5. Plaintiff'. reoord. prelently .how no rentBl aheokl were
reoeived from defendant linoe April, 1995. The totBl amount owed by
the defendant from April, 1995 through June, 1996 il $3750.00.
6. Between October 6, 1995, and June 30, 1996, and only after
severel unluocellful attempts were made to relolve this problem with
the defendent, the plaintiffs reluotantly turned to the legal sYltom
in the hopes of outting their 101les of rental inoome.
7. Plaintiffs filed a landlord/tenant oomplaint on July 10,
1996, before Diltriot Justioe Manlove demanding judgment in the amount
of $3750.00. ^ hearing wal soheduled for July 18, 1996, at 10115 a.m.
8. Pefendant allegedly reoeived notice of this hearing on July
15, 1996, requeeted a oontinuanoe in order to prepare for the hearing
and allegedly was advised at that time by th~ Distriot JUltioe of the
new oourt date set for July 29, 1996.
9. Defendant filed an Anewer and New Matter before Distriot
JUltioe Manlove on July 24, 1996.
10. Defendant filed a Petition Raising Questions of Jurisdiotion
in Distriot Juetiae Manlove's offioe almost two houre before the
soheduled hearing, yet failed to Ihow for his own eviotion hearing.
11. Defendant failed to show for the hearing on July 29, 1996.
The Distriot Justice ordered jUdgment for the plaintiffs for the

In this opinion we address defendant William Tenny's preliminary objecllons
tc plaintiffs' baslo Landlordrrenant Complaint. The faots are all follows: Plaintiffs
Roger J, and Morlan Wood allegedly rented three rooms looated at 2204 Market
Street, Camp HIli, to Tenny, (Plaintiffs' LandlordlTenant Complaint, hereinafter 'PI.
Cmpl,. 1,) This rental was based upon an oral lease, (PI, Cmpl, 1,) The Woods
now olalm that Tenny owes them $3750,00 In back rent whloh he has not paid
since April 1995, (PI, Cmpl, 2, 4,) For this reason, the plaintiffs have ffled a
LandlordlTenant Complaint In tha Cumberland County Court of Common Pleas,
(PI, Cmpl, 4.) Tenny has responded to this complaint by filing preliminary
obJeotlons,
The defendant separates his preliminary obJecllons Into two main headings.
The first Is titled 'Defense of Prior Aotlon Pending,' Under the Pennsylvania Rules

Flrslly, Tenny elleges that the plalnllffs' complaint lacks verlfloallon of
purported faots, However, a verlfloallon was flied by the plalnllffs on Ootober 11,
1996, which alleviates this problem, Therefore, the Court denies this preliminary
objeotlon,
Secondly, Tenny claims that the oomplalnt pleade the e)(lstenoe of a
proposed lease but falls to Inolude a copy of II, thereby vlolallng tho Pennsylvania
Rules of Civil Procedure, However, the rule states that 'a pleading shall state
specifically whether any claim or defense set forth thf,lreln Is based upon a wrlllng,'
Pa, R.Clv,P, 1019(h), In the case at bar, the dispute Is based upon an alleged oral
lease, The plaintiffs' complaint menllons that Tenny was asked to sign a wrlltan

lacks lurhsdlcllon over LandlordfTenant Complaints, However, this case Is nothing
more than a basic contract action which Invclves a routine claim for the back pay
of rental monies. Therefore, this Court has jurisdiction over this matter and
defendant's motion to strike Is denied,
Additionally, there Is no need for this Court to examine the plaintiffs' answer
to the preliminary ob/ectlons or defendant's response, This case Involves a

to plaintiffs' baslo LandlordlTenant Complaint. The faots are as follows: Plaintiffs
Roger J, and Marlan Wood allegedly rented three rooms looated at 2204 Markot
Street, Camp HIli, to Tenny, (Plaintiffs' LandlordlTenant Complaint, hereinafter "PI,
Cmpl," 1.) This rental was based upon an oral lease, (PI, Cmpl, 1.) The Woods
now olalm that Tenny owes them $3750,00 In baok rent which he has not paid
since Aprll 1995, (PI, Cmpl, 2, 4,) For this reason, the plaintiffs have flied a
LandlordlTenant Complaint In the Cumberland Counly Court of Common Pleas,
(PI. Cmpl, 4,) Tenny has responded to this complaint by filing preliminary
ob/eotlons,
The defendant separates his preliminary objections Into two main headings,
The first Is titled "Defense of Prior Aotlon Pending," Under the Pennsylvania Rulas
of Civil Prooedure, preliminary objeotlons are limited 10 certain grounds, Pa,
R.Clv,P, 1028, The defendant's preliminary objection of "Defense of Prior Aotlons

Pandlng' does not fit within any of the enumerated grounds under this rule. For
this reason, the Court denies this preliminary objeotlon,
"he defendant's second heading Is 'Motion to Strlke.Off Woods'
Landlordrrenant Complaint,' Tenny has several preliminary objaotlclns listed under
this seollon.
Firstly, Tenny alleges that tho plalnllffs' oomplalnt looks verlfloatlon of
purported facts, However, a verification was lIIed by the plaintiffs on October 11,
1996, whloh alleviates Ihls problem. Therefore, the Court denies this preliminary
obJection.
Seoondly, Tenny claims that the complalnl pleads the existence of a
proposed lease bulfalls 10 Include a copy of II, Ihereby violating the Pennsylvania
Rules of Civil Procedure, However, the rule slates thai 'a pleading shall state
speclfloally whother any claim or defense set forth therein 15 based upon a writing,'
Pa, R,Clv.P. 1019(h). In the caso at bar, the dispute Is based upon an alleged oral
leaso. The plaintiffs' complalnl mentions Ihal Tenny was asked to sign a written
lease but refused. Howover, Ihls unsigned lease 15 not Ihe basis of Ihe claim and
therefore does not need 10 be altached. For this reason, the Court denies this
preliminary objection.
Thirdly, Tenny claims that the plaintiff's complaint contains Impertinent facts

