Corporation to service transfer of this application including, but not limited to, the tender of a required $250.00 appraisal fee of their prospective collateralized residence. 4. Prior to this application, Plaintiffs' primary mortgage of their residence was held by united Telephone Employee's Credit union at an annual rate of 9.125%. 5. Defendant Corporation agreed to procesf' and service transfer Plaintiffs' mortgage refinancing application and submit that application to CUNA Mortgage Corporation, P.O. Box 1332, Madison, Wisconsin, 53701 requesting a $48,000 loan for 180 payments at 6.25% per annum interest rate, the advertised interest rate then available. 6. Upon knowledge and belief, the CUNA Mortgage Corporation required named Defendant Corporation to obtain a local appraisal as the condition precedent of the grant of the mortgage to the Plaintiffs and as a means to determine the value of the prospective collateral. This appraisal was the responsibility of Defendant Corporation to obtain and submit to complete the service transfer of Plaintiffs' application to CUNA Mortgage Company . 7. Because the application for refinancing included a fluctuating interest market, time was of the essence for entire herein above described transaction. 8. Plaintiffs, at their February 24, 1994 application and thereafter presented the June 26, 1991 appraisal of Larry E. Foote appraising the value of their residence to be $81,000.00 to Defendant Corporation. 2 '. . 9. Defendant Corporation retained Donald Kauffman of Middletown, Dauphin County, to appraise the residence for the above refinancing. Upon knowledge and belief, Mr. Kauffman was without general experience in the real estate market of the Newville area. 10. Plaintiffs requested that Larry E. Foote, the prior certified appraiser, be allowed to do the re-appraisal because of his familiarity with their residence and the Newville, Cumberland County, real estate market but Plaintiffs were not permitted a choice of appraisers nor an alternative to Donald Kauffman. 11. Plaintiffs relied in good faith on Defendant Corporation's selection of Donald Kauffman as an appraiser. 12. On or about March 14, 1994, twenty (20) days after submission of the mortgage refinancing application to Defendant Corporation, Plaintiffs received Kauffman's appraisal for $66,000.00. 13. Plaintiffs immediately voiced to objection to this disportionatly reduced property valuation to Defendant Corporation and specifically noted these following overt errors or omissions; said below list being non exclusive of all errors or omissions of Donald Kauffman's appraisal: a. misstatement of the acreage; b. incorrect description of window treatment; c. omission of wall and driveway gate in property description; d. failure to describe correctly insulation; e. failure to include attic; 3 f. failure to describe ceramic tiled bathroom; g. failure to correctly describe sky lights. 14. Additionally, Kauffman chose for value comparisons three (3) houses that were twenty (20) to forty (40) years old when Plaintiffs' residence was ten (10) years old; two (2) of the comparison houses had no landscaping; none of the comparison houses had alternative heating systems; none of the comparison houses had an attached garage; all of the comparison houses were less than 1200 square feet and had one bathroom when the Plaintiffs' residence is over 1600 square feet with two (2) bathrooms; two (2) of the comparison houses were modular homes and all were one-story when Plaintiffs' residence was bi-level and built on-site; one of the comparison houses had a collapsed roof; one of the comparison homes was not sold and the comparison price used was the listing price only; one of the comparison houses was over three (3) miles from the Plaintiffs' residence. Kauffman's March 10, 1994 appraisal is attached hereto as Exhibit A and made part hereof and the prior June 26, 1991 Foote appraisal is attached hereto as Exhibit B and made part hereof. 15. In response to Plaintiffs immediate objections and the manifest appraisal differences, Defendant Corporation provided a copy of appraisal to the Plaintiffs, who provided a written description of the discrepancies of the appraisal to Defendant Corporation. Notwithstanding many telephone inquiries, Plaintiffs were not informed until April 18, 1994 that Defendant Corporation had received an increased appraisal to $77,000.00. 4 " '. 16. On April 19, 1994, Defendant Corporation, by its agents, employees and/or servants, informed Plaintiffs that their time to obtain a second appraisal or reduce their loan amount request had expired and the requested interest rate was no longer available. Defendant Corporation's letter of April 19, 1994 letter is attached hereto as Exhibit C and made part hereof. 17. Plaintiffs contracted with Defendant Corporation to submit and transfer service of a residential refinancing. This contract is oral. Upon knowledge and belief Defendant Corporation receives compensation for this service. COUNT I BREACH OF CONTRACT 18. Paragraphs (1) through seventeen (17) are incorporated herein as if set forth in full. 19. Defendant Corporation had a contractual duty to obtain competent and timely appraisal of the residence. 