarle McKensle, an adult
Individual who resides at 944 Eppley Drive In l>1echanlcsburg, Cumberland County,
Pennsylvania.
3. The parties are the parents of 2 minor children, Lauren A. Herbert, born 2
May 1989 and Molly A. Herbert, born 4 August 1992, which children are the subject
of an Order entered by this Court on 24 October 1996, a copy of which Is attached
hereto and marked as Exhibit A.
4. The Defendant has violated tile terms of this Courl's Order and has failed
to make the children available to the Plaintiff for his period.; of temporary custody
on several occasions since August of 1998. As a result of the Defendant's violation
of said Order, the Plaintiff has not seen his children for more than a month and
continues to be deprived of his parental rights with regard to those children.
5. Since the entry of the prior Order In this matter, tile circumstances of both
parties have changed significantly, Those chan'iles Include:
A, Each of the partle!i have moved and 1I0W IIVI~S 111 a new
location.
B. The children ore older and are better able to be with the
Plaintiff and away from the care of the mother fOl' longer periods of
time.
. C. The Plaintiff had developed a strong relatlollshlp with the
children and It Is Important to th~1I1 thai they spelld I nore time with
him.
6. As a result of the changes described In the foregoing paragraph, Plaintiff
requests this Court to modify Its wlor Order to grant him longer periods of time ovel'
holidays and other school vacations during the school Yl!ill' ilnd 50% of the time
each summer.
WHEREFORE, Plaintiff prays this Court to ad]udgl! the Defendant In contempt
of Its Order of 24 October 1996 and to 1I1lpOSI;' SUdl salldl0115 as are reasonably
necessary to assure Defendant's future compliance with t11dt Order and to modify
the terms of that Order to give Plaintiff additional time with the Court, particularly
over holidays, school vacations, and the summer months.

with the first weekend aft~r conmencetnent of the school year
and end on the Father's last regUlarly scheduled weekend prior.

Rte, 896 in Lancaster, unless otherwise agreed by the parties.
7. The non-custodial party I1lBY contact the Children by telephone on
Wedneeday evenings at 8100 p.m. 'Itle Children shall be permitted to
initiate telephone contsct with both parents.
8, Each part:y shall ensure t.hat the other party has his or her
current: sddress and telephone number.
9, Each party shall be entitled to visit the other party's residence
at a time to be IIrr.anglld by agreement of the parties to enable each party
to see where the Children will be residing during the other parent's
pariods of custody.