and prooedural matter. For 11 pleading to contain Impertinent allegations, It must
Inolude olalms of a scandalous nature, This means 'rmy unneoessary allegation
whloh bears oruelly on the moral oharaoter 01 an Individual or states anything whloh
Is contrary to good manners, anything which Is unbecoming to the dignity 01 a oourt
to hear,' GOODRICH.AMRAM 2d !j1017(b):14, HOW13ver, none of the allegallons
In the plaintiffs' complaint reach this outrageous level, Furthermore, '[tlhe right to
strike Impertinent matters should be sparingly exercised; where the matter Is
Impertinent but not Injurious, It need not be strioken, Impertinent matter may be
treated as mere surplusage and Ignored,' GOODRICH.AMRAM 2d ij1017(b):16.
Based upon this, any surplusage concerning prooedural matters oan be
disregarded by this Court. Therefore, this preliminary objeotlon Is denied.
Finally, Tenny claims that the r.umberiand County Court 01 Common Pleas
lacks lurisdlcllon over Landlordrrenant Complaints. However, this case Is nothing
more than a basic contract aotlon which Involves a routine claim for the back pay
of rental monies. Therefore, this Court has jurisdlotlon over this matter end
defendant's motion to strike Is denied.
Addlllonally, there Is no need for this Court to examine the plaintiffs' answer
to the preliminary objeotlons or defendant's response. This case Involves a
straightforward contractual action, Therefore, the defendant's preliminary
objections are the only necessary considerations for this Court.

to plaintiffs' baslo Landlordfrenant Complaint, The facts are as follows: Plaintiffs
Roger J, and Marian Wood allegedly rented three rooms located at 2204 Mal'ket
Street, Camp Hili, to Tenny. (Plaintiffs' L.andlordfrenant Complaint, hereinafter 'PI.
Cmpl,' 1,) This rent$1 was based upon an oral lease. (PI. Cmpl, 1.) The Woods
now claim that Tenny owes them $3750,00 In back rent which he has not paid
since April 1995, (PI, Cmpl, 2, 4,) For this reason, the plaintiffs have flied a
Landlordfrenant Complaint In the Cumberland County Court of Common Pleas,
(PI, Cmpl, 4,) Tenny has responded to this complaint by filing preliminary
objections,
The defendant separates his preliminary objections Into two main headings,
The first Is titled 'Defense of Prior Action Pending,' Under the Pennsylvania Rules
of Civil Proceduro, preliminary objections are limited to certain grounds, Pa,
R,Clv.P.1028, The defendant's preliminary objection of 'Defense of Prior Actions

this reason, the Court denies this preliminary objection,
The delendanl's second heading Is 'Motion to Strike.Off Woods'
l.andlordfrenant ComplBlnt,' Tenny hus several preliminary objections listed undGr
this seotlon,
Firstly, Tenny alleges that the plaintiffs' complaint laoks verilloatlon of
purported facts, However, a verillcallon wos filed by the plaintiffs on October 11,
1996, whloh alleviates this problem, Therefore, the Court denies this preliminary
objection.
Secondly, Tenny claims that the oomplalnt pleads the existence of a
proposed lease but foils to Include a copy of It, thereby violating the Pennsylvania
Rules of Civil Procedure, However, the rule states that 'a pleading shall state
specifically whether any claim or delense set forth therein Is based upon a writing,'
Pa, R,Clv.P. 1019(h), In the case at bar, the dlspule Is based upon an alleged oral
lease. The plaintiffs' complaint mentions that Tenny was asked to sign a written
tease but refused, However, this unsigned lease Is not the basis of the olalm and
therefore does not need to be attached. For this reason, the Court denies this
preliminary objection,
Thirdly, Tenny claims that the plaintiffs oomplalnt contains Impertlnentfaots

Include claims of a sosndalous nature, This means 'any unnecessary allogatlon
which bears oruelly on the moral character of an Individual or states anything which
Is contrary to good manners, anything which Is unbecomlt1g to the dignity of a court
to hear.' GOODRICH.AMRAM 2d lj1017(b):14, However, none of the allegations
In the plaintiffs' complaint reach this outrageous level. Furthermore, '[tlho right to
strike Impertinent matters should be sparingly exercised: where the matter Is
Impertinent but not Injurious, II need not be stricken, Impertinent matter may be
treated as mere surplusage and Ignored,' GOODRICH.AMRAM 2d ~1 01 7(b): 1 6,
Based upon this, any surplusage conQernlng procodural matters can be
disregarded by this Court, Therefore, this preliminary objection Is denied,
Finally, Tenny claims that the Cumberiand County Court of Common Pleas
lacks lurisdlctJon over Landlordrrenant Complaints, However, this case Is nothing
more than a basic contract action which Involves a routine claim for the back pay
of rental monies, Therefore, this Court has jurisdiction over this matter and
defendant's motion to strike Is denied,
Additionally, there Is no need for this Court to examine the plaintiffs' answer
to the preliminary objections or defendant's response, This case Involves a
straightforward contractual action, Therefore, the defendant's preliminary
