1) Pl,aintirf charles Adam Leas is an adult individual who
ourrently I.'esides at Messiah Vlllage, 100 Mt. Allen Orive,
Mllchaniosburg, PA, but whose principal plaoe of residenoe is 501
Rickey Road, Mechanicsburg, cumberland county, Pennayl vania 17055.
2) Plaintiff 'rhelma Diane Hurley is the peraon appointed by
plaintiff Charles Adam Leas as hill Power of Attorney pursuant to a
duly executed Power of Attorney dated July 25, 1996. A copy of
that power of Attorney is attached hereto and marked Plaintiffs'
Exhibit "A" and is incorporated hereln as If set forth at length.
Thelma Diane Hur ley resldes at 1532 Sheepford Road, Mechanicsburg,
cumberland county, pennsylvania, 17055.
3) Defendant Dauphin Depoait Bank and Truat company is a
oorporation or similar entity organlzed and existing under the laws
of Pennsylvania that regularly conducts businesa in cumberland
county, with it./ principal, plaoe of budnBu located at au Market
Street, Harrisburg, Dauphin county, PennBylvania,
4) plaintiff Char lea Adam Leaa ia 83 years old "nd in the
reoent paat hall ellperienced phyalcal health problema whleh resultud
in his hoapitallzatlon at Holy Spirit Hospital, camp Hill,
Pennsylvania where he underwent Burgery.
5) Prior to this hospltaliution, on or about March 1, 1995,
plaintiff Charles Adam Leas had ellecuted a Power of Attorney in
whioh he named defendant Dauphin Deposit Bank and 'rrust company as
his attorney-in-fact.
6) Whlle plaintiff Char lea Adam Leas was hospitalized in
1996 Dauphin Deposlt Bank and Trust company took control over the
assets of plaintiff Charles Adam Leas which were at that tl,me
deposited with Harris Savings Bank.
7) As plaintlff Char.les Adam Leas continued to recover from
his hospitalization and continued to regain c'ontrol over all of his
faculties, mental and physical, he began to ellperienee dlfficulties
having Dauphin Deposit Bank and Trust company take care of his
immediate needs.
8) Plaintiff Charles Adam Leas alao was denied acoess and
control over his assets to such an Illltent that he became frustratlld
and angered by the actions of defendant Dauphin Deposlt Bank and
TrUst company which effectiVely deprived him of control over his
own affairs.
9) on July 25, 1996, plaintiff Charles Adam Leas ellecuted a
new Power of Attorney, Plalntiffs' ElIhibit "A", in which he
appointed hi. personal triend Thelma Diane Hurlev as his mttorney-
in-ta~t, and in so doing he explioitly revoked the previoua Power
of Attorney whioh had been given to the detendant Pauphin PepQ,it
Bank and Truat company.
10) Pauphin peposit Bmnk and Trust company retuses to
aoknowledge the Power ot Attorney executed by plaintift charl.s
Adam Leas on July 25, 1996 and has clalmed that plalntitt Charles
Adam Leas was not mentally oapable of appointing Thelma Piane
Hurley as hia attorney-in-taot.
11) Plaintiff Charles Adam Leaa was seen and evaluated by his
personal phyaioian, John M. Sullivan, M.P., on August 22, 1996.
12) John M. SUllivan, M.D., has st~ted that in his opinion
Char lea Adam Leas is tully competent to make a decision aa to the
appointment of a Power at Attorney to aot on hia behalf., and that
in his presence, Chal:les Adam Leas ratitied his appointment of July
25, 1996, of. plaintiff Thelma Plane Hurley as his attorney-in-fact.
A oopy of Dr. Sullivan's letter ia attached hereto and marked
Plaintiffs' Exhibit "B".
13) Charles Adam Leas is 83 years old and ourrently
experienoes physical health problema which may in the immediate
future result in hia becoming inoapacitated.
14) The entry of a Deolaratory Judgment or Decree in this
case will aerve to terminate the uncertainty or controversy as to
which party is the lawful attc,rney-ln-fact for the plaintiff
Charles Adam Leas.
15) Due to the continued dep~ivation of control over hi. own
afrain plus the d..iu and r1r;Jht of pllintitt Chuba Adam Leu to
have contl:ol over his own affairs whioh mav likeLy be terminated in
the event of inoapacity there is no speolal form of remedy provided
by statute for this type of caee.
WHEREFORE, plaintitts Charles Adam Leas and Thelma Oiane
Hurley respeotfully request that the court enter a judgmCllnt or
decree which provides I
a) That the Power of Attorney executed by charles Adam Leas
on July 26, 1996 and ratified by plalntitf Charles Adam Leas on
August 22, 1996 be determined tc be a valid Power of Attorney which
effectively re'/okes all prior Powers of Attorney previously
executed by the plaintiff charles Adam Leasl
b) That Thelma Diane Hurley be r.ecognlzed as the attorney-
in-faot as so appointed by plaintift charles Adam Leas on July 25,
19961
Q) That defendant Dauphin Deposit Bank and Trust company be
directed to turn over control of all property in its possession
belonging to plaintiff charles Adam Leasl
d) 'rhat Dauphin Deposit Bank and Trust company prepare an
aocounting of its the property of plalnti tt Charles Main Loas Which
has been in its possession I
e) That any attorney's fees incurred by Defendant Dauphin
Deposit Bank and Trust company as a result of this litigation be
paid from funds of Dauphin Deposit Bank and Trust company and not

