COMPLAINT
AND NOW comes Plaintiffs ROBERT F. MYERS, JR., and DEANNA D.
MYERS/ Husband and Wife, by their attorney, Herschel Lock,
Esquire, and file their Complaint as follows, to witl
1. Plaintiffs Robert F. Myers, Jr., and Deanna D. Myers,
husband and wife, are adult individuals residing at 22 Pine Road,
Walnut Bottom, Cumberland County, Pennsylvania 17266.
2. Defendant Robert S. Griffiths is an adult individual
residing at 197 E. Gilmore Avenue, Trafford, Pennsylvania 15085.
3. Defendant Eastern Metal of Elmira, Inc. is a corporation
having as it's principal place of business 1430 Sullivan Street,
Elmira, New York 14901.
4. At all times relevant hereto, Defendant Robert S.
Griffiths was the agent, servant, workman or employee of Defendant
Eastern Metal of Elmira, Inc. and was then and there acting within
the scope of said relationship and authority and on behalf of
Pefendant Eastern Metal of Elmira, Ino.
5. On or sbout September 28/ 1994, at or about 8110 AM
Plaintiff Robert F. Myers, Jr. was lawfully operating his 1993
Chevrolet Cavalier automobile in northerly direotion along Route
11, South Middlesex Township, Cumberland County, Pennsylvania,
when he oame upon another vohJ.cle traveling in the same direction
along th~ same road and which was stopped to make a left hand
turn.
6. The Plaintiff Robert F. Myers, Jr. brought his vehicle
to a stop behind the vehicle waiting to turn.
7. At that time and place, Pefendant Griffiths was
operating Defendant Eastern Metal of Elmira, Inc.' s automobile in
the same direction along the same road as Plaintiff Robert F.
Myers, Jr. was travelling and behind Myers' vehicle.
8. At the aforesaid date, time and place, Defendant
Griffiths' vehiole oame to a sudden and violent collision with the
back of Plaintiffs' aforesaid vehicle.
COUNT I
ROBERT F. MYBRS, JR. V. ROBBRT S. GRIFFITHS
9. The averments of Paragraphs 1 through 8 hereof are
incorporated herein by reference thereto.
10. The aocident as aforesaid was caused solely by the
carelessness, recklessness and negligence of Defendant Griffiths
in that hel
a. failed to keep a vigilant look out, and
b. failed to see Plaintiffs' vehicle stoppen ahead of him
on the roadway, and
o. failed to operate his vehiole under full oontrol, and
d. failed to avoid striking Plaintiffs' vehiole, and
e. failed to bring his vehicle to a full stop within a safe
distance of the vehiole ahead of his in the roadway, and
f. failed to keep an assured olear distanoe between his
vehiole and Plaintiffs' vehicle; and
g. failed t,o operate his vehicle at a safe rate of spsed,
and
h. failed to operate his vehicle in accordanoe with the
laws of Commonwealth of Pennsylvania.
11. As a direct and proximato result of the carelessness,
recklessness and negligence of Defendant Griffiths, Plaintiff
Robert F. Myers, Jr. has suffered severe and sundry injuries
inoluding but not limited to, injuries to his back and neok as
well as bruises and other serious injuries suoh as contusions over
various parts of his body as well as past, present and future pain
and suffering.
12. As a direct and proximate result of the carelessness,
recklessness and negligence of Defendant Griffiths, Plaintiff
Robert F. Myers, Jr. is undergoing and will continue to undergo
pain and suffering, emotional distress, anguish and loss of
enjoyment of life's pleasures.
13. As a direct and proximate result of the carelessness,
recklessness and negligence of Defendant Griffiths, Plaintiff
Robert F. My~rs, Jr. has missed time from his employment and has
suffered past and future medical expenses.
WHEREFORE, Plaintiff Robert F. Myers, Jr. prays your
Honorable Court to enter judgment in his favor and against
Defendant Robert S. Griffiths in the amount in excess of the
amount for mandatory referral for arbitration.
COUNT II
ROBBRT F. MYBRS, JR. V. EASTERN METAL OF BLMlRA, INC.
14. The averments of Paragraphs 1 through 13 hereof are
incorporated herein by reference thereto.
15. At all times relevant hereto, Defendant Robert S.
Griffiths was the agent, servant, workman or ~mployee of Defendant
Eastern Metal of Elmira, Inc. and was then and there acting within
the scope of said relationship and authority and on behalf of
Defendant Eastern Metal of Elmira, Inc.
16. Pursuant to the doctrine of Respondeat Superior,
Defendant Eastern Metal of Elmira, Inc. is liable for the
carelessness, recklessness and negligence of Defendant Robert S.
Griffiths.
WHEREFORE, Plaintiff Robert F. Myers, Jr. prays your
Honorable Court to enter judgment in his favor and against
Defendant Eastern Metal of Elmira, Inc. in the amount in excess of
the amount of mandatory referral for arbitration.

22. The averments of Paragraphs 1 through 21 herein are
incorporated herein as if more fully set forth.
23. The averments of Paragraph 23 represent a conclusion of
law for which no responsive pleading is required.
24. To the extent the averments of Paragraph 24 represent
conclusion of law, no respons~ve pleading is required. To the
extent the averments of Paragraph 2~ represent factual assertions,
those averments are hereby dellied and, by way of further anBwer,
it is averred that the total cause of this accident was the
actions of Defendants.
25. The averments of Paragraph 25 represent a conclusion of
law for which no responsive pleading is required.
26. The avermen.ts of Paragraph 26 represent a conclusion of
law for which no responsive pleading is required.
27. The avermente of Paragraph 27 represent a conclusion of
law for which no responsive pleading is required.
28. The averments of Paragraph 28 are hereby denied and, by
way of further answer, it is averred that Defendant$ herein were
negligent by their actionR giving rise to this cause of. aation.
29. The averments of Paragraph 28 are hereby denied and, by
way of further answer, it is averred that the actions of
Defendants constitute negligence and were the cause factors in the
subject incident with the result which resulted in injuries and
loss to Plaintiffs,
30. The averments of Paragraph 30 are hereby denied and, by
way of further answer, it is averred that in no manner did
Plaintiffs cause the accident giving rise to this cause of action.
31. The averments of Paragraph 31 are hereby d~nied and, by
way of further answer, it is sverred that no other persons or
entity acted in a negligent fashion or ~n any other manner so as
to constitute intervening or superceding causes for the damages or
injuries herein claimed by Plaintiffs.
32. The averments of Paragraph 32 are hereby denied and, by
way of further answer, it is averred that the incidents injuries
and damages alleged herein were caused by the actions of
Defendants.
33. The averments of Paragraph 33 are hereby denied and, by
way of further answer, it is hereby averred that in no manner have
Plaintiffs failed to mitigate the damages caused them by
Defendants' actions.
34. The averments of Paragraph 34 are hereby denied and, by
way of further answer, it is averred that the injuries and damages
caused to Plaintiffs herein were not caused by persons or parties
other than Defendants.
