GREGORY TOMASSETTI, t/d/b/a TOMASSETTI BUILDING AND REMODELING CONTRACTOR, Defendant . . : : CIVIL ACTION - LAW COMPLAINT 1. Plaintiff is an adult individual who resides at 200 E. Locust Street, Mechanicsburg, Cumberland County, Pennsylvania 17055. 2. Defendant is an adult individual who resides at 150 Henry Road, Enola, CUmberland County, Pennsylvania 17025. 3. Defendant is self-employed as a building and remodeling contractor conducting business under the name of "Tomassetti Building and Remodeling Contractor". 4. Plaintiff is the owner of the residence located at 200 E. Locust Street, Mechanicsburg, Pennsylvania. 5. During the severe winter of 1995-1996 the roof at 200 E. Locust Street, Mechanicsburg, PA was damaged as a result of ice and water build-up. 6. In addition to the dallage to the roof the interior of the house suffered damage as a result of water leakage. 7. On or about February 20, 1996. plaintiff entered into written agr....nt. with the defendant pursuant to which the defendant was to aake repaira to the interior of the hou.e and to replace the roof that had tIlten daaaqed. Cop i es 0 f those two written agreements are attached hereto and marked Exhibits "A" and "B". 8. Pursuant to the agreements the plaintiff was to pay a total amount of $4,012.50 to defendant for the repairs. 9. The defendant did come to the plaintiff's house and did make repairs for which the plaintiff paid the defendant a total of $4,120.00. 10. After the defendant had completed the repairs the plaintiff experienced water leakage through the new roof which the defendant had installed and this water leakage caused additional interior damage. COUNT I BREACH OP CONTRACT 11. Paragraphs 1 through 10 are incorporated herein as if set forth at length. 12. The defendant breached its agreement in that the work performed by the defendant was not performed in a quality and workmanlike manner. 13. The defendant, who held himself out as a building and remodeling contractor with experience in the installation of roofs on residences improperly installed a shingle roof on a roof that should not have been covered with shingles. 14. Due to defendant's improper installation of shingles on a roof that should not have had a shingle roof installed the plaintiff'. roof continues to leak and cause vater damage to the interlor of th~ r.sidence. 15. Plaintiff has had to hire a new contractor to repair the leaking roof and to obtain estimates to make interior repairs and replace the shingled roof. 16. To date, the plaintiff has had to pay $513.53 for repairs which were designed to prevent further leaking of a shingled roof. 17. In addition to the repairs the plaintiff has obtained new proposals to complete the repairs to the interior and to install a proper roof for the structure. These proposals total $2,303.14. 18. The total damages which flow from the defendant's breach of his contract with plaintiff is $2,816.67. WHEREFORE, plaintiff prays that this Honorable Court will enter judgment in favor of plaintiff and against defendant in the amount of $2,816.67 plus court costs and such other relief as the Court deems appropriate. COUNT II HlOLIOIllCa 19. Paragraphs 1 through 18 are hereby incorporated as if set forth at length. 20, The defendant held hilllself out to the plaintiff as a building and remodeling contractor with experience in the installation of roofs. 21. Plaintiff relied upon the defendant's representations as to his ability to perfon the work required to IUlte repairs to plaintiff's house. C) At this location. is were the leaking actually occurs. cont. and is not caused by use of this product, but rather by poor design structure. Again this would not have occured if the Plaintiff would have allowed the Defendant to do his job in the beginning. 14) DISAGREE - Refer to 13.C reply 15) DISAGREE - Again the Plaintiff ended the contract/warranty when the Plaintiff refused to allow the Defend- ant to perform his job. The Plaintiff. in fact. refused to allow the Defendant to perform work that may not have been covered by their insur- ance company. They have been warned and advised by the Defendant all throughout this job. The Defenant asks this honorable court for the Plaintiff to be responsible for their own decis- ions and to take responsibility for their own actions. 16) DISAGREE - The Defendant throughout the job had advised the Plaintiff of the consequences of not allow- ing the Defendant to make necessary repairs that may not be covered by their insurance com- pany. The Defendant asks the court to hold the Plaint-. iff accountable for their own actions. 17) DISAGREE 18) DISAGREE It is the Defendants deepest hope and prayers that both the Plaintiff and the Defendant bring out in court all the important questions and ans- wers. along with all the necessary Information for all to see and witness. Because of the Plaintiff and her son tried to get the Defendant to co..lt insurance fraud through- out this jab. by writing up work not covered by insurance as "Ice' water damage". The Defendant would like nothing more than a court order stating that the Plaintiff can not contact the Defendant in any.ay. no more &fter this trial.