cumberland county, Pennsylvania, 17055.
2) Petitioner 'l'helma Piane Hurley is an adult individual who
ourrently resides at 1532 Sheepford Road, Mechaniosburg, cumberland
County, Pennsylvania 17055.
3) Respondent herein is Dauphin Depooit Bank and Trust
company whioh is a oorporation or similar entity which regularly
oonduots business in cumberland county, Pennsylvania, with its'
principal plaoe of business being 213 Market street, Harrisburq,
Dauphin county, Pennsylvania.
4) Petitioners initiated this aotion by the f ilin9 of an

1) plaintiff Charles Adam Leas is an adult individual who
currently resides at Messiah village, 100 Mt. Allen Drive,
Meohanicsburg, PA, but whose principal place of residenoe is 501
~ickey Road, Mechanicsburg, cumberland county, Pennsylvania 17056. '
~) plalntiff Thelma Diane Hurley is the person appointed by
plaintiff Charles Adam Leas as his power of Attorney pursuant to a
duly executed power of Attorney dated July 25, 1996. A copy of
that power of Attorney ls atteched hereto and marked PlaintiffS'
Exhibit >>A>> and is incorporated hereln as if set forth at length.
Thelma Diane Hurley resides at 153~ Sheepford Road, Mechani,csburg,
Cumberland county, Pennsylvania, 17055.
3) Defendant Dauphin Dnposit Bank Ilnd Trust company is a
corporation or sim1lar entity organized and existing under the laws
of Pennsylvania that regularly conducts business in cumberland
county, with lts' prinoipal plaoe of business looated at 213 Market
street, Harrisburg, Dauphin county, Pennsylvania.
4) Plaintiff Charles Adam Leas is 83 years old and in thB
reoent past has experienoed physloal health problems whioh resl,llted
in his hospitalizatlon at Holy spirit lIospital, camp lIill,
Pennsylvania where he underwent surgery.
6) Prior to this liospltalhation, on or about Maroh 1, 1995,
plaintiff Charles Adam Leas had executed a power of Attorney in
whioh he named defendant Dauphin Deposit Bank and Trust company as
his attorney~in-fact.
6) Whlle plaintiff Charles Adam Leas was hospitalized in
1996 Dauphin Deposit Bank and Trust company took control over the
assets of plaintiff charles Adsm Leas which were at that time
deposited wlth lIarris savings Bank.
7) As plaintiff charles Adam Leas continued to recover from
his hospitalization and continued to regain control over all of his'
faCUlties, mental and physical, he began to exp~rience difflcultles
havlng Dauphin Deposit llanlt and Trust company take care of his
immediate needs.
S) Pleintiff charles Adam Leas also was denied access and
control over his assets to such an extent that he became frustrated
and angered by the actions of defendant Dauphin Deposit Bank and
Trust company which effectively deprived him of control ovor his
own affairs.
9) On July 25, 1996, plaintiff Charles Adam Leas executed a
new Power of Attorney, plaintlffs' Exhibit "A", in which he
appointed hi. pergonal friend TheLma Diane >>urley ag hi. attorney-
in-fact, end in 10 doing he expllcitlY revoked the previoug powe~
or Attorney which had been given to the defendant Dauphin Oepogit
Bank and Trult company.
lO) Dauphin Deposit Bank ond Trust company refuses to
acknowledge the power of Attorney executed by plaintiff charLes
Adam Leas on July 25, 1996 and has claimed that plaintirt charles
Adam Leas WIIB not mentally capable of appointing 'l'helmll 01llne
>>urley as his ottorney-in-fact.
11) plaintiff Charles Adam Leas was slten and evaluated by his
personal physician, John M. SUlllvan, M.D., on August 22, 1996.
12) John M. SUlliven, M.D" has stated that in his opinion
charles Adam Leas is fully competent to make a decision as to the
appointment of a Pow~r of Attorney to act on his behalf, and that
in his presence, charles /\dam Leas ratified hls appointment of July
25, 1996, of plaintiff Thelma Olane Hurley as his attorney-in-fact.
A copy of Or. sullivan'S letter is attached hereto and marked
plaintiffs' Exhibit "6".
13) Charles Adam Leas is 83 years old and currently
experiences physical health problems which may in the immediate
future result in his becoming incapacitated.
14) The entry of a Declaratory Judgment or Decree in this
case will serve to terminate the uncertainty or controversy as to
which party is the lawfUl attorney-in-fact for the plaintiff
charles Adam Leas.

