COMPLAINT IN CIVIL ACTION
AND NOW, comes Plaintiff, PNC Bank, N.A., by its Attorney,
Murray A. Felder, Esq., and files this Complaint in Civil Action
of which the following is a statement:
1. Plaintiff is PNC Bank, N.A., a National Banking
Association with an office located at 2730 Liberty Avenue,
Pittsburgh, PA 15222.
2. Defendants are Leonard E. Guise & Holly A Guise,
individuals residing at 203 Chestnut Street, Mt. Holly Springs,
PA 17065.
3. On or about December 23, 1989 Defendants applied for and
were issued a Loan by Plaintiff in the amount of $17,389.26 as
evidenced by the Note & Security Agreement attached hereto as
Exhibit nAn. The loan was assigned account number 710024290,

LEONARD E. GUISE v. GEORGE T. LOWE AND KATHERINE L. LOWE
AND NOW comes Defendant, Leonard E. Guise, by and through
his attorney, Michelle R. Calvert, Esquire, and files this
Complaint against Additional Defendants, George T. Lowe and
Katherine L. Lowe, and in support thereof avers as follows:
1. Defendant is Leonard E. Guise, an adult individual
residing at 203 Chestnut Street, Mt. Holly Springs, Cumberland
County, Pennsylvania 17065.
2. Additional Defendants are George T. Lowe and Katherine
L. Lowe, adult individuals residing at 603 South Second Street,
Chambersburg, Franklin county, Pennsylvania 17201.
3. On or about December 23, 1989, Defendant and his ex-
wife, Holly A. (Guise) Schick, were issued a loan by CCNB Bank,
N.A. in the amount of Seventeen Thousand Three Hundred Eighty-
nine Dollars and 36/100 ($17,389.36).
4. The loan was evidenced by a Note and Security Agreement,
in which Defendant and Ms. Schick granted CCNB Bank a mortgage on
real property located on Old Town Road, South Middleton Township,
Cumberland County, Pennsylvania (hereinafter "the Property").
5. On or about September 29/ 1994, the property was sold to
Additional Defendants at tax sale for the upset price of Seven
Hundred Thirty-seven Dollars and 83/100 ($737.83).
6. The property was subsequently transferred by Additional
Defendants to Edgar E. Dorsey, Jr. and Sharon L. Dorsey
(hereinafter "Dorseys"), by deed recorded April 4, 1995.
7. The sale price in this transfer by Additional Defendants
was Twenty-five Thousand Dollars ($25,000.00).
8. At the time of this sale to Dorseys, a title search on
the property revealed the existence of the mortgage lien in favor
of PNC Bank, N.A., successor to CCNB Bank, N.A.
9. In response to an inquiry concerning the status of the
mortgage, a representative of PNC Bank advised that the mortgage
obligation had been paid in full.
10. This information was incorrect in that the loan to
which the mortgage related had never been paid.
11. The transfer from Additional Defendants
proceeded on the basis of this information, and funds
reserved for payment toward the still existing mortgage.
12. At the insistence of the title company and Dorseys, PNC
Bank subsequently prepared a release from Mortgage, which was
recorded on August 30, 1995, releasing the subject property from
the mortgage lien.
13. Additional Defendants received proceeds from the sale
of the property that wou[d otherwise have gone to payoff the
mortgage.

