1. The Plaintiff is The Bank of New York, s~ Trustee under
the Pooling and Servicing Agreement and Assignee to The Money
Store Financial Company, Inc., doing business at 3301 "C" Street,
Suite 700W, Sacramento, CA 95816.
2. The Defendants are Duane r." Lebo and Martina L. Ll.!lbo,
husband and wife, adult individuals residing at 661 W. Old York
Road, Carlisle, Cumberland County, Pennsylvania and true owners of
the mortgaged premises.
3. The Plaintiff brings this action to foreclose on a
Mortgage by and between the Plaintiff and the Defendants datp.d
February 10, 1994, in the principal amount of Sixty-five Thousand
and 00/100 ($65,000.00) Dollarsl a copy of suid Mortgage is
attached hereto and made a part hereof marked as Exhibit "A", and
was recorded in the Off ice of the Recorder of Deeds in and for
Cumberland County in Mortgage Book 1196, Page 536,

oertain tract of land situate in Diokinson Township, cumberland
County, Pennsylvania, known all 661 W. Old York RQad, Carlillle, PA,
a hglll desoription is more fully delloribed in the attached
li:xhibil; "A".
6. Pursuant to the termll of said Mortgage, the Plaintil'f
advanced to the Defendants the aum of Sixty-five Thoulland and
00/100 (1)65,000,00) Dollins.
6. The Defundants defaulted under tho terms of said loan by
failing to make the monthly payment of $569.94 for the month of
November, 1995, and subsequent monthly installments.
7. 'rhe Plaint if f hall given to the Pef19ndllnts a writ ten
Notice of Intention to Foreclollc on said Mortgage as required by
law under the Act 6, dated March 26, 19961 a copy of said Notice
is attached hereto and made a part hereof marked all Exhibit "B".
