THIS AGREEMENT made the5ti, day of September, 1996, by and
between ERIC L. SECHRIST and ERNEST C. KREISER, Pennsylvania
Lioensed Co-Partners, of BOO Allendale Road, Mechaniosburg,
Pennsylvania, hereinafter referred to as Contractor, AND RALPH M.
BAlLETS and ANN B. BAlLETS, husband and wife, of 20B West
courtland Avenue, Shiremanstown, Pennsylvania, hereinafter
referred to as Owner, whereby the former undertook and agreed to
ereot and oonstruct a residential dwelling on that oertain lot of
ground situate in the Borough of Mechanicsburg, Cumberland
County, being Lot No.4, Jenna Court, Bluestone Estates. Being a
portion of that certain larger premises which William L. Shelley,
M.D., Exeoutor of the Estate of Raohel S. Stetler, deceased, by
his deed dated May 31, 1991 and recorded in the Cumberland County
Reoorder of Deeds Office in Deed Book "0", Volume 35, Page 413,
granted and oonveyed unto Erio L. Sechrist. Also being the same
premises which Erio L. sechrist, joined by his wife, Stephanie J.
Sechrist, by deed dated j~..\.,..- r , 1996 and about to be
recorded herewith, granted and conveyed unto Ralph M. Bailets and
Ann B. Bailets, husband and wife.
NOW THEREFORE, THIS AGREEMENT WITNESSETH I That the said
contraotor, for and in consideration of the sum of One ($1.00)
Dollar to them in hand paid by Owner, the receipt whereof is
hereby acknowledged, and the further oonsideration mentioned in
the agreement aforesaid, for themselves and their subcontraotors,
and all parties acting through or under them, covenant and agree

that no mechanic's liens or claims shall be filed or maintained
by them or any of them against the said buildings and the lot of
ground appurtenant thereto for or on account of any work done or
materials furnished by them or any of them under said contract or
otherwise, for, towards, in, or about the erection and
construction of the said buildings on the lot above described,
and the said Contractor, for themselves, their subcontractors and
others under them hereby expressly waive and relinquish the right
to have, file, and maintain any mechanic's liens or claims
against the said buildings or any of them and agree that this
instrument, waving the right of lien, shall be an indepsndent
covenant.
