The Deed to plaintiff'S property indicates that a 16
foot wide alley ("Alley") is adjac)Gllt to the western boundary of

The Alley is used by plaintiffs and
Defendants, their respective tenants, and said tenants' invitees.
Much of the traffic over the Alley is f~om trucks which provide
supplies to the retail and commercial tenants on the Defendants'
property, as well as traf.fic from customers, and invitees of the
retail and commercial establishments located on the Defendants'
property.
The use of thE! Alley by Plaintiff and Plaintiff' s
tenants and their respective invitees is limited to automobile
traffic normallY associated with eight single family residential
mobile homes. The driveway located within the Alley is currentlY
in serious disrepair,
When trucks which service Defendants'
property go over the driveway in the Alley, they continue to cause
significant damage to the driveway, Based upon the frequency of
use and the type of vehicles which use the Alley, Defendants,
,
DeI!endants tenant. and laid tenanh' supplien, customer. and
invite.. u.. the Alley in a manner whioh con.titute. 90% of the
wear and tear on the driveway looated on the Alley. There i8 no
wt'1ttell maintenllnoe aqullment between or among the landowner. whioh
adjoin the Alley. sinoe Defendant. rIloeive 90% of the benefit from
the Alley, Defendants are r8l5lponsible for 90% of the oo.t of
maintenanoe of the Alley.

Plaintiff has obtained an estimate for the repair of
the driveway in the amount of $12,744.00. Defendants' use of the
dr.iveway has rssulted in at least 90% of the wear and tear on the
driveway and therefore Defendant should be rosponsible for
$11,469.60 of the cost of repair. In addition, going forward,
Defendants and plllintiff should share responsibility for the
oontinued maintenance of the driveway, with Defendants being
responsible for 90% of the cost and Plaintiff being responsible for
10%. Such obligation should be binding on future owners of the
respective properties of P:~intiff and Defendants.

1. The Plaintiff, Francis X. Doyle, i, an individual
residing at 4004 Ash street, Harrisburg, Pennsylvania 17109.
2. The Defendant, Gary L. Quesenberry, is an individual
and was last known to reside at 98 Peach alen Road, aardners, PA
17324.
3. The Defendant, I. Willialll Quesenberry, is an
individual and was last known to reside at .~6 Peach Glen Road,
Gardners, PA 17324.
4. The Defendant, Michael H. Quesenberry, is a deoeased
individual and the executor of the estate is Helen L. Lott who was
last known to reside at 42 Fairfield street, Carlisle, PA 17013.
5. The Plaintiff owns certain property looated on Mill
street in the Borough of Mt. Holly Springs, Cumberland County,
Pennsylvania (UPlaintiff's Property"), whioh property is more
pntioularly d..cribed on Exhibit "A" attached hereto.
IS. The Defendantll own certain property which i. adjacent
to the northern boundary cf Plaintiff'. property in the Borough of
Ht. Holly springs, cumberland county, Pennsylvania (IIDetendants'
Property"), which property is more particularly described on
Exhibit liB" attached hereto.
7, The Deed to plaintiff'. property indicate. that a 16
foot wide alley ("Alley") is adjacent to the western boundary of
Plaintiff's Property.
8. Donald E. alike and ROlle Marie slike ("slike") own
certain property located on the corner of Mill street and Baltimore
Avenue in the Borough of Mt. Holly springs, cumberland county,
PlIInnsylvania ("Slike property") , which property is more
particularly described on Exhibit liCit attached hereto.
9. The Deed to the Slike Property indicl\tes that the
Alley is adjacent to the eastern boundary of the alike property.
10. Benjamin D. Rosario and Margie A. Rosario
(IIRosariolt) own cllrtain property located on Baltimore Avenue in the
Borough of Mt. Holly springs, Cumberland county, Pennsylvania
("Rosario Propertylt), which property is more particularly desoribed
on Exhibit ItDIt attached hereto.

11. The Deed to the Rosario Property indioate. that the
Alley i. adjaoent to the southern boundary or the Rosario Property.
u. Plaintiff's property oontains a mobile home park
with ei9ht oocupied units.
13. Defendants' Property oontains a retail and
oommeroial site with an italian restaurant and piua shop, an
attorney's off ice, an accountant's off ice, a hardware stcre, a
video rental store, a donut shop, and a beveraqe distributorship.
14. The Alley is used by Plaintiffs and Defendants,
their respective tenants, and said tenants' invit~es.
15. The Alley is not used by Slike, Rosario, or their
respeotive tenants, or said tenants' invitees.
l6. sinoe the Alley is not used by Slike or Rosario, and
they derive no material benefit from the Alley, Slike and Rosario
are not parties to this action.
17. Muoh of the traffic over the Alley is from truoks
which provide supplies to the retail and commeroial tenants on the
Defendants' Property, as well as traffic from customers, and
invitees of the retail and oommeroial establishments looated on the
Defendants' Property.

