4. Said license suspension is allegedly based upon a
conviction for Driving While Registration Suspended or Revoked,
which violation is alleged to have occurred on July 2, 1996.
5. At the time of the above violation on July 2, 1996, the
arresting officer, Officer Siekerman from the Mechanicsburg
Police Department, advised the Petitioner that his registration
was suspended because of a lapse in insurance coverage relative
to that vehicle.
6. Petitioner believes that he maintained insurance
coverage on the vehicle in question at all times and that no such
lapse in insurance coverage occurred.
1. A summary appeal has been filed with the Clerk of
Courts office of Cumberland County and Petitioner is awaiting a
notice of summary trial from the Cumberland County District
Attorney's office relative to the citations issued to the
Petitioner on July 2, 1996.
WHEREFORE, Petitioner respectfully requests that your
Honorable Court schedule a license suspension appeal in this
matter for not less than three (3) months from the date of this
petition in order to allow the Petitioner ample time to litigate
the summary appeal and to rectify the issue of whether a lapse in
insurance coverage occurred with the Department of
Transportation.
