acts of the Defendant, Jennifer Phelabaum, the Plaintiff, Bryan Gembusia, has suffered
medically determinable physical impairments which have prevented him from performing all of
the normal acts and duties which constitute her usual and customary daily activities.
12. As a further direct and proximate result of the negligent, careless and/or reckless
acts of the Defendant, Jennifer Phelabaum, the Plaintiff, Bryan Gembusia, has experienced
severe pain and suffering, mental anguish and humiliation, and in the future may continue to so
experience.
13. As a further direct and proximate result of the negligent, careless and/or reckless
acts of the Defendant, Jennifer Phelabaum, the Plaintiff, Bryan Gembusia, has suffered a loss
of life's pleasures and in the future will continue to suffer a loss of life's pleasures.
WHEREFORE, Plaintiff, Bryan Gembusia, demands judgment against Defendant,
Jennifer Phelabaum, in an amount in excess of the compulsory arbitration limits plus costs and
interest as provided by law.

DEFENDANT'S PRE-TRIAL MEMORANDUM
I. FACTS OF LIABILITY
'rhis accident occurred on May 29, 1996 at approximately 7:45
p.m. on State Route 944 in East Pennsboro Township. At the
timo of the accident, the Plaintiff suddenly and unexpectedly
brought his vehicle to a stop. The Defendant did not have
time to react and struck the rear of the Plaintiff's vehicle.
Tho Dofendant's position is that the Plaintiff stopped to
spoak with someone along the roadway. Instead of pulling off
of the roadway, the Plaintiff stopped in the middle of the
street.
II. FACTS OF DAMAGES
Bryan Gembusia was seen at the Emergency Room of the Holy
Spirit Hospital on the date of the accident. He had one
follow up visit with his family physician approximatley one
(1) week after the accident. He received no further treatment
for his alleged injuries.
III. ISSUES
A. Negligence of the Defendant.
B. Comparative negligence of the Plaintiff.
C. Damages.

1. After reasonable investigation, Defendant is without
sufficient knowledge to form a belief as to the truth of the
averments of Paragraph 1.
Therefore, each and every averment of
Paragraph 1 is specifically denied and strict proof thereof is
demanded at the time of trial.

aforesaid time and place, a vehicle operated by Defendant, Jennifer
L. Phelabaum struck another vehicle from behind while the other
vehicle was stopped on Route 944. After reasonable investigation,
Defendant is without sufficient knowledge to form a belief as to
the truth of the remaining averments of Paragraph 4.
Therefore,
the remaining averments of Paragraph 4 are specifically denied and
strict proof thereof is demanded at the time of trial.
5. After reasonable investigation, Defendant is without
sufficient knowledge to form a belief as to the truth of the
averments of Paragraph 5. Therefore, each and every averment of
paragraph 5 is specifically denied and strict proof thereof is
demanded at the time of trial.
6. The averments of paragraph 6 constitute a conclusion of
law to which no response is required. To the extent that a
response is deemed required, each and every averment of paragraph
6 is specifically denied and strict proof thereof is demanded at
the time of trial.
7. After reasonable investigation, Defendant is without
sufficient knowledge to form a belief as to the truth of the
averments of Paragraph 7. Therefore, each and every averment of
paragraph 7 is specifically denied and strict proof thereof is

sufficient knowledge to form a belief as to the truth of the

WHEREFORE, Defendant, Jennifer L. Phelabaum, respectfully
requests Your Honorable Court to dismiss the Plaintiff's Complaint
with prejudice.
NEW MATTER
14. The collision referred to in the Plaintiff's complaint
was caused by the negligence, carelessness and recklessness of
plaintiff, Bryan Gembusia, in that he:
(a) stopped his vehicle in the middle of a roadway for no
apparent reason other than to converse with a pedestrian;
(b) failed to move his vehicle off to the berm of the roadway
before stopping;
(c) failed to maintain his vehicle under proper and adequate
control;
(d) failed to notice the imminence of an accident and to take
the necessary steps to avoid the same; and
(e) acted without due regard to the safety and rights of the
Defendant.
15. The Plaintiff's claims are barred, or should be reduced
in accordance with S 1722 of the pennsylvania Motor Vehicle
Financial Responsibility Act.
16. The plaintiff's claims for medical expenses and lost
wages are barred, or should be reduced in accordance with S 1722 of
the pennsylvania Motor Vehicle Financial Responsibility Act.
