Subsequently, Plaintiff, Paul H. Haut, Jr" Informed the Defendants that he
was the owner of the mobile home. (P,Q, 1,) Haut acknowledged that Zook had
agreed to purchase the home from Haut via an Installment sales contract. (P.Q,
7.) However, Haut told the Defendants that Zook defAulted on the agreement and
therefore Haut was stili the owner of the mobile home, (P,Q, 2,) On or about
October 3, 1995, the Defendants supposedly came to an oral agreement with Haut
In which they would pay Haut $100/week In order to continue to reside In the
mobile home, (Complaint 1,) The Ramoses lived In the home for a total of 35
weeks and moved out of the home In May 1996, (Complaint 2,) From October 1,
1995 to May 26, 1996, tho Defendants paid Haut a total of $1700, During this
time, Defendants claim that they tried to resolve the ownership dispute, but
eventually concluded that a resolution was not likely and stopped making any
payments to Haut. (Defendants' P,O, Brief 2,) Plaintiff has now brought suit In
order to collect $1 BOO which he claims the Ramoses stili owe him based on their
oral agreement. (Complaint 2,) The Defendants have flied preliminary objections
claiming that Plaintiff's failure to loin Zook Is a defect In the pleadings,

on or abolJt Ootober 3, 1995, Defendants orally agreed to pay
Plaintiff $100 per week to reside in the mobile home.
