STIPULATION AGAINST LIENS
THIS AGREEMENT made this ,>' day of /' ',,' I 1996, by
and between Farinelli Construction, Inc, a Pennsylvania
Corporation, hereinafter referred to as Contractor,
AND
Donald J, Farinelli and Jeanne K, Farinelli, husband and wife,
hereinafter referred to as Owners, whereby the contractor
undertook and agreed to erected and construct a dwelling on the
certain lot of ground situate in Upper Allen Township, Cumberland
County, Commonwealth of Pennsylvania, and more fully described in
Exhibit "A" which is attached hereto and made a part hereof known
as Lot #9 Bumble Bee Hollow, Mechanicsburg, PA,
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1,00) Dollar
to Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its,
his or their subcontractors, and all parties acting through or
under them, covenant and agree that no mechanic's liens or claims
shall be filed or maintained by them or any of them against the
said buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under
them, hereby expressly waive and relinquish the right to have,
file, and maintain any mechanic's liens or claims against the said
buildings or any of them, and agree that this instrument, waiving
the right of lien, shall be an independent covenant.

Exhibit "A"
ALL that certain piece. parcel or tract of land situate in Upper
Allen Township, Cumberland County, Pennsylvania more particularly
identified as Lot No, 9 on a subdivision plan recorded in
Cumberland County Plan Book 60, Page 4, which premises are
bounded and described as follows, to wit:
BEGINNING at a point on the easterly right of way line of Kacey
Court, at the southwest corner of Lot No, 8 on the said
subdivision plan; thence along Lot No, 8, North 51 degrees 58
minutes 00 seconds East, the distance of 295.67 feet to a point;
thence South 39 degrees 15 minutes 50 seconds East, the distance
of 119.32 feet to a point at the north east corner of Lot No. 10,
on said subdivision plan; thence along Lot No. 10, South 39
degrees 39 minutes 39 seconds West, the distance of 305,18 feet
to a point at the easterly right of way line of Kacey Court,
aforesaid; thence along same, North 38 degrees 02 minutes 00
seconds West, the distance of 184,33 feet to a point the place of
BEGINNING,
CONTAINING 1,036 acres of land,
UNDER AND SUBJECT to conditions and restrictions set forth on
said subdivision plan,
BEING part of the premises which MRK Associates, a Partnership
by deed dated January 12, 1989 and recorded in the Office of the
Recorder of Deeds in and for Cumberland County in deed Book 33-T,
Page 891, granted and conveyed to Chad Hazam, one of the Grantors
herein, Karis Lewellen-Hazam joins in this conveyance to
extinguish any right, title or interest she may have to s~id
property by reason of her marriage to Chad Hazam,
