WHEREAS, Giant Food Stores, Inc., of Middlesex Township, Cumberland County,
Pennsylvania, is about to enter Into a contract with R. S. Mowery & Sons, Inc., of carlisle,
Pennsylvania, for the construction of a Windbreak Addition at Giant FOOd Store 1110 upon
a lot of land situate at 700 camp Hili Shopping Plaza, Camp Hili Borough, Cumberland
county, pennsylvania.
NOW, September 13, 1996, at the time of and Immediately before the execution of the
principal contract, and before any authority has been given by the said Giant FOod Stores,
Inc. to the said R. S. Mowery & SOns, Inc., to commence WOI1c on the said addition, or
purchase materials for the same In consideration of the making of the said contract With
R. S. Mowery & SOns, Inc., and the further consideration of One DOllar to R. S. Mowery &
Sons, Inc., paid by Giant FOod Stores,lnc., It Is agreed that no lien shall be flied against the
building or property by the contractor, nor any subcontractor, nor by any of the material
men or wol1cmen nor any other person for any labor, or materials purchased, or extra
labor or materials purchased for the construction of said addition, the right to file such
liens being expressly waived.
