HA'UUBBUftO, PA 17100 4, Admitted, exoept that Mr, Lant~'s firs~ name is "Delano" , 5, Admitted in part and d~nied in part, 'fhe variance request related to the location of the driveway and the garage with respeot to the set back along the northorn line of the property, No variance was required to construct the garage or the driveway, a highway occupancy permit and a building PQrmit having previou/lly been granted, Intervenora requeated a de minimia variance to allow the construction of the garage within five feet of the northern property line to eliminatQ unnecessary hardship under th~ circumstances and to permit the construction in a location that was better for everyone in th~ area, Intervenors an the ownera of the adjoining lot immediately north of the property at 603 West Old York Road and the only property in any way affected by the grant of the variance with reapect to the setback at isaue, The variance allowed the garage to be moved within five feet of the northern line. The aetback otherwiae was 10 feet, 6, Admitted that a hearing waa held and that Mr, Wertime was preaent and asked questions. The Zoning Hearing Board did not in any way racogni~e Mr. Wartime as a party aggrieved. 7. Admitted, 8,' Admil:l:lId, 9. Denied, Thll varianoe rllquII8ted was a de minimis variance, The Zoning Hearing Board in the Findings of ~act stated that it was a "minimal varianoe>>, Paragraph B of Findings of Fact. The evidence presented was sufficient to support the grsnt of the variance. Although the property could be used without the variance, under all of the circumstances, and in view of the minimal nature of the variance, the hardship that would result from the failure to grant the variance would be unnecessary hardship, The unnecessary hardship was a result of the unique physical circumstances of t.he lot as was demonstrated on the record, The variance that was granted is a minimal variance and the least possible modification to remove the unnecessary hardship, The variance does not permanent ly impair the appropriate use or development of any adjacent property, The only adjacent property that potentially is affected in any way is the property immediately to the north which is owned by Intervenors who requested the variance, Intervenors believe that the grant of the variance does not in any way adversely affect the adjoining property owned by Intervenors. Maw Nal:l:u 9, Appellant, David c, Wartime. lacks standing to appeal the Zoning Hearing Board decision granting the varianoe, 10, Mr. Wertime does not own any prope~ty in the vioinity of 603 West old York Road and is not in anyway way adversely affected by the grant of the variance for the property looated at 603 West Old York Road. The property owned by Mr. Wertime at 2043 Walnut Bottom Road is nowhere near or in any way affected by the grant of the variance, 11. Mr, Wertime's general interest in policing the action of the Zoning Hearing Board or other agencies in Pickinson Township is insufficient to provide him with standing in this matter. 12.