Answer and New Matter to Plaintiffs' Petition for Rule to Show
Cause,

2. Admitted for purposes of responding to the within
Petition, but proof thereof is demanded at the hearing thereon.

4. Admitted. By way of further answer, Exhibit "A", being
a writing, speaks for itself and requir.es no answer.
5. Denied as a conclusion of law. By way of further
answer, Oefendant's New Matter is incorporated herein by
reference.

Matter and incorporated herein by reference.

WHBREFORE, Defendant requests your Honorable Court to
determine the competency of Petitioner, Charles Adam Leas, and'
his capacity to revoke the Power of Attorney given to Oefendant
and dated Maruh 1, 1~~5, and to award Defendant its costs and
attorney's fees for defending and participating in this
~roc~eding and the Aotion for Peclaratory Judgment filed by
Petitioners in the above captioned matter.
NEW MATTER
10. Defendant incorporates herein by reference its answars
to Paragraphs 1 thr.ough ~.
11. By Power of Attorney duted March 1, 1995, Petitioner,
Charles I\dam Leas, hereinafter referred to as "Leas", appointed
Defendant his attorney-in- fact. Said Power was recorded May 13,
19~6, in the Office of the Recorder of Deeds in and for
Cumberland County, Pennsylvania, in Misc. Book 519, Page 1140,
and a copy of which Power is attached hereto all Exhibit "D-l".
12. Said P.ower provides, 'merolla, that" [iln the event
of my incompetency, from whatever cause, this rower of attorney
shall not th~reby be revoked but shall thereupon become
irrevocable, . . ."
13. On or about April 19, 1996, Kathy Wolfer, a social
worker at Holy Spirit Hospital where Leas was hospitalized and
had undergone surgery, contacted Defendant and suggested that
such I?ower needed to be activated.
14. As a result, Defendant contacted Lisa K. Torp, M.P.,
Leas' surgeon, who advised Defendant by letter dated April 23,
1996, a copy of which is attached hereto as Exhibit "D-2", that
Leas "is not mentally capable of making financial decisions[.!"
15. Following Petitioners' presenting Defendant with a later
Power of Attorney (Exhibit "1\" to I?laintiffs' Complaint in the
above captioned action), Richard W. Stewart, Esq., on behalf of
Defendant, wrote Kenneth B. Conner, M.D., Leas' treating
physician, requesting his opinion about Leas' capacity, to which
request Dr. Conner responded by letter dated August 9, 1996,
copies of both letters being attached hereto as Exhibits "D-3"
and P-4", respectively.

breach of its fiduoiary duty to Less,
18. To the e~tent that the within Petition requests the
Court to determine Leao' capacity, Pefendant joins in Buch
request and will cooperate fully and promptly as the Court may
direct,
19. Section 711(12) of the probate, Estates and Fiduolaries
Code (the "PEF Code") mandates that jurisdiction of this court
shall be ~xercised through its Orphans' Court Pivision where the
removal and discharge of a fiduciary is at issue.
WHSREFORE, Defendant requeots your Honorable court to
transfer the above captioned action at Petitioners' c~st to
the orphsns' Court Pivision of this Court pursuant to
Pa.R.C.P, No, 213(f), as well as the r.equeots more fully set

The Petition of Dauphin Deposit Bank and Trust Company, by
its attornoys, Fowler, Addams & Rundle, respectfully represents

On October 7, 1996 I at the request of R. Mark Thomas, Esq.,
counsel for Plaintiffs, the hearing in the above matter set for
October 4, 1996, was continued generally by Order of the
Honorable Kevin A. Hess,

The purpose of the October 4, 1996 hearing was for the Court
to determine which of two Powers of Attorney given by Plaintiff
Leas to different attorneys-in-fact are valid and in force and
whether Plaintiff Leas had the requisite mental capacity to
revoke or ratify eit.her Power of Attorney.

On November 20, 1996, Petitioner's attorneys were contacted
by Donald R. Waisel, Esq., who notified them that he was now
representing Plaintiff Leas and that Attorney Thomas was
withdrawing his appearance as counsel of record with regard to
the above captioned action, a copy of Attorney Waisel's letter of
November 21, 1996 confirming the same being attached hereto as
Exhibit "P-l/1.

promptly tor.Warded to him thll required retainer tor Kathleen C.
Dougherty, M,P" Director of ForenBic PByohiatry at Hershey
Medioal Center, to examine and evaluate Plaintiff Leas.

will be availaple to the Court.
