At the aforementioned time and place, the Defendant, SHEILA HARING, struck the Defendant, HALBROOK, in the rear, who struck the Plaintiff, SHERI REIFSNYDER's vehicle, in the rear. 5. As a result of the aforementioned accident, the Plaintiffs sustained injuries. 6. On September 17, 1996, the plaintiffs filed a Praecipe to Issue a Writ of Summons upon the Defendants in This Honorable Court for the injuries they sustained in the aforeaentioned accident. (Se. Praecipe for Writ of Su.aona attached as Exhibit -A-). 7. On or about october 21, 1996, the cuaberland COunty Sheriff's Office refunded the Plaintiffs' psyaent for service, noting that the Defendant, BRIAN HAL8ROOlC, va. unable to be located. (S.e Sheriff's Office receipt attached as Exhibit -8-). 8. On or about october 25, 1996, the Plaintiffs' attorneys, SCHMIDT AND RONCA, P.C., retained COnfidsnt Of Protective Service., Inc., to locate the Defendant and belp coaplete service. t. (See Affidavit of Ron Hill attached hereto as Exhibit "C"). 10. Ron Hill also went out to the new address and spoke with persons who stated Defendant, BRIAN HALBROOK, lived there. 11. On or about November 15, 1996, the Plaintiffs filed a Praecipe to Reinstate the Writ of Summons with This Honorable Court. (See Praecipe to Reinstate attached hereto as Exhibit "D") . 12. On or about December 10, 1996, the CUmberland county Sheriff's Office refunded the Plaintiffs' payaent for service, notill9 that the Defendant, BRIAN HALBROOK, vas unable to be located at the new address. (See Sheriff's Office receipt attached hereto as Exhibit "E"). 13. At the present tiae, the Defendant, BRIAN HALBRooX'. Whereabouts are unknown. 14. Admitted. 9. Admitted in part; denied in part. It is admitted that the accident occurred when Defendant Sheila Haring struck the rear of the motor vehicle operated by Brian Halbrook. It is averred that the actions of Defendant Haring forced Mr. Halbrook's vehicle to strike Plaintiff's vehicle from the rear. By way of further answer, Mr. Halbrook, at the time of the accident, had properly slowed and stopped his vehicle prior to the time his vehicle was struck from behind by the Haring vehicle. All remaining aspects of this averment are denied, as after reasonable investigation, Defendant is without knowledge or information sufficient to form a belief as to the truth or accuracy of these allegations. 10. It is averred that the accident was caused by the negligence, carelessness and recklessness of Defendant Sheila Haring; or in the alternative, that Plaintiff Sheri Reifsnyder was guilty of negligence which caused or contributed to her accident.
