i. Plaintiff is Wesley Wolt~, an adult individual who
ourrently resides at 17 Walnut Street, Newville, Cumberland
County, Pennsylvania.
2. Defendants are the Sorough of Newville and/or Newville
Borough Wat~r and Sawer Authority with offices at .. West Street,
Newville, Cun~erland County, Pennsylvania.
3, Plaintiff was employed by the Defendants 6S an
assistant plants operator in the Borough Water and S~wer
Department.
4. The Plaintiff was paid an hourly wage for a forty hour
work week scheduled from Monday to Friday, Plaintiff was
requ!.red during this forty hour work week to be fully engaged .in
activities for the Borough Water and Sewer Department.
S, In addition to his regular forty hour worlt week, the
Plaintiff was required by the Defendants to conduct tests on
alternate weekends and holidays,
6. Due to the requirement of oonduoting the t.Qt. the
Plaintiff wa. not free to enjoy hie alternate weekend. and
holiday. aB he waB engaged thoQe days in the furtheranoe of the
Defendant employers bUBiness.
7. The Plaintiff was not oompellBated or otherwise paid by
the Defendants for theBe required activities on alternate
weekends alld holidaya.

O. The Plaintiff inoorporetQB paragraphs one (1) throulj/h
seven (7) herein by referenoe.
9. Tbe failure to pay the P leJ.ntiff for hiB work on
alternate weekends and holidaYB waB a violation of the "Fair
Labor Standards" 29 uses S 201 et Beq.
10. Pursuant to the aforementioned statute the Plaintiff
makes olaim against the Dsfendants for unpaid wageB for all days
worked. plaintiff makes claim for hiB regular hourly wage rate
for eight hourn each day he waB required to conduct teBtB on his
daYB off and overtime at time and a half for all weeks in whioh
his hours exceeded forty(40).

1. ~laintiff is Wesley Woltz, an adult individual who
ourrently residss at 17 Walnut Street, Newville, cumberland
County, ~ennsylvania.
2. Defendants are the Barough of Newville and/or Newville
Borough Water and Sewer Authority with offices at 4 West Strest,
Newville, Cumberland County, Pennsylvania.
3. plaintiff was employed by the Defendants as an
assistant plants operator in the Borough Water and Sewer
Department.
4. The Plaintiff was paid an hourly wage for a forty hour
work week scheduled from Monday to Friday. Plaintiff was
required during this forty hour work week to be fully engaged in
activities for the Borough Water and Sewer Department.
5. In addition to his J:"egu lar forty hour work week, the
Plaintiff was required by the Defendants to conduct tests on
alternate weekends and holidays.

1. Plaintiff is Wesley Wolt2, an adult individual who
currently resides at 17 Walnut Street, Newville, Cumberland
County, Pennsylvania.
2. Defendants are the Borough of Newville and/or Newville
Borough Water and Sewer Authority with offices at 4 West Street,
Newville, Cumberland County, Pennsylvania.
3. Plaintiff was employed by the Defendants as an
assistant plants operator in the Borough Water and Sewer
Department.
4. The Plaintiff was paid an hourly wage for a forty hour
work week schedulod from Monday to Friday. Plaintiff was
required during this forty hour work weok to be fully engaged in
activities for the Borough Water and Sewer Department.
B. In addition to his regular forty hour work week, the
Plaintiff was required by the Defendants to conduct tests on
alternate weekends and holidays.

9. 'l'he failure to PIlY tho Plaintiff for his work on
alternate weekends and holidays was a violation of the "Wage
Payment and Colleotion Law" 43 P,S. ~ 260.1 et. seq.
10. Pursuant to the aforementioned statute the plaintiff
makes claim against the Defendants for unpsid wagee for all days
worked within three (3) years prior to August 27, 1996.
Plaintiff makes claim for his regular hourly wage rate for eight
hours each day he waa required to conduct tests on his days off
and overtime at time and a half for all weeks in which his hours
exceeded forty(40).
COUNT II
11. The Plaintiff incorporates paragraphs one (1) thr.ough
ten (10) herein by reference.
12. Pursuant to 43 P.S.~260.10 the Plaintiff makes claim
against the Defendants for liquidated damages of tWenty~five
(25\) percent of the total amount of the wages due.