14. On or about August 16, 1996, PNC Bank, N.A. instituted
a civil action on the Note against Defendant and Holly A. Schick
alleging default and demanding judgment in the amount of the
unpaid balance.
15. In its action,. PNC Bank seeks a judgment against
Defendant and Holly A. Schick, jointly and severally, in the
principal amount of Eleven Thousand Five Hundred Ninety-three
Dollars and 57/100 ($11,593.57), plus attorney's fees of Two
Thousand Three Hundred Eighteen Dollars and 71/100 ($2,318.71),
plus costs and interest.
16. In the event that PNC Bank is successful in its claim
against Defendant, Additional Defendants will have been unjustly
enriched in the amount of Thirteen Thousand Nine Hundred Twelve
Dollars and 28/100 ($13,912.28), plus costs and interest, as a
result of the mortgage having gone unpaid from the proceeds
realized upon their sale o~ the property.
17. Additional Defendants have enjoyed an unjust enrichment
at the expense of Defendant in that neither Defendant nor PNC
Bank now has recourse against the property as a means of
satisfying the remaining debt on Defendants' loan.
18. Additional Defendants' receipt of the additional monies
is unjust in that they were made aware of the existence of the
mortgage prior to, at the time of, and subsequent to their sale
of the property, and chose to do nothing to address the issue of
the excess funds they received.
19. The benefit to Additional Defendants is unjust in that
they have been able to realize the gain of in excess of Twenty-
four Thousand Dollars ($24,000.00) on the sale of the property,
without payment of the mortgage which was a valid lien against
the property at the time of their sale.
20. The unjust enrichment of Additional Defendants creates
an implied contract between Defendant and Additional Defendants,
compelling restitution of the amounts obtained by Additional
Defendants at Defendant's expense.
WHEREFORE, Defendant, Leonard E. Guise, in the event that he
is determined to be liable to PNC Bank, N.A. on its claim,
demands judgment against both Additional Defendants, George T.
Lowe and Katherine L. Lowe, jointly and severally, in the amount
of Thirteen Thousand Nine Hundred Twelve Dollars and 28/100
($13,912.28), plus costs and interest.

payments. Additional sums of Five Hundred Forty-Five Dollars and
23/100 ($545.23) and Twelve Hundred Seventy-seven Dollars and
43/100 ($1,277.43) were thereafter applied by Plaintiff toward
the outstanding balance. These amounts were seized by Plaintiff
from other PNC Bank accounts held by Defendant and Defendant's
father, respectively. On or about November 2, 1995, a
representative of Plaintiff known only as Mr. Wright advised
Defendant, through his at~orney, that the outstanding principal
balance was Ten Thousand Seven Hundred Ninety-three Dollars and
95/100 ($10,793.95).

7. Admitted in part and denied in part. It is admitted that
the Note provides for the addition of attorney's fees of 20% in
the event of a default. The allegation that attorney's fees at
this rate are reasonable is a conclusion of law to which no
response is required and the same is therefore denied.

a conclusion of law to which no response is required, and the
same is therefore denied.
WHEREFORE, Defendant, Leonard E. Guise, demands judgment in
his favor against plaintiff, FNC Bank, N.A.

9. Defendant Leonard E. Guise's Answers contained in
paragraphs 1 through 8 are hereby incorporated as if set forth at
length.

10. As indicated by the terms of the Note and Security
Agreement attached to Plaintiff's complaint, the instant debt was
originally secured by a mortgage on real property then belonging
to Defendants located on Old Town Road, South Middleton Township,
Cumberland County, pennsylvania.
11. The mortgage, in the amount of Seventeen Thousand Three
Hundred Eighty Nine Dollars and 36/100, ($17,389.36), was
originally recorded on January 8, 1990 in favor of CCNB Bank,
N.A., predecessor corporation to Plaintiff herein.
12. On or about September 29, 1994, this real property was
sold at tax sale to George T. Lowe and Katherine L. Lowe
(hereinafter "Lowes").
13. The property was subsequently transferred by Lowes to
Edgar E. Dorsey, Jr. and Sharon L. Dorsey (hereinafter
"Dorseys"), by deed recorded April 4, 1995.
14. At the time of the sale to Dorseys, a representative of
Plaintiff advised Frofessional Abstract, the title company
conducting the real estate settlement, that the subject mortgage
had been paid in full, and would be marked satisfied on the
records of the cumberland county Recorder of Deeds.
15. This information was incorrect in that the loan to
which the mortgage related had never been paid.
16. Proceeding on th~ basis of this incorrect information,
Professional Abstract conducted the settlement without reserving
funds for, or making payment on, the mortgage. The mortgage lien
thus remained on the property after the transfer.

