imminent serious bodily injury, and has knowingly engaged in a
course of conduct or repeatedly committed acts toward the
plaintiff and her minor children includin, following the
plaintiff and the children, under circumstances which have placed
the plaintiff and the children in reasonable fear of bodily
injury. This has included, but is not limited to, the followin,
specific instances of abuse:
a. On or about September 7, 1996, the defendant
forcefully pushed Christie H. Henn, the plaintiff's
daughter, into her bedroom Bnd slapped her across the
face causin, her mouth to bleed.
b. In or about Au,ust 1996. the defendant picked the
plaintiff up by grabbing both of her arms and threw her
to the floor causing bruising on her hip.
c. In or about July 1996, the defendant lorcefully
crabbed the plaintiff around her throat and choked her
cau.inc bruisinc and sorene.. for several daym.
d. On several different occasions since 1993, the
defendant has pushed the plaintiff. re~ate~ly slapp.d

to fear for her safety and that of the children who
would scream for their mother to intervene when the
defendant would enter their bedrooll, touch theil, and
keep them awake.
6. On or about September 9, 1996, the plaintiff and her
two minor children left their residence at 1030 Alexander Spring
Road, Carlisle, Cumberland County, Pennsylvania, in order to
avoid further abuse.
7. The plaintiff believes and therefore avers that she and
her minor children are in i.mediate and present dan,er of abuse
fro. the defendant should they return to the hOlle without the
defendant's exclusion and that they are In need 01 protection
fro. such abuse.
8. The plaintiff desires that the defendant be prohibited
from having any direct or indirect contact with the plaintiff or

B. EXCLUSIVE POSSESSION
12. The mobile hOlle froll which the plaintiff is asking the
Court to exclude the defendant is owned in the names of the
plaintiff and the defendant.
13. The plaintiff currently has no permanent place to stay
with her children except the marital home. and the defendant has
lamily and friends in the area with whom he can stay.
14. The plaintifl desires possession of the mobile home so
as to give the greatest degree of continuity to the lives of the
children and to allow them to continue their educstion at their
schools and to continue their school and social activities.

the arrest.

8. The facts of the most recent incident of abuse are as
follows:
On or about October 2, 1998, Defendant grabbed
Plaintiff about the mouth causing a cut on her lip. He
threw her to the floor causing a bruise on her arm, and
drew back his fist in a threatening manner saying, ~Do
you want more,. causing Plaintiff to fear for her
safety. Plaintiff struggled free and tried to get to a
telephone to call for help, but Defendant's mother
grabbed the telephone refusing to give it to her saying
that she deserved what she got. Plaintiff left the
residence and went to the Pennsylvania State Police to
report the incident. The Police later arrested
Defendant and there is a preliminary hearing pending.
Defendant is out on bail which prevents him from having
any contact with Plaintiff. The hearing is scheduled
for November 13, 1998.
9. Defendant has committed the follc~ing prior acts of abuse
against Plaintiff or the minor children:
a. On or about Sept~~ber 13, 1998, Defendant forcefully
punched Danielle Henn, Plaintiff's twelve year old
daughter, in the face, resulting in a bruised, swollen,
and cut lip, and causing her to fall backwards cnto a
bed. When Defendant went after the child on the ~,
she struggled free and ran from the room into a
bathroom. Defendant's mother followed the child, took
her by her arms, shook her, and told her to look at
herself and remember it. Danielle ran out of the house
to her grandmother's resi~nce. The child also had
scratches on her n~:k from the incident.
b. In ~r about August 1998, Defenuant fcr~Efutly pU$h~j

stay awake. Defendant has also forcefully pushed
Plaintiff's daughter, Christie M. Henn, and slapped her
across the face causing her mouth to bleed.
10. The following police departments or law enforcement
agencies in the area in which Plaintiff lives should be provided
with a copy of the Protection Order: the appropriate police
departments.
11. There is an irr~ediate and present danger of further abuse
from the Defendant.
12. Plaintiff is asking the Court to exclude Defendant from
the residence at 1030 Alexander Spring Road, Carlisle,
Pennsylvania, which is owned by Plaintiff and Defendant.
WHEREFORE, PLAINTIFF REQUESTS THAT THE COURT ENTER A TEMPORARY
ORDER, AND AFTER HEARING, A FINAL ORDER THAT WOULD 00 THE
FOLLOWING:
A. Restrain Defendant from abusing, threatening, harassing, or
stalking Plaintiff and her minor children in any place where
Plaintiff may be found.
B. Evict and exclude Defendant from Plaintiff's residence and
prohibit Defendant from attemptir.g to enter any temporary or
permanent residence of Plaintiff.
L. Prohibit Oehndant from havin<} any contact with Haintiff or
her minor children, either in person, by telephone, or in
writing, personally or through third persons, including but not
limited to any contact at Plaintiff'g place of employment or the