and Sewer Department. The Plalnllff was paid an hourly wage for B forty hour

otherwise paid by the Defendant for these required aotlvllles. The Plalnllff was
employed by the Defendant until May 15, 1996.
Plaintiff oommenced this acllon, for the oolleotlon of unpaid wages, by
praecipe for a writ of summons on August 27, 1996. Plaintiff flied a complaint
against Defendant on November 22, 1996. The complaint alleged that Defendant,
as Plalnllff's former employer, failed to compensate Plalnllff for overtime hours
worked between May 1969 and May 1996. Plaintiff sought relief under the
Pennsylvania Wage Payment Collection Law (43 P.S. seo. 260.1 et seq.) for
unpaid wagee, liquidated damages, and reasonable attorneys flles and oosts,
Plalnllff apparently concluded during dlsoovery that, as a former munlolpal
employee, he was barred from recovery under the Pennsylvania Wage Payment
and Colleollon Law. On April 21, 1997, Plaintiff flied a Molion To Amend the Initial
Complaint to eliminate his claim pursuant to the Pennsylvania Wage Payment and
Collection Law and to subslltute new claims for unpaid wages pursuant to the Fair

Labor Standards Act, 29 U, S,C,A, 6201 let seq. ("FLSA") and common law theories
for breach of contract, Leave to amend was granted pursuant to an order of court
by J. Wesley Oler, J, and Plaintiff flied his amended complaint on July 18,1997.
Cefendant fIIod a Motion for Partial Summary JUdgment on April 20, 1998
on the grounds that the Plaintiff's oommon law breach of contract claim Is pre-
empted by the FLSA, Plaintiff falls to establish Ii common law breach of contraot
claim, and Plaintiff falls to establish a willful violation of the FLSA.

Plaintiff's common law breach of contract claim Is barred as preempted by the
Fair Labor Standards Act, 29 U.S,C.A. sec, 201, et seq. Although the FLSA has
no express language asserting Its pre-emption of state law, courts have consistently
held that when an employer violates 29 U.S.C.A. seo. 206 or 207 that the statute
Is the exclusive remedy for the enforolng of rights oreated under the FLSA, flatt
~urrouQhs Corp., 424 F.Supp. 1329,1340 (E,C,Pa,1976); ~.sx
Corp. 763 F,Supp, 541 (N,D.Ala. 1991); ~ , 704 F.Supp. 95,
100 (D.S.C. 1988). The ~ court stated that "as a matter of law, plaintiff

In the present oase, Plaintiff has brought suit to olalm overtime oompensatlon
under state common law contraot theories In addition to the FLSA. Since the FLSA
Is the applloable law, and courts havQ Interpreted olalmfJ for wages and overtime
oompensatlon to be exoluslvely remedied by the FLSA, Plaintiff's argumont for
recovery under oommon law oontraot theories Is rejeoted. FLSA pro-empts
common law contrallttheory recovery and Is, consequently, the exclusive remedy
In the present case.
In Plalntlff's amended complaint, he asserts that pursuant to Plaintiff's
employment, the employer provided a written contraot. The dooument attached to
the amended oomplalnt, enlltled "Job Desorlptlon," Is not an employment contract,
but a job desorlptlon. The Plalnllff himself Idenllfles the document as a job
descrlpllon In his deposition. (Deposlllon of Wesley Woltz, February 11, 199B, p.
19), The document describes In detail what Is entailed In the Plaintiff's job and the
hours to be worked. There are no numbers on the job descrlpllon Indicating an
amount of wages to be paid or the period In time during which Plaintiff would be
employed. Plaintiff admits In his tesllmony that he was not told he would be

p. 19). For theBe reasons this job desorlptlon oannot be construed aa a contraot.
Even If the dooument could be viewed as a oontract, the claims for wages made
under common law contract theories are pre-ampted by the FLSA.

Plalnllff states that the amended complaint puts forth alternate theories of reoovery,
In the present case, the facts haVen't changed; the parties are sllll the same and
the alleged harm caused Plalnllff Is sllllthe same, The only thing that has changed
from the original complaint to the amended complaint was the law under which relief
Is sought. We view this change as a different means for obtaining the same relief
for the same harm oaused by the same party, Plalnllff's substitution of the FLSA for
the Pennsylvania Wage Payment and Colleollon Law Is an alternate theory of
reoovery and not a new cause of acllon,
Dlsllngulshlng between an alternate theory of recovery and a new cause of
acllon Is relevant In determining the date from which damages are calculated.
Beoause Plaintiff's substitution of the FLSA Is not considered a new cause of action
but an alternate theory of recovary, damages are computed from the date that
Plalnllff filed the original complaint. Since the FLSA provides for a Statute of
Llmltallon period of two years, Plaintiff may recover overtime wages from two years
prior to the November 22, 1996 filing of his complaint. Since the Plaintiff worked

Plalnllff during his employment for Instances when Plaintiff was called In on an
