1. The plaintiff, Judy L, Malloy, is an adult indiYidual
residing at 3673 Bpring Road, Carlisle, Cumberland county,
Pennsylvania 17013.
2. The plaintiff is temporarily staying at an undilolosed
looation tor her own protection and to avoid further abuse as is
more fully set torth herein. This address will bo furnished to
the oourt upon request.
3. The defendant, Albert L. Malloy, (BBNI 207-32-4768)
(Date of Birthr 11/15/40), is an adult individual residing at
3673 Spring Road, Carlisle, cumberland County, PennBylvania,
17013.
4. The defendent is the plaintift's husband.
6. since epproKimately 1994, the detendent has attempted
to oause and hae intentionally, knowingly, or r.ecklessly caused
bodily injury to the plaintiff, has plaoed the plaintiff in
reasonable fear ot imminent serious bodily injury, and has
knowingly engeged in a course ot conduct or repeatedly committed
acts toward the plaintiff under oircumstances which have placed
the plaintitf in reasoneble fear of bodily injury. This has
included, but il not limited to, the rOllowinq Ipecific inltanoel
ot abU.el
a. on or about Augu.t 3, 1996, the defendant called
the plaintiff vile names, continuelly soreamed at her
for approximately thirty minutes, and raised his hand
cau.ing the pleintirf to atep beokwards because she
feared that he was going to hit her,
b. on or about July 14, 1996, after the plaintifr had
gone to bed, the defendant forcefully threw open th.
bedroom door knooking the door into the wall and turned
on all the lights causing the plaintiff to fear for her
safety. The defendant repeatedly pushed on the
waterbed mattress forcing the plaintiff to get out of
the bed. When the plaintiff stood up, the defendant
came aoross the bed, grabbed the plaintiff by the arms
pulling her backwards onto the bed. The defendant then
covered the plaintiff's nose and mouth with his arms
and forcefully squeezed her head so that she COUldn't
breathe. The defendant then forcefully squeezed her
forehead oausing her to heve a severe headaohe. The
defendant threatened that he would harm the plaintiff
if she got out of bed as he put his leg over her legs
and put his hand on her arm so that she oouldn't move
oausing her to fear for her safety.
Arter the defendant fell esleep, the plaintiff got

out of bed and went to the Carliele Ilolpital becaule of
the levera headaoha.
c. on aeveral different oocaeione lince 1994, the
defendant puehed the plmintifr, elapped her, choked
her, gusbbed her arms, and reetrained her. on one
oocs.ion in 1994, the defendant grabbed the plaintiff
by the arm, ohoked her and forcefully elapped her
across the face, On another ooomsion in 1995, the
defendant slapped the plainl:iff aoross the face, ohoked
her, and grabbod her by the armB oausing soratches end
bruises.
6. The plaintiff believes and therefore avers that she i.
in immediate and present danger of abuse from the defendant and
that she is in need of protection from suoh abuse.
7. The plaintiff dosires that the defendant be prohibited
from having any direct. or indirect oonta~t with the plaintiff
including, but not limited to, telephone and written
oommunications.
8. The plaintiff desires that the defendant be enjoined
from harassing and otalking the plaintiff, and from harassing the
plaintiff'S relatives.
9. The plaintiff desires that the defendant be restrained
from entering her places of employment,
10. The plaintiff desires that the defendant be enjoined
from removing, damaging, destroying or selling any property owned