20. Upon receipt and review of Kauffman's March 10, 1994 appraisal, Defendant Corporation knew or should have known by the manifest devaluation, review of comparison valuations, and comparison of the 1991 Foote appraisal that Kauffman's appraisal was incorrect and without basis for belief and reliance in use in the residential mortgage refinancing process. 21. Defendant Corporation was solely responsible for selection of Kauffman as an appraiser and had a contractual duty to 5 '. know about his professional abilities and reputation in the local area upon his peer professionals. 22. Defendant Corporation had a contractual duty to inform Plaintiffs that an alternative appraisal would be necessary or, alternatively, that the loan amount request should be a lower amount in a timely manner to assure the availability of the requested interest rate. 23. Kauffman was Defendant Corporation's independent subcontractor, solely selected by Defendant Corporation its agents, employees and/or servants. Defendant Corporation paid Kauffman for his work product notwithstanding Plaintiffs' complaints thereby concluding his service and he is not a necessary party to this cause of action. 24. Defendant Corporation had a contractual duty to act within the time period that the 6.25% interest rate was available and advise Plaintiffs fully of that time constraint. 25. Defendant Corporation breached their contract with Plaintiffs and as a direct consequence thereof Plaintiffs sustained the following damages: a. $1,342.00 (difference in interest payment between the date of refusal and the next date 6.25% was available for refinancing. b. $250.00 appraisal fee paid to Defendant Corporation. c. $42.40 credit report fee. d. $50.30 filing fee for civil complaint at District 6 '. Justice's office. e. $12.18 film development costs for exhibits at the District Justice hearing. f. $16.32 mileage for attendance at District Justice hearing and investigation. g. $151.00 loss of salary for attendance at District Justice hearing. TOTAL $ 1,864.20 WHEREFORE, Plaintiffs RONALD and CARYL SHEPPARD demand judgment from PENNSYLVANIA CREDIT UNION LEAGUE and PACUI, SERVICES, INC. in the amount of $1,864.20 plus interest and costs, such amount being within the parameters of mandatory arbitration by Local Rules of Court. PROMISSORY ESTOPPEL 26. Paragraphs one (1) through twenty-five (25) are incorporated herein as if set forth in full. 27. Plaintiffs justifiably relied upon Defendant Corporation's choice of appraisal. 28. Submission of an appraisal value of the collateral, is an essential element to grant of the refinancing request and Defendant Corporation should have reasonably foreseen that a competent appraisal was a requirement to the grant of Plaintiff's residential mortgage refinancing. 7 '. 29. Upon the representations and/or failure to act of the Defendant Corporation, Plaintiffs forbore obtaining alternative appraisal or lowering their loan request amount until loss of the availability of 6.25% interest of the financing. 30. As a direct consequence of the above described acts and omissions of the Defendant Corporation, Plaintiffs incurred a detriment and sustained the following losses. a. $1,342.00 (difference in interest payment between the date of refusal and the next date 6.125% was available for refinancing. b. $250.00 appraisal fee paid to Defendant Corporation. c. $42.40 credit report fee. d. $50.30 filing fee for civil complaint at District Justice's office. e. $12.18 film development costs for exhibits at the District Justice hearing. f. $16.32 mileage for attendance at District Justice hearing and investigation. g. $151.00 loss of salary for attendance at District Justice hearing. TOTAL$ 1,864.20 WHEREFORE, Defendant PENNSYLVANIA CREDIT UNION LEAGUE and PACUL SERVICES, INC. is estopped and liable and Plaintiffs RONALD and CARYL SHEPPARD should be granted consequential damages of 8 $1,824.20 plus interest and costs of suit, such amount being within the mandatory parameters of mandatory arbitration by Local Rules of Court. COUNT III BUSINESS NEGLIGENCE 31. Paragraphs one (1) through thirty (30) are incorporated herein as if set forth in full. 32. Defendant Corporation is in the business inter alia of processing transfer and procuring residential refinancing and, as such, knows or should have known the requirement to select competent appraisers and the need to do business in a timely manner in a fluctuating interest market. 33. Defendant Corporation negligently, wantonly and recklessly failed to select a competent appraiser, and/or failed to timely notify Plaintiffs of the manifestly devaluated appraisal to permit them to retain another appraisal or reduce their loan amount request amount when 6.25% per annum interest was available, and/or failed to respond in a timely manner to Plaintiffs many requests for timely assistance. 34. Such negligent acts directly and proximately caused the Plaintiffs to incur the following damage: a. $1,342.00 (difference in interest payment between the date of refusal and the next date 6.125% was available for refinancing. 9 LL.J .............,."'" PACUL assigned an appraiser from their list of approved appraisers. His appraisal was improperly done (it came in $15,000 less than an apprai done in 1991). Our lock on interest rates ran out, rates rose a PACUL would not extend the rate or do anything to rectify the error.
