PETITION FOR PRIVATE SALE OF REAL ESTATE
TO THE HONORABLE, THE JUDGES OF SAID COURT:
The Petition of the Board of Directors of the Carlisle Area School District, by FRED
BALDWIN, its President, respectfully represents:
1 . The Carlisle Area School District is the owner of land acquired by Deed from
William Thompson, dated October 18, 1948, and recorded in the Office of the Recorder of
Deeds in and for Cumberland County, in Deed Book "l", Volume 13, Page 30, part of which
is proposed to be conveyed by private sale.
2. The properties to be conveyed to separate purchasers are Lots Nos. 8 and 9 of the
Plan of Lots laid out by Robert Thompson, dated May, 1908, and recorded in the Office of the
Recorder of Deeds in and for Cumberland County, in Plan Book 1, Page 41.
3. The properties in question were utilized in connection with the vocational program
of the Carlisle Area School District by having the v0cational department erect on each of said
lots of ground a dwelling house.
4. Two dwelling houses have now been completely erected, one on each lot, and
have served the purpose of training of the students of the Carlisle Area School District and said
lots are unused and unnecessary for the purposes of the School District.
5. A complete description of the land on which the buildings have been erected is
attached hereto and marked Exhibits" A" and "B".

6. The Board of School Directors of the Carlisle Area School District has entered into
tentative Agreements for the private sale of each of said properties at the price of $97,000.00,
each.
7. The terms of the sale are as set forth in the Agreements attached hereto as Exhibit
"e" and liD",
8. The Board of Directors of the Carlisle Area School District are of the opinion that
the price offered for the properties is a fair and reasonable one and, in their opinion, a better
price than could be obtained at public sale.
9. The Board of Directors of the Carlisle Area School District have obtained the
opinions of two persons familiar with the value of real estate in the locality, and the affidavits
of those persons are attached hereto, marked respectively Exhibits "E", "F", "G" and "H".
WHEREFORE, your Petitioner prays your Honorable Court to fix a time for a hearing to
determine whether or not it shall approve said sale in accordance with the Public School Code
of 1949 (24 P.S. 7-707 {3}), in accordance with the notice provisions of said Public School
Code (24 P.S. 7-707 {1}).

EXHIBIT "A"
ALL THAT CERTAIN tract of land situate in the Borough of Carlisle, Cumberland County,
Pennsylvania, in accordance with that certain Plan of Lots laid out by Robert Thompson, dilted
May, 190B, and recorded in the Office of the Recorder of Deeds in and for Cumberland County,
in Plan Book 1, Page 41, bounded and described as follows:
BEGINNING at a point in the Southern right of way line of Lincoln Street at the dividing
line between Lot Nos. 8 and 9 of the aforesaid Plan of Lots; thence in an Easterly direction
along the Southern right of way line of Lincoln Street a distance of 30 feet, more or less, to a
point at the dividing line between Lot Nos. 7 and 8 of the aforesaid Plan of Lots; thence alono
the dividing line between Lot Nos. 7 and 8 of the aforesaid Plan of Lots in a Southerly direction,
a distance of 169.35 feet to a point in the Northern line of a 16 foot alley; thence along the
Northern line of said 16 foot alley in a Westerly direction a distance of 30 feet, more or less,
to a point at the dividing line between Lot Nos. 8 and 9 of the aforesaid Plan of Lots; thence
along said dividing line in a Northerly direction a distance of 169.35 feet to a point in the
Southern right of way of Lincoln Street, the Place of BEGINNING.
BEING Lot No.8 on the aforesaid Plan of Lots, and having thereon erected a dwelling
house known and numbered 336 Lincoln Street, Carlisle, Pennsylvania.
BEING a portion of the same property which William D. Thompson, by his Deed dated
October 18, 1948 and recorded in the Office of the Recorder of Deeds in and for Cumborlllnd
County, in Deed Book "l", Volume 13, Page 30, granted and conveyed unto Carlisle Areil
School District.

the price offered for the properties is a fair and reasonable one and, in their opinion, a better
price than could be obtained at public sale.
9. The Board of Directors of the Carlisle Area School District have obtained the
opinions of two persons familiar with the value of real estate in the locality, and the affidavits
of those persons are attached hereto, marked respectively Exhibits "E", "F", "G" and "H".
WHEREFORE, your Petitioner prays your Honorable Court to fix a time for a hearing to
determine whether or not it shall approve said sale in accordance with the Public School Code
of 1949 (24 P.S. 7-707 {3}1. in accordance with the notice provisions of said Public School
Code (24 P.S. 7-707 (1 I).

TO THE HONORABLE, THE JUDGES OF SAID COURT:
The Petition of Carlisle Area School District, by its Solicitors, FLOWER, MORGENTHAL,
FLoWER & LINDSAY, respectfully represents:
1. That on September 24, 1996, your Honorable Court made an Order approving sale
of real estate owned by Carlisle Area School District to Floyd Vasser and 8eatrice Vasser,
husband and wife, or their assignees, for the sum of Ninety Seven Thousand and 00/100
($97,000.00) Dollars and directed a Return of Sale after the sale had been consummated and
the Deed executed and delivered.
2. That on November 13, 1996, followin9 Court approval, settlement was made and
the executed Oeed delivered and purchase price paid.
3. Settlement was made and costs were incurred, all as set forth in the Settlement
Sheet attached hereto, marked Exhibit" A", and made a part hereof.
WHEREFORE, your Petitioner prays your Honorable Court to approve the Return of Sale.
