child. Father shall advise Mother at leallt by May 30th of
each year as to when he will exercise this/eeiad of custody.
The oustody summer vacation may be extende to three weeks by
agreement of the parties to accolMlodate the minor child having
the oppor.tu,lity to spend some time witll the pa

Hother. In the event the child and the Mother are not
home to receive tho phone call, the Mother shall initiate
a phone oall to the Fa ther la ter tha t evening or prior to
the 7100 p. m. time.
The minor child shall attend tht! I/untington Learning Center
for sUnuller school at 3507 Market streetj Csmp Hill, PA,
Father shall incur. the expenses for the ch Id attending this
sohooling. Mother shall have the obligation of ensuring that
the ohild is in attendance at the /Jchool. If there are any
problems with Mother ensuring attendance at the sahool,
oounsel for the parties can contaot the Conciliator and the
Court will entertain a request at that time to provide that
Father shall handle transportation.

Marc and Debbie Keiser were married In October of 1989, They had dated
during high school and Deb was pregnant with Amanda attha lima of the marriage,
The marital relallonshlp was somewhat stormy as described by both of these adults,
Deb states that during the course of the marriage Marc was physically abusive to her
and that she ulllmately left him In March of 1996 following a phyalcal altercallon, Marc
denlasthat he ever physically abused Debbie, but states that she had an extra-marllal
effalr during the course of the marriage. Actually, Mere Is somewhat confused as to
why Debbie finally left him In 1996.
Following their separatlon, Debbie had attemptad to obtain a Protecllon from
Abulle Order against Marc, That order was eventually withdrawn and these parents
came to an agreement with respect to custody. Marc states that he had gone almost
two months without seeing Amanda prior to their reaching a suitable custody
errangement. Debbie become the primary physical custodian of Amanda and Marc
weB grented partial parlods of custody on an alternating weekend and Wednesday
evening overnight basis. The Wednesday overnight was changed to an evening visit
when Amenda entered school so as to make her Bchool week less dlsrupllve, That
arrangement has bean In effect since the summer of 1996,

At this point In time Mdrc Is requesting a change In primary cuslody for Amanda
from her molher 10 him, He reported Ihlll he has always wanted primary custody but
wes adlllsed that he had IIllle chance of obtaining II at the time of tha separation, At
that time ha was staying It, an apartment with a friend and did nol feel that the court
would grant primary custody 10 him, Now, howeller, he feels that Amanda's best
Interests are served by her being In his primary custody,
Thore are multlpl~ reasons for this belief. First I and forelnOsl, Marc Is extremely
concerned aboul Amanda's academic achlellement. Amanda has bllsn hailing
considerable difficulties In school, especially wllh reading. In Ihe first grade she wes
placed In a special reading class and was failing In Ihol anlllronmonl, He flilels Ihat
Deb was denying this fact and actually lying to him about Amanda's progress In school.
Thareforo, he took It upon hlmsolf to enter her Inlo the Huntington Learning Center In
order to remedlate the problems thai she was Bxparlanclng, His acllons wera mel wllh
considerable resistance from Deb, who would nOllnltlally agree that Amanda was In
naed of this type of help. Marc feels thai Deb's altitude has been consistently negatllle
about Amanda's acadamlc work He does nol feel thai she lIalues education and that
thla Is further Indication of a lack of priority on Amanda. Marc ultimately prellalled wllh
Ihe Huntlnglon Learning Center by asking Ihe court 10 Intervene,
Marc was equalled concerned Ihat Deb would consistently speak badly about
him to Amanda, According to Marc, Amanda frequently makes remarks abolJt how
much money Marc and Honey halle and that her molher cannol do things for her
because she does not halle money, Marc bellevas thel Debbie does not use the
support money Ihat he pays In a poslllve way for Amanda, In fact, he doee nol believe
that Debbie doee anylhlng particularly conelructlve wllh Amanda, Within the same
context, Marc states that Amanda frequently uses vulgar language Ihat she has heard
har mother use,
Other complaints that Marc hae with respect 10 Debble's parental care Include
what he describes as a lack of structure wllhln Debbie's household, He states that
Amanda frequently shows out of control behavior when she Initially comes to his house
from her mothors, He has also pointed out thai Amanda has experienced some acting
out problems at school. Marc Is also concerned that Debbie pays IIl1le attention to
Amanda's diet. He points outlhat Amanda Is over weight and her mother does not
restrict the types of food she eats, Marc also Indicates that Amanda Is learning from
Debbie to hate Honey, He Indicates Ihat Amanda Initially enjoyed all of her time wllh
Honey, but after continually hearing Debbie's feelings about her, Amanda is now much
cooler In her relationship wllh Honay,
Flnally, on a more general nole, Marc feels that Debbie Is emotionally unstable,
He Indicates that In the pasl she has attempted suicide. He feels thai her moods
vacillate rapidly and Ihat even during the marriage Debbie was concerned that she was

high schoolllhe had attempted to take em overdo so and walltrealed for depression,
She stated that she does alllme!! get odgy, grumpy and depressed. Bhe often feelll

