While driving her vehicle ot approximately 3:60 p,m, on June 24, 1996,
petitioner Evelyn K, Yost had a one-vehicle accident In Cumberland County,
Petitioner swerved off the right side 01 a highway lor 360 leet. She then crossed the
highway hitting an embankment and Illld to a stop, Trooper Jeffrey Braid 01 the
Pennsylvania State Police responded to the scene, The trooper noticed that
petitioner's speech was slurred, her eyes were bloodshot and glaasy, and ahe had an
odor 01 alcohol about her person, The trooper asked petitioner the direction she had
been drlvlng and ahe pointed the wrong way, Petitioner acknowledged to the trooper
that she was under the Influence 01 alcohol. An ambulance crew wanted to transport
petitioner to a hospital but she declined, Trooper Braid arrested petitioner lor driving
under the Influence and told her that he was going to take a blood test. He tClld her
that he preferred that she go to a hospital In the ambulance but otherwise she would
have to travel In his pollee car, Petitioner then blacked out and was taken to the
Carlisle Hospital by ambulance,
Petitioner was treated at the emergency room 01 the Carlisle Hospital by

Trooper Braid wenllo Ihe hospital and twice read potltloner her rlghls under
the Implied Consent Law, Both times, petitioner retused a blood lesl. Trooper Braid
ftlled out a retussl form at 5:22 p,m, Trooper Braid thought Ihal he asked Dr,
Guarraclno If blood had been drawn for medical purposes, although he could not
remember, Dr, Guarraolno testltled that he did not recall Trooper Braid asking him If
blood was drawn for medical purposes, Petitioner was treated and released from the
hospital al 6: 12 p,m,
Pursuant to the VehIcle Code 75 PQ,C,S, Section 1547(b)(1), the Department ot
Transportation suspended petitioner's driving priVilege for one year tor tailing to
prOVide blood for a test of alcohol content. In order to sustain a license suspension
under Beotlon 11547(b)(1) at the Vehlcll:l Code, the Department must prove that Ihe
IIcensae (1) was arrested tor driving under the Intluence of alcohol; (2) was asked to
submit to a chemical test; (3) refused to do so; and (4) was specifically warned that
the retusal would result In a license suspension. Depurtment ot Transportutlon,