17. At the insistence of Frofessional Abstract and Dorseys,
Plaintiff subsequently prepared a Release from Mortgage, which
was recorded on August 30, 1995, releasing the subject property
from the mortgage lien.
18. As a direct result of Plaintiff's negligence in
providing incorrect information as to the status of the mortgage
and in releasing the subtect property from the mortgage lien,
Defendant's obligation on the Note and Mortgage was not satisfied
out of the proceeds of the sale to Dorseys.
19. Defendant's obligation on the Note and Mortgage would
have been satisfied but for Plaintiff's mistake, since the
obligation constituted a valid lien on the property at the time
of the transfer from Defendant to Lowes via Tax Claim Deed and at
the time of the transfer from Lowes to Dorseys.
WHEREFORE, Defendant, Leonard E. Guise, demands judgment in
his favor and against Plaintiff, PNC Bank, N.A. on its claim, and
that Plaintiff's Complaint against him be dismissed.

AND NOW comes Defendant, Leonard E. Guise, by and through
his attorney, Michelle R. Calvert, Esquire, and files this
Complaint against Additional Defendants, George T. Lowe and
Katherine L. Lowe, and in support thereof avers as follows:
1. Defendant is Leonard E. Guise, an adult individual
residing at 203 Chestnut Street,. Mt. Holly Springs, Cumberland
County, Pennsylvania 17065.
2. Additional Defendants are George T. Lowe and Katherine
L. Lowe, adult individuals residing at 603 South Second Street,
Chambersburg, Franklin County, Pennsylvania 17201.
3. On or about December 23, 1989, Defendant and his ex-
wife, Holly A. (Guise) Schick, were issued a loan by CCNB Bank,
N.A. in the amount of Seventeen Thousand Three Hundred Eighty-'
nine Dollars and 36/100 ($17,389.36).
4. The loan was evidenced by a Note and Security Agreement,
in which Defendant and Ms. Schick granted CCNB Bank a mortgage on
real property located on Old Town Road, South Middleton TownShip,
Cumberland County, Pennsylvania (hereinafter lithe Property").
5. On or about september 29/ 1994, the property was sold to
Additional Defendants at tax sale for the upset price of Seven
Hundred Thirty-seven Dollars and 83/100 ($737.83).
6. The property was subsequently transferred by Additional
Defendants to Edgar E. Dorsey/ Jr. and Sharon L. Dorsey
(hereinafter "Dorseys"), by deed recorded April 4, 1995.
7. The sale price in this transfer by Additional Defendants
was Twenty-five Thousand Dollars ($25,000.00).
8. At the time of this sale to Dorseys, a title search on
the property revealed the existence of the mortgage lien in favor
of PNC Bank, N.A., successor to CCNB Bank, N.A.
9. In response to an inquiry concerning the status of the
mortgage, a representative of FNC Bank advised that the mortgage
obligation had been paid in full.
10. This information was incorrect in that the loan to
which the mortgaga related had never been paid.
11. The transfer from Additional Defendants to
proceeded on the basis of this information, and funds
reserved for payment toward the still existing mortgage.
12. At the insistence of the title company and Dorseys, PNC
Bank subsequently prepared a release from Mortgage, which was
recorded on August 30, 1995, releasing the subject property from
the mortgage lien.
13. Additional Defendants received proceeds from the sale
of the property that woufd otherwise have gone to payoff the
mortgage.

14. On or about August 16, 1996, FNC Bank, N.A. instituted
a civil action on the Note against Defendant and Holly A. Schick
alleging default and demanding judgment in the amount of the
unpaid balance.
15. In its action,- PNC Bank seeks a judgment against
Defendant and 'Holly A. Schick, jointly and severally, in the
principal amount of Eleven Thousand Five Hundred Ninety-three
Dollars and 57/100 ($11,593.57), plus attorney's fees of Two
Thousand Three Hundred Eighteen Dollars and 71/100 ($2,318.71),
plus costs and interest.
16. In the event that FNC Bank is successful in its claim
against Defendant, Additional Defendants will have been unjustly
enriched in the amount of Thirteen Thousand Nine Hundred Twelve
Dollars and 28/100 ($13,912.28), plus costs and interest, as a
result of the mortgage having gone unpaid from the proceeds
realized upon their sale o~ the property.
17. Additional Defendants have enjoyed an unjust enrichment
at the expense of Defendant in that neither Defendant nor PNC
Bank now has recourse against the property as a means of
satisfying the remaining debt on Defendants' loan.
18. Additional Defendants' receipt of the additional monies
is unjust in that they were made aware of the existence of the
mortgage prior to, at the time of, and subsequent to their sale
of the property, and chose to do nothing to address the issue of
the excess funds they received.

