I, Arleen B. Miller, am the plaintiff in the original caee.
On 0/00/96, I reoeived judgement against Mr. Lauok in the amount
of $1,074.43. Mr. Lauck has not paid this and delivered a NOTICE
OF APPEAL to my of fioe on september 10, 1996. 'rhiB was wi tneseed
by my office manager, Tammy L. Walker-as I was not in the offioe
at tlle time. This dooument was also never signed for, as in
receipt of, by anyone, including myself.
On November II, 1995, I incurred severe storm damage to the roofe
of both my house (slate roofl and attached insuranoe agency (tin
roof). After receiving mult pie estimates for oomplete,
professional repair of damageB, I believed Mr. Lauck's contract
to be the most thorough to repair damages to the building. AB he
advertises himBelf as a roof Bpecialist, with 27 years
experience, I understood he would repair ALL damageB, as I
requeBted, and honor his own contract which stateB, "All material
is guaranteed to be as speoified. All work to be completed in a
workmanlike manner according to standard practices."
On December 12, 1995, I contracted with Roger Lauck, Roofing
Contractor, to repairdamages to our property (business & home).
The damages included chimney repair, slate roof repair
(inBtalling new slate & sealing against further damage) I second
floor, Bide porch roof repair & Beal, seeling all valleysI
repairing lower tin roof and also repair and reset all gutters--
all damages in his professional opinion needed and would be
repaired by his company. As well, On Oec.16, 1995, Mr. Lauck
oontraotually agreed by addendum to repair, prime and paint
interior ceiling of the office. No further addendums would ever
be discussed, or contraotually agreed on.
On Dec. 27, 1995, I made partial payment of $1,000.00 to Mr..
Lauok to repair property. Initial repair made to the interior
office included sanding and Bpackle, on top of damaged interior
ceiling dryweall. 'l'he outside tin roof directly above the
ceiling was also to have been repaired. However, the interior

correct size was never installed as evident from the continual
leaking of the slate roof in the exact area original damage
occurred. ThiB leaking did not stop with any repair Mr. Lauck
was supposed to have provided. As a result, we now have
additionnal water damage to the third floor ceiling. In Ocl:ober
we renovated the third floor aB living area with new white walle
that are now stained from roof leaks that were not repaired in a
workman-like manner aB MR. LAUCK'S CONTRACT STA'l'ES, NOR were the
gutters EVER EVEN 'l'OUCIIED, Mr. Lauck physically inspected the
interior of the house as 1 personally showed him the new room
prIor to hie eatImate & evIdences no damage at that time ae it
was NEW.
ceiling immediately began pulling down from water that wae
leaking through the tin roof, that was supposed to have been
already repaired creating additional damage. I illunedIately
called Mr. Lauck on numerOUB occassionsl left messages on his
answerlng machine, wi th no responBe until, after approxiama tely 2
more weeks of damage, he agreed to return to inBtall new dl:ywnll,
of which he agreed, would be his own expenee. lie I:eturned ono
(t) time only to hang new drywa 11 (7 sheeta). 'I'he of flee wlla
left with joint compound on the unfinished drywall and down the
sideB of the walle which were newly painted. A large overhead
light and ceiling fan waR never reinstalled, leaving the office
with no prlmary llghtlng. 1 called Mr. Lauck again on mul tlple
occaeBione (Jan. 16,17,lH as documented In a phone log) to return
and complete the work - at least until the weather improved - and
rehang my office light as this continued to disrupt businesB.
lie establlshed an appointment in the office on Saturday, .lan. 20,
1996 at which time he rehung my main office light. lie
reinspected the elate roof and informed me he did not have the
right size slate and would have to order it. Mr. l,auck
"repaired" the tin roof by applying caulk, which another
contractor told me WOULDN'T repair the roof, ita a temporary
"quick fix" as the Bun would break down the caulking - as is
evident by further water damage through the office ceiling in the
NEW DIIVWAI,L SEAMS. On Monday, Jan.22, 1996, Mr. Lauck returned
to simply roll gray primer on the tin roof. If this was applied
for cosmetic reasonB, it was almost entirely WASIlED OFF as
EVIDEN'l' IN 't'IIE PIIO'l'OS I there iB ADDITIONAlJ DAMAGE '1'0 the OFFICE
ceiling.
1 continued to call Mr. l,auck ,lan. 23,25,26,29,30 [, 31, Foh, 1&2.
On several of the occasionB, on his answering machine, 1
requested hie return to complete the repaira hiB contract agrond
upon or I would have no choIce but to go to the !letter BIIHIIIRRR
!lurellu and/or fUe Bull with the District ,JUBtice. I\ll of L1mRe
occassionB and throughout Feb. and March I continued to call Mr.
Lauck and he never responded. I can be reached at the offico
durJIIg the day.. .my husband IInd I can be contacted ill the
eveningR at home.. .and I have full-time day staff as woll 6e
voice mall l.f contacted at the office. NEI'l'IIER did I receive allY

returned to provide repairs and complete hia work. 1 believe tho
only supplies expense he provided to this contract included ONLY
caulking, joint compound, joint tape and 7 sheets o[ drywall.

the ADDI'I'IONAL DAMAGE and businllss expense I have incurred
resulting [rom hls neglIgence and GROSS BREECH OF CON'l'RAC'I'. On
this basisl his breech of contract and failure to provide a
workmanlike mannoI', as IllS OWN contract Btates, warrants retllnl
of my original $1,000.00 (One Thousandl deposit plus court (lOStB,
AT MINIMALl Mr. IJauck completely fai ed to REPAIH the damages
his contract stipulated.

owner of this property (wh ch we purchaBed August 1995) will alBn
attest to these facts. She will also attest to the fact thnt
these damages from water leaks did not occur IInt!.1 after the
