A. HISTORY OF CASE:
The father brought this matter before the custody conclllato,' just one year ago,
On August 26, 1996, the parties entered a sllpulallon for custody where the mother wes
given primary custody of the child, The father, despite being given addlllonalllme with
his child, as a result of tha July, 1997 conciliation process, neglected to exerclsa that
time with the child, As a rasult of the 1997 conclllallon, the father was given the child
from Thursday evening through Monday morning on alternating weekends, For the first
several months the father generally did not exercise his vlsltallon on Friday, Typically,
ho would return the child after a few hours on Thursday evening and pick her up again
Friday after ha finished work, Likewise, he would generally return the child on Sunday
evening rather than Monday morning. Of the esllmated twenty six Fridays that the
Father had custody for the entIre day It Is believed that he has only taken one day off
work to spend the lime with his child, It Is bolleved thet if the child has been kept on a
Friday that she has remained with the Father's mother, In a similar matter, the Father,
having the right to have two weeks of vacation Ilchedule with his daughter, has
neglacted to exercise this time with the child. Father has taken vacations but has not
brought his daughter with him,
The Mother Is a full time homemaker end has every opportunlly to cere for her
child, The Father's suggestion Is that the grandmother be substituted for him In cering
for the child This Is contrary to the child's best Interest end IIl1empts to substitute a
grandmother for the custodial parent
e, ISSUES BEFORE THE COURT
The Mother adall1anlly denies Ihot she has ever allempted to undermine the
child's relationship wllh the Father and hiS family As referenced earlier, despite having
the opportunity to spend 1110re time wllh his daughter, the Father and his family have
neglected to do 50 The sole Issue In Ihls custody case, as In any c1Jstody case Is the
best Interest of Allison Given the presenl circumstances of Moti1er being a
homemaker and available to care for thiS four year old child it is approprlalethat the
Mother remain the primary caretaker and that the F ather have periods of partial
custody, The Mother also requests that the court consider the Issue of legal custody as
for the past several monlhs she has been trying to arrange with the Father for the
daughter to allend a pre-school program, The Mother wants some modification on the
holldey schedule and the same 15 attached hereto,

Allleon Strayer, age 4, born July 26, 1994, The partlee wel'e married on June 215,
19BB, They efJparated on July 22, 1996, and were dlvoroed In January, 1991. The
father Is single. The mother married Dwight West on Maroh 21, 199B, West has two
daughters, ages 5 and 10, who live wllh their mother In Ohio. HG hae those ohlldren
for an extended period of temporary physloal oustody eaoh summer. He alllo seee
them approximately onoe per month,
The mother lives In a three bedroom home In Carlisle that Ie approximately
nine miles from the father's two bedroom townhouse In Boiling Springe, The paternal
grandparents live approximately two miles from the home of the father. The maternal
grandparents live a few miles from the home of the mother. The mother formerly
worked outelde the home, but Is now a homemaker. She ended her employment In
order to provide full.tlme oare for Allison, She has no plans to retake employment.
The father works Monday through Fridays for the Woolworth Corporation In Camp
HIli, He works nine hour shifts that oan start as early BS 7:00 a m. and end ee late as
10:00 p.m, He has some limited flexibility with his schedule,

Allison, The mother has primary physloal ouslody, The father has periods of

Less than a month atler the molher remarried, Ihe falher tiled Ihe within petition
to modify the oustody order, He seekll shared physloal oustody of Allison on an
alternate week basis. When the father exerolses his ourrent expended alternate
weekend of tsmporary physloal oustody, the paternal grandmother, who Is a retired
klndergarton leaoher, takes oare of Allison on the Fridays when he Is working, I The
father proposes 10 have his mother oare for Allleon when he Is working on eaoh
weekday during the allernale weeks he seeks under a shared oustody order, The
molher objeots 10 Iho shared oustody sohedule suggested by the falher, She
believes that Allison should have a primary home, wllh the father having periods of
temporary ~hysloal custody, We conducted a hearing on August 12, 199B,
The father will notlalk to Ihe mOlher, He Is extremely bl<<er aboulthe breakup

the mother concurred, that the parent who has Allison will, at the end ot any period
with her, take har to the other parent's home, Allison will not start kindergarten until
the tall 01 1999, Both parents agree that she should now attend a three day a week
pre.sohool program at L1ltle Hearts and Souls In Carlisle, The program Is for two
houre saoh Monday, Wednesd/;\y and Friday, The mothsr wants Allison to attend In
the afternoons and the tather wants her to go In the mornings. They have yet to
agree on a schsdule,
The father has two weeks vacation eaoh year, He has not exerolsed any 01 his
separate two weeks 01 vacation with Allison as allowed In the oustody order of July
22, 1997, Hs rscently took a vaoatlon to the home of his aunt In Louisiana, but he
did not take Allison, The father complains that the mother does not allow him to see
Allison enough on oocaslons other than as speclfloally set forth In the custody order
of July 22, 1997, Notwithstanding, he allknowledged that on ten oooaslons out ot
fifteen when he hAS asked to have Allison the mother has allowed him additional