Deb appears to be of average Intellectual ability, She was able to presenl her
story In a relatively rational fashion, There were limes that her thoughts would ramble,

problems wllh hallucination II or deluslonll. There did not seom to be any olher types of
cognitive distortion that would Imply II moro severe psychological dlsordor, Deb also
denied any problemll wllh alcohol or drug use

Marc Is a 26 year old man who is currentty self-employed, For approxhnrately the
past eight months he has owned and operated his own Mobil station, Prior to that, he
worked as a car mechanic for other owners. He states Ihat as a funcllon of owning his
own business he has gained a greater degree of flexibility with his schedule, He
admits to previously having worl<ed longer hours, II ahould be noled that when the
children are with their other parents, Honey helps In the business
MBrc presented as a relatively serious, Intense young man who was very eager
to participate In the eveluatlon process, He exhibited confidence and an assertive
aUltude regarding the overall custodial situation and his ability as a parent, He
presented for all of the sessions In 0 timely manner and was always well-dressed,
clean and well-groomed,
Marc exhibited no particular ebnormel signs of anxiety or deprli9slon during Ihe
Interviews, Furthermore, he denied any significant history of either of these disorders,
His mood was generally positive and within normel expectations fol' this type of
evaluation, Marc also appears to be of average Intellectual ability. His thinking Is
clear, concise and goal-dlrected, There were no signs of cognitive distortion, He
denlad any symptoms of more severe psychopathology, such as hallucinations or

The townhouse has large rooms that are well maintained, There are many
books and videos present which are appropriate for young children, Upstairs are two
bedrooms, The first belongs to Marc and Honey, while the second Is shared by Brindle
and Amanda when she Ie vh!llllng, The chlldron are provided with many toys, games,
books and activities, During this visit Amanda Interacted easily and voluntarily with
both her fathar and Honey, Brindle and Amanda pleyed well together with the rest of
the children In the neighborhood, During the visit the girls were decorallng pumpkins
with the able assistance of both parants,
During Amenda's office vlslt, she requested that her father, Brindle and Honey
all escort her to the examlnallon room, Within thet selling, they all decided to playa
game of Memory. The Interacllons bslween all of thesa Individuals were fun-filled end
relaxed, Amanda was extremely pallent with Brindle and tried to help her with the

course of this evslusllon, Deb eppears to be unable, atllmes, to separate her feelings
about Marc or Honey from decisions that would be Amanda's besllnterast. Not only
hall she dona Ihis recenlly, bul she appears to have done this In the past. Her feelings
about the Hunllngton Learning Center are nol consistent with Aml1nda's educallonal
needs or acllvilles, Furthermore, she conllnues to portray '1egallve feelings about
Marc, and espoclally Honey, with respect to their emphashs on these areas, Debbie
has baen Inflaxlble with respect to working out conflicts regarding Amanda's acllvllles,
Her rigidity has made It difficult for Amanda to participate In acllvllles, even more so
than Marc's desire to keep Amanda In the Huntington Center. Debbie exhibited similar
rigidity In dealing with Marc around Brindle's birthday and her ability to attend a
birthday party with her father, This rigidity was a result of Debble's anger at Honey and
Marc, much more so than what was In Amanda's besllnteresl, Ills also bolleved that
Debbie's attempts at keeping Amanda rrom vlslllng with her father for the flrst two
months efter the separallon were related to her anger al Marc more than any concems
about Amanda,

Marc Keiser has never besn In the role of primary custodian for Amanda, During
Ihe marriage most of the child care fell upon Debbie to provide, There was a brief
period of lime arter the separation when Marc took care of Amanda without the eld of
Honey, but currently Honey Is also inllmataly Involved In helping him with Amanda's
care, If primary physical cuSlody were switched to Marc, he would have to rely upon
Honey to have to help with that care, Marc may undereollmete some of the problems
thai would be associated wllh a change In custody, as he lends to deny the severity of
emollonallmpacls in general, Nonetheless, Marc also appears 10 be more emollonally
stable and provldo a more stable environment for Amanda at this lime,
Therefore, It Is tha recommandallon of this evaluallon thBt primary physical
custody of Amanda Keiser be changed to her father during thF.lschool year, Ills
recommended that Debbie have periods of partial cUlitody from Friday artar lichool untIl
Sunday evening on an alternallng weekend basis, Furthermore, It Is recommended
that Amanda visit with har mother the Wednesday evening before and the Tuesday

each year as to when he will exercise this period of cUlltody.
The custody summer vacation may be extended to three weeks by
agreement of the parties to accommodate the minor chlld having
the opportunity to spend some time with the paternal
grandparents.

