Plaintiffs presently reside In Roanoke, Vlrglnlal Brett H. ZlmmermGll Is currently engaged 'n active duty with the United Sutes Armed Services, and presently stationed In North Carolina. Nonetheless, Brett Zimmerman submitted to deposition on Saturday, October 12, 1996, here In Cenlral Pennsylvania. Plaintiffs offer Brm Zimmerman's deposition tellimony to the arbitration panel pursuant to Pa.R.C.P. 4020(a)(J)(b). As noted above, on or about April 12, 1995, at approximately 8130 p.m., plaintiff Brm Zimmerman was driving his paren15' 1992 Volkswagen Jetta with their permission north on State Road 34, approximately two miles south of the Borough of Carlisle. At the aforesaid time, and as Brett Zimmerman proceeded north on State Road 34, Defendant Harvey Roy Fry, operating a bU5 owned by Defendant Bethel A55embly of God, attempted to make alen turn to enter the northbound lane of State Road 34 in front of Brett Zimmerman'5 vehicle. Failing to yield to Brm's right of way, Mr. Fry caused Brett to unavoidably $trike the rear of the bus with co. Plaintiffs' automobile, cJusing damage to said automobile in the amount of 56,070.04. II. LAW Defendant Fry had the primary duty of yielding to Brett's right.of.way.
