1. Your Plaintiff is Kenneth L. Myers, an adult individual
ourrently residing at 1885 Felker Road, Middletown, Dauphin
county, Pennsylvania,
2. Your Defendant is John Perky, an adult individual now
or formerly doing business as John's Birdhouse at 328 Pine Grove
Road, Gardners, cumberland county, Pennsylvania.
3. on or about July 7, 1992 your Plaintitf consigned a
Soarlet Macaw named "Penny" to the Defendant for a consignment
fee ot 25' of selling price for the period of three months to be
sold to the lowest offer acceptable. A copy of the consignment
agreement, is attached hereto, marked Exhibit "A" and made a part
hereof by reference thereto,
4. In the three years following the original oonBignment
on or about July 7, 1992 of the Scarlet Macaw, Detendant made no
oontaot with your Plaintiff exoept when your Plaintiff called
requesting information on the status.
5, After Borne period of time the Defendant requested it he
oould breed the bird and after selling one of the offspring pay
the Plaintiff which your Plaintiff agreed to, However, it has

6. The Plaintiff believes and therefore avers that the
50arlet Maoaw "Penny" which was Qonsignud to your Defendant i. no
longer in the possession of the Defendant based on
representations made by the Defendant that he has traded the
Soar let Macaw for another bird, which trade was without the
oonsent of your Plaintiff.
7. 5ince your. Defendant has admittedly disposed of the
~oarlet Macaw on consignment without the consent of your
Plaintiff your Plaintiff demands that he be compensated
acoordingly,
B, Your Plaintiff paid $2,000.00 for the bird ann about
$400,00 for the bird's cage which was given with the bird on
oonsignment,
9. Your Plaintiff believes the value of the Soarlet Macaw
and the wrought iron cage to be $2,500,00 based on an appraisal
estimate reoeived from the BlUe Dog Pet Shop, a copy of whioh is
attached hereto, marked Exhibit "B" and made a part hereof by
referenoe thereto.
10, Since your Defendant is no longer in the position to
follow through on the written arrangement of the parties since he
has in one way or another unloaded the Soarlet. Macaw of your
Plaintiff which he had for a consignment fee of 25% of the

The Plaintiff later agreed to permit the Scarlet Macaw to be traded for another bird for
breeding purpose. In order to lelllhe offspring, The Defendant Incurred all the expense. of the
care and feeding of the original Scarlet Macaw os well aSlhe bird traded for It.