18. The un at the Alley by plaintiff and plaintiff'a
tenant. and their respeotive invitees is limited to automobl.le
tr~ffic normally assooiated with eiqht sinqle family re.idential
mobile homes.
19. The driveway located within the Alley is ourrently
in serious disrepair.
20. As part of Defendant.' development of Defendants'
property, a water line was installed under the driveway.
21. After the installation of the water line, the
driveway was not properly repaired.
22. The inadequate repair of the driveway after the
water line installat ion is the primary reason for the current
oondition of the driveway.
23. When trucks which servioe Defendants' property go
over the driveway in the Alley, they continue to cause siqnificant
damage to the driveway.
24. Based upon the frequency of use and the type of
vehicles which use the Alley, Defendants, Defendants tenants and
said tenants' suppliers, oustomers and invitees use the Alley in a
manner which constitutes 90\ of the wear and tear on the driveway

31. The driveway located within the ^lley i. currently
in ..riou. diuepair and the oost of filling said driveway i.
$12/744,00. An estimate i. attaohed hereto as rellhibit >>E>>.
32. The repair of the driveway within the Alley in the
manner .et forth in the estimate ie necessary beoause any 10..
substantial repair will result in the driveway once again falling
into disrepair in an unreasonably short period of time.
33. The driveway within the Alley is ourrently in an
unsafe condition and oonstitutes 0 hazard to Plaintiffe and
Defendants, their respeotive tenants, and said tenants' invitees.
34. Plaintiff has no adequate remedy at law.
WHIRB'ORI, Plaintiff, based on the foregoing,
reopeotfully requests that your Honorable Court grant the following
reliefl
a) determine that the alley is property adjoining the
real property of Plaintiff and Defendants,
b) determine that the alley is a private right of way,
whioh is a form of an easement,
0) determine that Defendants are the dominant tenements
of the aforesaid easement,
d) determine that Plaintiff is the servient tenement of
the aforesaid easement,

e) determine that Defendant. use the alley in a manner
which oonstitutes 90% or tho wear and tear en the driveway located
on the alley,
f) determine that Plaintiff uses the alley in a manner
which oonstitutes 10% of the wear and tear on the driveway lccated
on the alley,
g) compel Defendants to enter into a written agreement
with Plaintiff, to be recorded with the cumberland county Reoorder
of Deeds, t~ apportion the respeQtiVe costs of maintenanco of the
aforesaid easement at 90% for Dofendants and 10% r.or Plaintiff,
h) determine that repairs to the aforesaid easement in
the amount of $12,744.00 are necessary and urgellt,
i) determine that the amount of $12,744 for repairs
shOUld be borne between Defendants and Plaintiff with Defendants
being responsible for 90% of the amount and Plaintiff for 10% of

j) grant suoh other relief as may be just and equitable
under the circumstances.

A pretrial oonf.erence was held in the
abovewoaptioned equity oase on Thursday, June 12, 1997, in the
ohambers of Judge Oler. Present on behalf of the Plaintitf was
craig I. Adler, Esquire. Present on behalf of all of the
Defendants was William P. Douglas, Esquire.
This is an equity oase in Which the primary issue
is allocation of tho oosts between the parties for repair of a
certain alley between tho parties' properties in the Borough of
Mount Holly, Cumberland county, Pennsylvania.
Counsel are in the process of determining whether
they oan stipulate that both parties share responsibility for
maintenance of the alley, and that the only issue to be
determined by the Court is the oost of the repairs at this time
and the allo~ation of that cost between the parties. Counsel
are also in the process of determining whether a related action
at No. 94-2983 CIVIL TERM, filed at law, can be resolved
pursuant to an agreement. That action apparently relates to
ownership of the alley in question and has been pretried by the

In Franois X. Doyle1s (~Doyle~) Complaint in Equity
under Cumberland county Case No. 96 - 4892 (~Equity complaintll), he
requested that the court, among other things, oompel the parties to
enter into a written agreement, to pe recorded with the cumberland
county Recorder of Deeds, to apportion the respective oosts of
maintenance of the alley (~Alley~) whioh is the subject of the
Equity complaint.

The Court I S ordCilr appears to determine that
responsibility for the maintenance of the Alley is to be divided
equally between the parties with each party contril:Juting $1,900.00
to the construction.

obligations ot the parties.
6. The court has tho power in Equity to grant the relief
requested.
7. The court in paragraph 2 of his order has indioated
that neither owner shall blook off the Alley or use, or permit to
be used, the Alley for parking.
B. This portion of the order oan be interpreted as
prOhibiting any parking in the Alley, whether such parking blooks
aooe/ils or not.
9. Doyle, his tenants and his predecessors in title to
Doyle'S property have parked upon a portion of the Alley adjacent
to Doyle'S property continuously for s period in eXcess of 25
years.

