I. The plaintiff, Laura S, Fritz, is an individual residing at RR. 4, Box 4020,
Duncannon, Perry County, PA 1711211-94116
2. The defendant, Samuel H. Starner, is an individual residing at 94 Peach
Glen Road, Gardners, Cumberland County, PA 17324
3. The defendant, Ridge Road Repair Service, is a place of business located at
450 S. Ride Road, York Springs, Adams County, 1'1\ 17324
4. On November 11, 1995, the plaintiff was the owner of a 1992 Mazda Protege.
5. At or about 4:30 P.M. on the aforesaid date, the plaintiff was operating the
said Mazda in a northerly direction on Routes 11 and 15 in Penn Township, Perry
County.PA.
6. At the same time and place, the defendant, Samuel It. Gardner, while acting
within the course and scope of his employment with the defendant, Ridge RIl<ld
Repair Service. was operating a 1979 3111/GX Datsun Coupe in a Southerly direction
on the said Routes 1 I and 15 in renn Township, Perry County, PA,
6. The defendant, Samuel It. Gardner, lost control of his vehicle and mISsed
over the center line, causing the plaintiff's vehicle to collide with the defendant's
vehicle.
7. The collision was caused by the negligence of the defendant. Samuel It.
Gardner, operating in the cuur<oe and scope of his emph1yment with tht' defenan!,
Ridge Road Repair St>rvice in the fl>!lowing respects:
a. In failing to operate his vehicle in a safe and prudent manner.
b. In failing to operate his vehicle in his own southbound lane and in mlS!!ing
owr the C\'Ilter line into tht. nurthbound lane of trawl.
M. As a result of the ~1i1tffiC\' I" the defendant. tht. plaintilf ",ustained

COMPLAINT
1. The plaintiff, Elizabeth K. Moffatt, is an individual residing at
R.D. I, Box 350, Lyons Road, Millerstown, Perry County, Pennsylvania.
2. The defendant, Samuel H. Stamer, is an individual residing at
94 Peach Glen Road, Gardners, Cumberland County, Pennsylvania.
3. The defendant, Ridge Road Repair Service, is a place of business
located at 450 South Ridge Road, York Springs, Adams County, Pennsylvania.
4. On November II, 1995, the plaintiff was the owner of a 1994
Chevrolet Cavalier.
5. At or about 4:30 P.M. on the aforesaid date, the plaintiff was
operating the said Chevrolet in a northbound direction on Routes 11 and 15
in Penn Township, Perry County, Pennsylvania.
6. At the same time and place, the defendant, Samuel H. Gardner,
while acting within the course and scope of his employment for the
defendant, Ridge Road Repair Service, was operating a Datsun 310 GX Coupe.
7. The defendant, Samuel H. Gardner, lost control of his vehicle
and crossed over the renter line, causing the plaintifrs vehicle to collide with
the defendant's vehicle.
8. The coUision was caused by the negllgen of the defendant in
the following respects:
(a) In failing 10 operate his vehkw in a sare and prudent
manner;

COMPLAINT
I. The plaintiH, Laura S. Fritz, is an individual residing at R.R. 4, Box 4020,
Duncannon, Perry County, PA 17020-9406
2. The defendant, Samuel H. Starner, is an individual residing at 94 Peach
Glen Road, Gardners, P A 17324
3. On November 11, 1995, the plaintiff was the owner of a 1992 Mazda Protege.
4. At or about 4:30 P.M. on the aforesaid date, the plaintiff was operating the
said Mazda in a northerly direction on Routes 11 and 15 in Cove, PA.
5. At the same time and place, the defendant was operating a 1 f179 Datsun
Coupe in a Southerly direction on the said Routes 11 and 15 in Cove, PA.
6. The defendant lost control of his vehicle and crossed over the center line,
causing the plaintiffs vehicle to collide with the defendant's vehicle.
7. The collision was caused by the negligence of the defendant in the following
respects:
a. In failing to operate his vehicle in a sale and prudent manner.
b. In failing to operate his vehicle in his ownJOUthliound lane and in crossing
over the center line into the northbound lane of traYel. :
8. As a result of the nrgligenct' of the defendant, the plaintiff sustained
$7,026.OJ in dlJllages to her said vehicle, as is more fully set forth in the attached
Exhibit A.

provided pursuant 10 Pa.R.c.P. 1305 (b) (3).

COMPLAINT
I. The plaintiff, Laura S. Fritz, is an individual residing at R.R. 4, Box 4020,
Duncannon, Perry County, PA 17020-9406
2. The defendant, Samuel H. Stamer, is an individual residing at 94 Peach
Glen Road, Gardners, PA 17324
3. On November 11, 1995, the plaintiff was the owner of a 1992 Mazda Protege.
4. At or about 4:30 P.M. on the aforesaid date, the plaintiff was operating the
said Mazda in a northerly direction on Routes 11 and 15 in Cove, PA.
5. At the same time and place, the defendant was operating a 1979 Dal..un
Coupe in a Southerly direction on the said Routes 11 and 15 in Cove, PA.
6. The defendant lost control of his vehicle and crossed over the center line,
causing the plaintiffs vehicle to collide with the defendant's vehicle.
7. The collision was caused by the negligence of the defendant in the following
respects:
a. In failing to operate his vehicle in a safe and prudent manner.

b. In failing to opera~ his vehicle in his own SouthfJound lane and in crossing
over the center line into the northbound lane of travel.
8. As a result of the negligence of the defendant. the plaintiff sustained
$7,026,08 in damages to her said vehicle. as is mons futty set forth in the attached
Exhibit A,
9. Attached hereto ans copies ,I( the bills/estimates in thill matter. which are
provided pursuant to Pa.R.CP. t:lJ5 (b) (3).
