4. MARITALJ~. As provided hereinabove, Wife is to
reoeive tho mllrital home aB pllrt of this Agreement subjeot to the
tollowing terms and conditionsl
A, Wife shllll obtain refinancing within three (3)
yellrs from the date of this Agreement in order to romove
Husband's name from the current mortgage obligation (BOl

B. Wife shall be solely responsible for mortgage
payments, insuranoe, tBxes, mBintenanoe, repairs and all other
expenses related to the marital home and Wife shall hold Husband
harmless and shllll indemnifY him for samel
c. In the event Wife does not obtain refinanoing on
the marital home sufficient to remove Husband's name trom the
mortgage obligation, within the three (3) year period speoified
above, the parties will promptly list the house for sale with a
reputable broker acceptable to both parties at its appraised
value. Wife will receive all sale proceeds and Bhall be
responsible for any and all expenses related to the salel Ilnd
D. Simultaneously with the exeoution of this
Agreement, Husband shall execute a deed conveying his ownership
interest in the marital home to Wife. Said deed will be held in

Husband turther asserts that all neoeBDary repairs to the
upstllirs heat have been made and that the same is in proper
working orderl that arrangements for the removal of the rubbish
pile have bean made by Ilusbandl Ilnd that the water pressure
throughout the house is adequlltel and any problems with the
funotLoning and operation of the water softener system have been
repll ired.
5. LEASE ASSUMPTION BY HUSBAND.
A. The parties have received the consent of Wife's
landlord to allow for Wife to assign her rights and obligations
in her lease of the property at 22 York circle, Mechaniosburg, to
Husband. Husband agrees to be bound by the terms of said lease
and to timely meet all obligations pursuant to said agreement.
Husband Ilgrees that he shall indemnify Wife and save Ilnd hold her
harmless for all rents, causes of aotion, suites, liabilities,
costs, claims, jUdgments, including all attorney fees and costs

retain, in full, the security deposit or any portion thereof,

Lllndlord, In the event Wife reoeives leNS than the full seQur.ity
deposit from Landlord, HUsband shllll pay to Wife the difference
between the full security deposit and the amount wife reoeives
from Landlord. Husband shall tftke all steps neoessary to