3. Mr. Quesenberry is the owner of Ii tract of land in the

northeast corner of the interseotion of North Baltimore Avenue
(Pennsylvania State Route 34) and East Lauman Street.
4. The Quesenberry property is the site of variollS
busines~eB, inclUding a doughnut shop, a beer distributorship, A
hardware store, an optometrist's office, A care and a video shop.
S. Mr. Doyle is the owner of A smaller tn.ct of land which
abuts part of the Quesenberry tract on the south, thoa Doyle
property is bounded on its south by Mill Street.
6. The Doyle property is the site of eight mobile homes.
7. A private alley runs along the western border of the Doyle
tract.
8. The alley is 16 feet wide &nd 150 feet long, And runs
north from Mill Street to the southern boundary of the Queeoanberry
tract.

12. At one point in the paut, Hr. Doyle blocked the alley at
it. point of connection with the Quesenbel:ry property.
13. The traffic into and out of th, Qu.uenberry property
cauues more damage to the alley than does the traffic associated
wi th the Doyle property I on the other hand, the alley is more
useful to the Ooyle property than to the Quesenberry property.
14 . Apparently, the alley is not of use to any other
properties.
15. The alley has fallen into serious disrepair.
16. An expenditure of $3,800.00 will be necessary to reutore
the alley to serviceable condit.ion, although Hr, Doyle would prefer
a more substantial (and more costly) form of repair.
17. Given the use of, and benefits fl:om, the common easemqnt
for ingrlllBB and egreau, it is equitable that eaoh property owner at

In some calles, the mOllt reasonable approach ill to impose upon
Pre-trial Brief of
an abutting landowner responsibility tor maintenance of the portion
of the easement which runs along his or her property. See, e,g.,
Oswald v. Hausman, 370 Pa, Super. 245, 548 A.2d 594 (1988)1 Borgel
v. Hoffman, 219 Pa, Super. 260, 280 A.2d 608 (1971).
In other cues, it is appropriate to oonsider the relative use
of the easement, both in terms of the benefits reoeived from and
the burdens imposed upon the physical easement.

Under either rule, an equal share of the expenses of repair

alley - the Que~enberry property lying along it. entire width, and
the Doyle pl:oporty lying along it~ entire lengthl both properties
utilize the entire length ~nd breadth of the alley.
In te~n~ of burden and benefit. the alley is more dam~ged by
its servioe of the Queeenbel:ry property, but is more neoeseary to
the ue. of the Doyle property. The foregoing analysis presuppoees,
of course, that the alley will not be blocked off or used for
purposes inconsistent with vehicular ingress and egress.
CONCLUSIONS OF LAW
1. The Court has jurisdiction of the subject matter of this
litigation and of the aforesaid parties.
2. The properties owned by the parties share a common
easement in the form of an abutting alley, and each owner is liable
for an equal share of the reasonable oost of maintaining it.
3. The decree issued hel:eafter properly adjudicates the
dispute between the parties in terms of their responsibilities at
this time in connection with use and maintenanoe of the easement.

In Francis X, Doyle's ("Doyle") Complaint in Equity
under Cumberland county Case No. 96 - 4892 ("Equity Complaintll), he
requested that the court, among other things, compel the parties to
enter into a written agreement, to be recorded with the cumberland
county Recorder of Deeds, to apportion the respective costs of
maintenance of the alley (IIAlloyll) which is the subject of the
Equity Complaint.

The Court I s order appears to determine that
responsibility for the maintenance of the Alley is to be divided
equally between the parties with each party contributing $1,900.00
to the oonstruction.
:I. The court t II I'rder doe II not appear to create an ongoinq
maint.nanoe obligation or apportion responsibility fo~ Buoh
maintenanoe beyond the initial repairB specifically desoribed in
the order.
4. The Alley will require ongoing maintenance by Doyle and
Quesenberry and their respeotive sucoessor owners of the propertieB
adjoining the Alley.
6. Doyle, in the Equity Complaint requested that suoh a
determination be made and such a determination is necessary in
order to avoid futur.e litiqation over the onqoing mainbananoe
obligations of the parties.
6. The court has the power in Equity to grant the relief
requested.
7. The Court in paragraph 2 of his order has indicated
that neither owner. shall block off the Alley or use, or permit to
be use~, the Alley for parking.

of the Petition for Finding of contempt and for Enforcement of No
parking Ban in Alleyway filed on behalf of Gary L. Qu~senberry, and
following a heat'ing held on December 15, 1998, it is ordered and
directed as followSI
1. E'rancis X. Doyle shall, within 20 days of the date of
this order, reimburse Gary L. Quesenberry in the amount of
$1510.00 for repair of the alley sub judice, which represents
the expenditure Mr. Doyle would have been responsible for had
his contractor performed the work ($1660.00), less the sum
which he paid the said contractor ($150.00)1 and
2. Francis X. Doyle shall, within 20 days of the
date of this order, again notify his tenants in writing that