monthly payment on the loan was made by Defendant in September
1994, although Defendant has no knowledge as to whether his ex-
wife, Defendant Holly A. (Guise) SChick, made any subsequent

payments. Additional sums of Five Hundred Forty-Five Dollars and
23/100 ($545.23) and Twelve Hundred Seventy-seven Dollars and
43/100 ($1,277.43) were thereafter applied by Plaintiff toward
the outstanding balance. These amounts were seized by Plaintiff
from other PNC Bank accounts held by Defendant and Defendant's
father, respectively. On or about November 2, 1995, a
representative of Plaintiff known only as Mr. Wright advised
Defendant, through his at~orney, that the outstanding principal
balance was Ten Thousand Seven Hundred Ninety-three Dollars and
95/100 ($10,793.95).

the Note provides for the addition of attorney's fees of 20% in
the event of a default. The allegation that attorney's fees at
this rate are reasonable is a conclusion of law to which no

B, reasonably believed that no mortgage existed in favor of thc Plaintiff. Since thc mortgage was
subsequently released from the rcal estate sold by the Additional Dcfcndants they did not receive

21. It is admitted that Defendant, Leonard E. Guise,
executed a Quit Claim Deed for the real estate encumbered by
Plaintiff-'s mortgage.
This Quit Claim Deed was executed only
after the transfer of the property to Additional Defendants by
tax claim deed recorded in Cumberland County Deed Book 118, Page
944.

23. Admitted in part and denied in part. It is admitted
that Defendant Leonard E. Guise was aware of the existence of
Plaintiff's mortgage at the time the Quit Claim Deed was
executed.

Defendants and the settlement agent were aware of the existence
of the mortgage based upon their contacts with PNC Bank and the
title search which had been done on the property.

25. Denied. Defendant is without knowledge and information
sufficient to form a belief as to the truth of the averment that
Additional Defendants and the settlement agent reasonably
believed that there was no mortgage lien on the real estate,
proof thereof being in the exclusive means, control, and
possession of Additional Defendants. Therefore, the same is
hereby denied, and strict proof thereof is demanded at trial, if
relevant.

27. Admitted in part and denied in part. It is admitted
that the real estate purchased by the Additional Defendants at
the tax sale was subject to the mortgage lien. It is denied that
Additional Defendants were never personally liable for the debt,
as personal liability arose as a result of their being unjustly
enriched by the receipt of settlement proceeds without deduction
for payment of the mortgage lien.

removed and released from said obligation to CCNB Bank.

of the mentioned Note obligation. By way of further Answer,
William C. Guise is not unjustly enriched in any way by the outcome
of the action between Lowes and Defendants Leonard E. Guise and
Holly A. Guise.

The allegations of Paragraphs 1 through 10 above are incorporated
herein by reference thereto.

At the time Additional Defendant William C. Guise executed the Note
to CCNB, which said Note is attached to the Amended Complaint filed
against William C. Guise in this matter, the joinder of William C.
Guise in said Note was only for the purpose of the adding of
additional security on the Note being the 1985 Ford Van.

The agreement William C. Guise had with CCNB was that he would be
removed from a Guarantor or additional security on said Note at
such time as certain payments were made and at such time as the
1985 Ford Van was removed from the Note.

Payments were made on said Note to such an extent that the 1985
Ford Van was released as security on said Note on January 29, 1992
at which time all parties further understood that the guarantee and
additional security of William C. Guise in connection with said
Note was also removed and that William C. Guise was discharged from
any further obligation as Guarantor or co-signer on said Note.

Additional Defendant William C. Guise received no financial benefit
from the Note in question and never received any of the monies nor
any consideration in any way relating to said Note obligation.
