7. On August 16, 1996, Plaintiff entered judgment in
the amount of $3,237.79 against Defendant docketed to the
above Docket Number.
8. Plaintiff has stated through her counsel that she
will seek to satisfy the aforementioned judgment.
9. Entry of a judgment in this matter is contrary to
the law because a support judgment may only be entered
when a Defendant is in arrears in excess of one (1) month
on a current order and not to collect arrears which had
previously accrued and which Defendant is making payments
toward.
WHEREFORE, the Defendant, Canio Salese, respectfully
requests that this Honorable Court issue an Order
striking Plaintiff's judgment in the amount of $3,237.79
against Defendant for support arrears.
