4. At the aforementioned time and place, the Defendant, SHEILA
HARING, struck the Defendant, HALBROOK, in the rear, who struck
the Plaintiff, SHERI REIFSNYDER's vehicle, in the rear.
5. As a result of the aforementioned accident, the Plaintiffs
sustained injuries.
6. On September 17, 1996, the plaintiffs filed a Praecipe to
Issue a Writ of Summons upon the Defendants in This Honorable
Court for the injuries they sustained in the aforeaentioned
accident. (Se. Praecipe for Writ of Su.aona attached as Exhibit
-A-).
7. On or about october 21, 1996, the cuaberland COunty
Sheriff's Office refunded the Plaintiffs' psyaent for service,
noting that the Defendant, BRIAN HAL8ROOlC, va. unable to be
located. (S.e Sheriff's Office receipt attached as Exhibit -8-).
8. On or about october 25, 1996, the Plaintiffs' attorneys,
SCHMIDT AND RONCA, P.C., retained COnfidsnt Of Protective
Service., Inc., to locate the Defendant and belp coaplete
service.

Praecipe to Issue a Writ of Summons. (See Affidavit of Ron Hill
attached hereto as Exhibit "C").
10. Ron Hill also went out to the new address and spoke with
persons who stated Defendant, BRIAN HALBROOK, lived there.
11. On or about November 15, 1996, the Plaintiffs filed a
Praecipe to Reinstate the Writ of Summons with This Honorable
Court. (See Praecipe to Reinstate attached hereto as Exhibit
"D") .
12. On or about December 10, 1996, the CUmberland county
Sheriff's Office refunded the Plaintiffs' payaent for service,
notill9 that the Defendant, BRIAN HALBROOK, vas unable to be
located at the new address. (See Sheriff's Office receipt
attached hereto as Exhibit "E").
13. At the present tiae, the Defendant, BRIAN HALBRooX'.
Whereabouts are unknown.
14. Plaintiff.' counsel has notified Defendant's, HALBROOK's
insurance coapany that a Writ vas filed and reinstated, but that
Defendant, UlAN HALBROOK, CO\Ild not be locsted. (5_ Eltbibit

As you recall, ve represent Sheri Reifsnyder for the injuries ahe
sustained in a aotor vehicle accident. Your insured, Brian
Halbrook vas involved in this aotor vahicle accident. We vere in
negotiations vith Sheila Haring's insurer for quite soae ti...
Earlier this Fall, "e spoke and I info~ed you that I vas going
to file a Writ of Suamons in order to protect the statute of
liaitationa. I also info~ed you that I vas going to naae Mr.
Halbrook as a Defendant in order to protect .y client's rights.
If ve vere able to resolve the claia, I did not anticipate
pursuing a clai. against your insured. Unfortunately, ve have
been unable to negotiate an aaicable resolution to the clai. vith "
lis. Haring. Therefore, it is going to be necessary to lIQVe
forward with suit. I Itnov that the other party vill try to place
~ fault on Hr. Halbrook.
We tried to have the Sheriff serve your insured at the address
you provided to... Unfortunately, your insured no longer lives
at that address. I then hired a Private Investigator to locate
your iNJured. '!'be Invest19ator provided .. with an address which
I forwarded to the Sheriff's Departaent. To date, ve haVe been
unauccessful in serving your insured. If the Sheriff cannot
serve your insured, then it asy be nece...ry to file a Motion to
Serve by Publication. In order to expedite the proce.., I would
appreciate it if you vould accept _rvice on behalf of your

13. As a direct and proximate result of the accident, the
Plaintiff, SHERI REIFSNYDER, suffered serious and permanent
injuries which include the following:
(a) Hand painr
(b) Arm pain:
(c) Back pain:
(d) Maxillary sinus pain:
(e) Sternal pain:
(f) Abdominal pain:
(g) Pain in the shoulders and anterior chest wall:
(h) Diffuse myofacial spasm throughout the cervical
thoracic and lumbar paraspinal muscles: and
(i) Trigger points in the rhomboid muscles.
14. Aa a direct and proximate result of the accident, the
plaintiff, SHERI REIFSNYDER, has incurred medical expense.

15. As a direct and proximate result of the injuries
sustained in the accident, the Plaintiff, SHERI REIFSNYDER, may
continue to incur medical bills in the future.
16. As a direct and proximate result of the injuries
sustained in the motor vehicle accident, the Plaintiff, SHERI
REIFSNYDER, has sustained a wage loss of approximately Fifty .ix
Dollars and 54/100 ($56.54) to date, and may continue to incur
additional wage loss in the future.
17. As a direct and proximate result of the injuries
su.tained in the motor vehicle accident, the Plaintiff, SHERI
REIFSNYDER, has been advised, and. therefore aver., that the
aforesaid injuries are permanent in nature and effect.
18. As a direct and proximate result of the injuries

9. Admitted in part; denied in part. It is admitted that
the accident occurred when Defendant Sheila Haring struck the rear
of the motor vehicle operated by Brian Halbrook. It is averred
that the actions of Defendant Haring forced Mr. Halbrook's vehicle
to strike Plaintiff's vehicle from the rear. By way of further
answer, Mr. Halbrook, at the time of the accident, had properly
slowed and stopped his vehicle prior to the time his vehicle was
struck from behind by the Haring vehicle. All remaining aspects of
this averment are denied, as after reasonable investigation,
Defendant is without knowledge or information sufficient to form a
belief as to the truth or accuracy of these allegations.
10. Denied. It is averred that the accident was caused by
the negligence, carelessness and recklessness of Defendant Sheila
Haring; or in the alternative, that Plaintiff Sheri Reifsnyder was
guilty of negligence which caused or contributed to her accident.
It is specifically denied that the accident was caused by the
negligence, carelessness, or recklessness of Defendant Brian
Halbrook. All of the remaining aspects of this aveTlllent are
denied, as after reasonable investigation, Defendant is without
knowledge or infol'1\lation sufficient to fot1ll a belief as to the
truth or accuracy of these allegations.
