PlJ..u --riA""j WAIVER OF LIENS WHEREAS, HERSHA CONSTRUCTION COMPANY. of New Cumberland, Pennsylvania ("Contractor") entered into a contract with 944 ASSOCIATES. of New Cumberland, Pennsylvania ("Owner") to provide materials and perform labor necessary for construction of a motel ("Project") upon a lot of ground located in Middlesex Township, Cumberland County, Pennsylvania, situate along the north side of the Carlisle Pike, east of a Pennsylvania Turnpike ramp and being more particularly described in Exhibit" A," attached hereto and incorporated herein. NOW TIIEREFORE, it is hereby stipulated and agreed by and between the said parties, as part of the said contract and for the consideration Iherein set forth, that neither the undersigned contractor, nor any sub-contractor or material man, nor any other person furnishing labor or materials to the said contractor for this Project shall file a lien, commonly caned a mechanics' lien. for work done or materials fumished for the Project or for any part thereof. This stipulation is made and intended to be filed with Ihe Cumberland County Prothonotary within ten days after date, in accordance with the requirements of the act of Assembly of Pennsylvania, in such case provided.
