THIS AGREEMENT made the ~ day of September, 1996, by and between
D & S CUSTOM HOMES, a Partnership, hereinafter referred to as Contractor/Owner, whereby
the former undertakes and agrees to erect and construct a single family dwelling on:
All THAT CERTAIN tract of land situate in Dickinson Township, Cumberland
County, Pennsylvania, bounded and described as follows:
BEGINNING at a point on the Weslern side of Sandy Bottom Road which point on
the dividing line between Lots Nos, 39 and 40 on the hereinafter mentioned Final Subdivision
Plan; thence by said dividing line North 81 degrees 56 minutes 20 seconds 41 seconds East
95.45 feet to a point, in line of Lot No. 41; thence by the dividing line betweens Lots Nos. 40
and 41 on said Plan South 4B degrees 56 minutes 3B seconds East 2B2,41 feet to a point on
the Northern side of Rapuano Way; thence along the Northern side of said Rapuano Way by a
curve to the right having an arc radius of :li5 feel a distance of 146,63 feet to a point; thence
conlinuing along the Northern side of said Rapuano Way South B1 degrees 20 minutes 41
seconds West 121.60 feet to a point; thence by a curve to the righl having an arc radius of 20
feet a distance of 31,4 feet to a point on the Eastern side of Sandy Bottom Road; thence along
the Eastern side of Sandy Bottom Road North 08 degrees 39 minutes 19 seconds West 241,53
feet to a point on the dividing line between Lots Nos, 39 and 40 on said Plan, the Place of
BEGINNING.
CONTAINING a 50,964 square feet and being Lot No, 40 on Final Subdivision Plan,
Phase Number One of Callapatscink, which is recorded in the Office of the Recorder of Deeds
for Cumberland County in Plan Book 69, Page 20.
UNDER AND SUBJECT to a portion of a 20 foot storm water easement, as shown
on the hereinafter mentioned SubdIVision Plan.
UNDER AND SUBJECT to bUilding and use restrictions recorded in the Office of the
Recorder of Deeds in and for Cumberland County, in Miscellaneous Book 486, Page 1074, for
certain lots of Final SubdiVISion Plan for Phase Number One of .Callapatscink,. as recorded In
Plan Book 69, Page 20.
BEING part of the property whIch was conveyed to Wilbert L. DIehl and Shryte M.
Diehl. husband and WIfe. by Michael R. Rapuano and Marsha L. Rapuano, his wife, by deed
dated January 13, 1966, and recorded 10 the Office aloresald in Deed Book .S., Vol. 31, Page
236, and betng part ot .Parcel A. in said Deed, By an Agreement of Sale for Real Estate
