1. The Petitioner herein iB VIVEK WADHAWAN,
individual, residing at 10 MARSHALL DRIVE, 17 .11 CAMP
17011.
2. The Respondent iB the conunonwealth of Pennsylvania by al1d
through the Department of TranlJportation located at Third & Forster
Streets, Harrisburg, PA 17101.
3. On June 29, 1994, the Petitioner waD stopped for speeding
16 miles an hour above the speed limit and was issued oitation
number 0055151, whioh was filed wJ.th D.J. Charles Clement, a oopy
of which is listed as Exhibit A.
4. The Petitioner failed to pay timely the fine snd hie
license was suspended as of November 15,1994,
5. The Petitioner paid the fine in full on Deoember 16, 1994
to as evidenced by the receipt received from the District Justio'l,
Charles Clement and that same day a DL-38 was filed directing Penn
DOT to lift the suspension of Petitioner's license, because he had
paid the f.ine. See Exhibit B.
5. However, PENN Dot failed to lift hie license suspension as
required by 75 PS S15331 irhe suspension shall be for an
indefinite plilriod until such person shall respond and pay sny fines
and penalties imposed.1
6. Moreover, the Respondent created two violation.. out of the
single oitation on June 29, 1996, listing a non-existent violation
for June 10, 1996, indexed to the citation for the vio~tion on
an adult

9. 'I'he Petitionor, all lndlan notIonal, without adville of
counsel and without viewin'il hill Pann 00'1' racoroR, ploncled 'ilullty
to the citntIon issued by Darry Township Pollee on July 15, 1996,
11. After obtaining his Penn 00'1' recordll, raali1.lng the
mistake the re6pondent made, and upon advice of counsel, the
Petitioner appealed the guilty plea to the Court of Common Pleas,
where no hearing date has yet bean set, See 8xhibit D,
12. On or about Auqust 13, 1996, the lI11spondent, actIng on
its at III uncorrected and erroneous records, suspended the
Petitioner's lIcense for the reasons Ret forth in Exhibit E.
13. The underlying is/luE! in thia la that through no fault of
hili own, the Petitioner's license continues to remail1 lIu8pendod for
no reason.