Court Order exercised periods of temporary physical custody. since ssperatlon Including
alternating weekends, Wednesday evenings and alternating holidays,
Mr, Keiser Is requesting primary physical custody of Amanda, Amanda has
e~perienced considerable difficulty In school, especially with reading, and has not
received Ihe support of her Mother, who, In the past, has misrepresented the child's
progress In school to Mr, Keiser, As a result of her acedemlc problems I end at the
suggestion of the child's teacher, Mr, Keiser took It upon himself ,over Respondent's
obJections I to enter her Into the Huntington Learning Center In order to Improve her
acedemlc work, The child's Mother continues to this day to expreu objection to this
Idea and has expressed a negative attitude about the child's academic work and the
altempts by Mr, Keiser to Improve It. Only after Intervention by the Court was
participation In the Huntington Learning Center approved for the minor child, The other

custody, Plaintiff would have primary physical
ustody snd Defendant would have a liberal visitation schedule.
on or about April 18, 1991, Defendant filed a Petition to
odify the prior order, by seekinq primary physical custody of
paqe 1 of 5

This filing came after leveral weeks of Defendant making
requent harassing phone calls, the phone calls and the Defendant
ollowing the Plaintiff in her oar oontinued throughout May of
1997.

Plaintiff cooperated throughout the period of child's
ttendanoe at the school, by being tho primary provider for
transportation. Plaintiff acknOWledged the need for ~anda to
reoeive help with her school performance, but also feels that she
lso needs the balance of social aotivities and sports in her.

The parties also partioipated in a Custody Evaluation with
iegler, Shienvold and Associates.
The report of the Evaluation was made available to the
arties on December 9, 1997 and the parties met for a
onoiliation Conferenoe on December 11, 1997.

Plaintiff iowed.iately began sessions with Andrea Chapman of
uid~noe Assooiates, whioh has enabled her to put her fear of the
Defendant and her feelings of being manipulated by him in proper
perspeotive, so that the type of emotional reaotions he was able
to oreate in her have been brought under control.
Plaintiff has a great love for her child and in view of the
history of her marriage to the Defendant, is quite protective of
her daughter. Plaintiff is not inferring that Defendant is or
would be physically abusive to his daughter, but he has never
been the prirnary caregiver. Defendant even now, as when he was
married to the Plaintiff, works long hours and the oare of the
child falls to his girlfriend.
Plaintiff has had a long term relationship (since June
1996), with Ronald Wilde, who has developed a olose relationship
with the child.

segment af the Chriatmas holiday from December 24 through

from December 25 through January 1 for purposes of a trip
to Florida. In light of the fact that the Father had a
similar trip in 1996, the parties agree t.hat the Mother
shall enjoy custody of the ohild in 1998 and 1999 during

2. The Mother shall enjoy primary phyaical custody of the minor
child.
3. The Father /fhall enjoy periods of t"mporary phyaical custody
of the minor ohild as follows,
A. Alternating wltekends from Friday evening when the Father
gets off work, to be no later than 8,00 p.m., until
Sunday evening at 8,00 p.m.
B. One even.ing per week, which will be Wednesday unle/f/f
agreed otherwise by the parties, from when the Father
gets off work until' 8,00 p.m.
The parties Bhall alternate oustody on the following holidays,
Ba"ter, Memorial Day, July 4th, Labor Pay, and Thanksgiving.
The times shall be from 9100 a.m. until 8100 p.m. Father
shall have Thanksgiving of 1996.

For the Christmas holiday, the parties shall alternate
ChriBtmas between two time frameB, with the first time frame
Deoember 24th at noon until December 25th at noo'll and the
seoond time frame Deoember 25th at noon until December 26th at
noon. For Chri/ftmas 1996, the Mother shall have the first
time period, and the partie/f ahall alternate thereafter.

Fathor shall enjoy two weeks of aummer vl1cation with the minor
ohild. Father shall advise Mother at ledst by May 30th of
eaoh year as to whan he will exeroise this period of oustody.
The oUBtody summer vaoation may be extended to three weeks by
agreement of the parties to aooommodate the minor ohild having
the opportunity to spend some time with the paternal
grandparents.
