AND NOW comes Ihe Plalnllff, Daniel C. stephens and makes the following
complaint::
,. The Plaintiff, Daniel D. stephens received a telephone call from the
Defendant George L. Vazquez requesting him to provide an estimate for the
demolition and removal or a garage, and to dig out the foundation per the
Defendants Instrucllons for an addition to said house, located at '805 Bridge 5t.
New Cumberland, Pa.
2. TIle Plaintiff quoted the Defendallt a price of $500.00 for the removal
of the garage. The Defendant was told that the digging of the foundation would
be on a lime and material basis. The Plaintiff quoted $45.00 per hour for the
dump truck and $50.00 per hour ror the backhoe. At that lime, the Defendant
Instructed the Plaintiff to proceed with the wor\< with the agreement that the
Plaintiff would be paid Immediately upon completion of said wor\<.

2. On December 11, 1996, the Plalnllff proceed With Ihe wol1< and
removed the gar.ge and hauled the debris away anrj dl.posed of II. The Plaintiff
then proceed to hand dig along Ihe buemenl wall, cut block 01 footer where the
garage fooler mellhe cellar wall and dug thll foundallrm and hauled Ihe dirt away,
On Oecember 12, 1996 Plalnllff conllnued to excavate and haul away materials
from foundation On December 13, 1906, project was completed to the
sallsfacllon of the Defendant George Vazquell.
Upon complellon of the work all requested, the Plaintiff requesled paymenl before
leaving Ihe Job, The Defendant, George L. Vllzquez handed Ihe Plalnllff his
business card and told Ihe Plalnllff 1,0 bill him. Wllenthll Plalnllff prepared the
Invoice for payment he discovered that tile Defendant did not Ilave his address on
his business card, The Plaintiff had to called the Defend"nt to getllle address,
The Invoice was submitted to the Defendanl for payment. Upon receipt of uld
Invoice the Defendant did nol dispute the amounl of the bill. After several months
and various telephone calls, and gelling excuses from nol receMng paymenl from
Ih" home owner, health problems, bible studies Ihe Defendant nnally paid
$1,000.00. After the $1,000.00 was paid and stlitements were sent out and clllIs
were made requesting payment the Defendant then disputed the bill.
WEREFORE, the Plalnllff respectfully requests this Honorable Court to award
to strike this appeal and award to the Plalnllff the amount of $1,342,88 plus
Interest
