AND NOW, comes the above-named Defcndant Daniel R. Ickes by and through his attorney J. Bart
DeLane. to file the following Answer and New Maller as follows:
I. Defendant does not have sutlicient inflmllation to atlirm or deny. Therefore it is denied.
2. Admitted.
3. Denied as more particularly detailed in New Maller Defcndant denies that Exhibit A attached
to Plaintifl's complaint constitutes a legal and enforceable agreement between the parties. Before Defendant
executed Exhibit A, Plaintifl'through its agents made material misrepresentations concerning Exhibit A.
PlaintilTs misrepresentations where knowingly falsc and fraudulent, Defendant did not know these
representations to be false Plaintill'induced Dcfendant to execute Exhibit A and Dcfendant justifiably relied
upon Plaintifl'misreprcsentations in doing ao
4. Dcnied. It is specifically dcnicd that Plaintills gratuitously agrccd to assist Dcfcndant in
securing a loan. Rat.her. as dctailcd marc spccifically in New Mallcr below, Defcndam was ncver adviscd of
the fact that Plaintifl' was going to attcmpt to secure a loan on Defcndants bchalf Defcndant never
consented having Plaintifl' take such actions Dcfendant was adviscd by Plaintills agcnt that thc proposal
(hereinafter the "Proposal") was being prepared to sce ifDefcndants could qualify for a loan Not to
actually obtain one It is fi,rther dcnied that Plaintitl'took any action to det.erminc whcthcr or not Dcfcndant
qualified lor such a loan.
5 It is specifically dcnicd that Plaintitl'Cllmmenced work in accordancc wilh Exhibit A attached

acceptance.

15, Under the terms of the oral agreement entered into by fllaintill'and Defendant Plaintiff
represented to Defendant the following
(a) All window frames as well as the windows were to be replace
with all new wood.
(b) All side shingles throughout the entire house were to be
removed and any worn or damaged under lying boards were to be replaced
before any siding was placed on the home
(c) All porch work was to be done using 0 split porch
construction.
16, The aforesaid representations were false and lraudulent Plaintill' made them knowing them to
be false, Defendant did not know these representations to be false
17. By these false and fraudulent representations Plainlill'induced Delendantto enter into an oral
agreement with Plaintill' Defendant juslif1ably relied upon Plaintifl's misrepresentation in doing so,
18, As a approximate result of Plaintill's false and fraudulent misrepresentations and Defendants
justitiable reliance uponlhem, Delendant believes and therefore avers that he has sull'ered damages In ~xcess
of $3,000,00. In damage to his home made by fllaintill's agent which amount serves to otl'set or diminish

AND NOW comes the Plaintiff, Pa, Building Products Corp" by
and through its attorneys, Friedman and Friedman, p,c" and
brings this Reply to New Matter averring as follows I
1, The allegations contained in paragraph 8 of the New
Matter are admitted,
2, The allegations contained in paragraph 9 of the New
Matter are sdmitted, However, ~laintiff's claim is being reduced
as more fully set forth herein,
3, The allegations contained in paragraph 10 of the New
Matter are denied as follows I
(a) It is denied that Plaintiff's agent advised Defendant
that the execution of the proposal did not represent a binding
agreement because the date of acceptance was not filled in,
Moreover, it is averred that the Defendant was fully aware he was
signing a legally binding document.
(b) It is denied that Plaintiff's agent made any
representations regarding the validity of the proposal,
Moreover, it is averred that Defendant authorized Plaintiff to
obtain a loan on his behalf,
4. Tile allegations oontained in. paragraph 11 of the New
Matter constitute $ conclusion of law and therefore no responsive
pleading is required,
5. Regarding the allegations contained in paragraph 12 of
the New Matter, it is denied that Plaintiff induced Defendant to
execute a proposal based on any false and fraudulent
representations, Moreover, it is averred that the contract was
entered into by the parties and constitutes a valid and binding
agreement, Moreover, Plaintiff demands strict proof of any
allegations of fraud or representation by itself or its agent,
6, The allegations contained in paragraph 13 of the New
Matter are admitted in part and denied in part. It is admitted
that Plaintiff and Defendant had further negotiations, It is
denied that Plaintiff offered to fulfill the contract for
$11,000,00, aad proof thereof is demanded at trial,
7, Regarding the allegations contained in paragraph 14 of
the New Matter, it is admitted that Plaintiff and Defendant did
eventually enter into an oral agreement for a total contract
price of $13,950,00, Moreover, it is averred that Defendant
advised plaintiff that he did ~ot wish to bind himself to the
initial agreement, and the parties agreed that the written
agreement would be modified so that less expensive windows would
be installed, resulting in a substantial savings to Defendant,
