Shover, an adult individual, who resides at 281 Leib Road, Mechanicsburg, Cumberland county, penneylvania. 2. The Detendants Kenneth E. Dahlhammer, an adult individual, who resides at 120 North Beaver Creek Road, Dillsburg, York county, Pennsylvania, and Roderiok G. Dahlhammer, and adult individual, who resides at 2220 Hilloreek Road, Dover, York county, Pennsylvania are the EKecutors ot the Estate ot Clem E, Dahlhammer. 3. The said Clem E. Dahlhammer is deoeased, having died on February 21, 1996 and, as a result, Kenneth 2. Dahlhllmmer and Roderick G. Dahlhammer were appointed 2xecutors ot the Estate ot Clem E. Dahlhammer in the Court ot Common Pleas, in and tor York County, Pennsylvania, Orphan'S Court DiVision, to Number 67-96-317. " , on or about Auguet 1B, 1994, Plaintiff, Jacqueline K. shover I wae the cc-owner of a 199~ OKa aafari automobile which wa. involve~ in the accident desoribed herein. a. On the aforeBaid date, Clem E, Pahlhammer waB the owner of a 19110 Chevrolet automobile ,~hich Wl\l!l involved in the accident de.oribed herein. 6. On the aforesaid date, at Rppt'oximatelY 9150 A.M., tne Plaintiff was stopped for a red light at the interseotion of East simpson Ferry Road and Frederiok street in Meohanioeburg, cumberland county, Penl1eylvania, when her vehiole was struQk in thll rear by the motor vehicle of Clem E. Dahlhammer whitlh Was being operated by him in a westerly direction on East Simpson Ferry Road behind and in the same lane as Plaintiff's vehicle. 7. At the time of the accident herein described, Plaintiff was lawfully stopped while waiting for a red light t.o Ohange to green. 8. The accident was directly and proximately caused by the negligence and carelessness of Clem E. Dahlhammer, which oonsisted, amount other things, of the fOllowingl (a) operating his motor vehiole in a oarelese, reokless, and negligent manner, (b) operating hi. ~otor vehicle at an ewee..iv. rate Of .peed under the aireuN.tane.., (c) operating hi. motor vehicle with no war-ning ot approaoh or intended direation, (d) not havin!) hiB motor vehiole under. the proper oontr-ol .0 a. to etop .aid vehiole within the assured olear di.tanea ahead (76 Pa. Con.. stat. 5 3361), (e) operating his motor vshiole without due regard ta the right., .afety, and position of the Plaintiff, (f) tailing to have his motor vehiole under the proper oontrol so es to prevent this vehiele from striking the Plaintiff's motor vehiole, (g) failing to keep a proper lookout/ (h) tailing to use due care under the o h:cumstances, ( i) tailing to notice the motor vehicle cf the Plaintiff, (j) upon notioint,J the motor vehicle of the Plaintiff I failing to yield the right-of-way to the Plaintiff's vehicle, (k) failing to take evasive aotion in order to avoid i~pacting with Plaintiff's vehicle, (1) tailin", to epply his brakes in sufficient time to avoid striking plaintiff's stationary oar, and (m) operating his motor vehicle in disregard of the rules of the road, the ordinanoes of the Borough of Mechanicsburg, and the laws of the Commonwealth of Pennsylvania, including but not limited to the Motor Vehicle Code, 75 Pa. Oahlhammer's negligence, Plaintiff euetained the tollowinq injuries I eome or all ot whioh may be permanent! headaches 1 strain and sprain to the musclee and lott tiseues ot the neck, spine, shoulders and chest 1 shoulder leparationl and general bruises and contusions. 12. As a result ot the negligence ot Clem E. Oahlhammer, plaintiff has suttered great bodily pain and sutterinq, as well as mental anxiety and nervousness, to her great detriment and loss. 13. As a result ot the negligence ot Clem 13, Dahlhammer, plaintiff has sustained serious and permanent injury, for the treatment of Which she has incurred medical bills and expenses in excese of $10,000.00 and wall required to undergo surgery in the injury to her left ehoulder. 14. Dahlhammer, Plaintitt sustained property damageB to her motor vehiole in the amount of $4,200.00 and Plaintiff further incurred oar rental charges, the reasonable cOBt and value of which waB $475.00, A true and correat copy af an eatimate of the property damage sustained by Plaintitt is attached as Exhibit ~^~. 17. Plaintiff has made demand for compensation of the aforessid injuries and losses, which de fondant has failed and retused and Itill refuses to pay. WHEREFORE, Plaintiff, Jacqueline M.
