Agreement ("Lease"), whereby Joseph Cwnano agreed to rent the Property, A copy of the Lease is
attached hereto, incorporated herein and marked Exhibit "8,"
5. Pursuant to the terms of the Lease, Joseph Cumano was obligated to pay, on a monthly
basis, base rent in the amount of Two Thousand Dollars ($2,000.00) through October 3 J, J 995 and
Two Thousand Five Hundred Dollars ($2,500.00) thereafter, common area maintenance rent in the
amount of One Hundred Fifty-eight and 40/100 Dollars ($158.40), laX renl not to be less than One
Hundred Ten Dollars ($1 10.00) and insurance rent. All sums were to be paid on the first day of each
calendar month during the Lease tenD, which was to expire without prior notice on the last day of
the month next following the tenth anniversary of the commencement date.
6. On or about February 6, 1991, Defendants Helen Klinger and Amedeo Cumano entered
into an Assumption Agreement, whereby Defendan1s agreed, inter alia, to assume "the performance
of all of the terms, covenants and conditions of the Lease." A copy of the Assumption Agreement
is attached hereto, incorporated herein and marked Exhibit "C."

DefendanlS were sent a notice of their rental arrearages and of their violation of the Lease, A copy
of the notice is attached hereto, incorporated herein and marked Exhibit "D." DefendanlS have
failed to pay the oUlStanding rental obligation.
13, DefendanlS are presently in possession of the property,
WHEREFORE, Plaintiff requeslS that this Court enter judgment in favor of Plaintiff and
against Defendants, Helen Klinger and Amedeo Cumano, for possession of the premises owned by
Plaintiff and located in Upper Allen, Cwnberland County, more fully described in Exhibit" A,"

15. Pursuant to the lease. DefendanlS' rental obligation for July. August and September of
1996, including base rent, common area maintenance rent, tax rent and insurance rent, due and
owing Plaintiff, is Eight Thousand Four Hundred Ten and 53/100 and Dolllrs (51,410.53).

commission in oblaining another tenant; expenses incurred in putting the leased premises in good

Dollars ($126.15) for interest and Seventy-five Dollars (575.00) for late charges, all of which

paying Plaintiff the full value therefore,

35. The parties hereto are also Landlord and Tenant under a
certain lease dated September 1. 19B4. for certain other premises in
the Shopping Center (hereinafter called the "First Lease"). By
executing this Lease. the parties hereto agree that the First Lease
shall be cancelled and terminated and each of the parties hereto
hereby release one another from any liability arising out of the
First Lease.
36, In addition to the items referred to in Subsection (e) of
Article 10 of the Lease, Tenant agrees to make all repairs,
replacements and alterations necessary to maintain in good condition
all conduits, fixtures. meters and equipment relating to utilities
(including, but not limited to. water. gas. electricity and
severage) to the extent they serve the Leased Premises exclusively.

37. The occupancy of the leased premises by Tenant prior to the

38. Tenant's sign design drawings shall be submitted to the
Landlord for Landlord's approval prior to the erection of Tenant's
sign, The sign shall not exceed 30" in height. nor shall the length
exceed 2/3 of the Tenant's storefront. Flashing. neon or moving
lights on signs are prohibited. "11 the provisions of this Lease
shall apply to said sign, insofar as said provisions are applicable.

42. Notwithstanding anything provided herein, any discrepancy
between the printed form and this rider, the rider shall prevail.
43. CA) At its expense. within thirty (30) days after the date
of this Lease, Tenant shall submit for Landlord's written approval
detailed plans and specifications (hereinafter collectively referred
to as "Plans") for all the work to be done by Tenant to the Leased
Premises, failing which Landlord has the right to terminate this
Lease and entitling Landlord to retain the Tenant's entire security
deposit as liquidated damages.
(B) Landlord shall inform Tenant of any objections to said
Plans within thirty (30) days after receipt: then Tenant within
fifteen (15) days shall deliver to Landlord corrected Plans, which
Landlord shall accept or reject within the next fifteen (lS) days,
Failure to inform Tenant of objections within said time periods
shall be deemed Landlord's waiver of objections.
(C) If Tenant's Plans are approved. it shall not be deemed
Landlord's undertaking that they conform to law or impose any
liability on Landlord Tenant shall immediately apply for all
governmental permits necessary for Tenant's work. After such
permi ts are issued and Landlord has completed the lJork, if any.
Landlord has agreed in this Lease to do. Tenant agrees to promptly
COlmlence and complete Tenant's lJork in conformity with said Plans
and with all legal requirements and lJith the requirements of the
Building Department having jurisdiction. and before cOlmlencing
Tenant's 1oIOrk. Tenant lJill deliver to Landlord all of the
following: (1) A Contractor's completion bond to Landlord as
obligee in form approved by Landlord issued by a surety company,
guaranteeing completion of Tenant' s lJork in accordance with said
Plans free of liens and security agreements. and (2) comprehensive
general liability insurance insuring Landlord for at least
Sl.000,~00 combined single limit for bodily injury and property
damage and (3) a statement from Contractor that Contractor agrees to
indemnify, save and hold hartllless Landlord, its agents, employees
and assiqns from all liabilities, claims. losses, liens. damages and
suits of whatsoever nature for personal injury. death or property
damage alleged to arise out of the work performed under the
contract. whether by the Contractor or by any subcontractor, and
whether asserted against Landlord or the Contractor. and (4)
Contractor's Workers' compensation and occupational Disease
insurance with statutory limits and employer's liability with a
limit of at least $100.000 for all damage from one or more claims.
(D) Tenant shall comply with all legal requirements during
its work: and lJhen completed. Tenant'S 1oIOrk shall colttply with all
laws, ordlnances. regulations or orders of public authority. and
with all Fire Insurance Rating Orglni:ation (or similar bodyl
re~irements and the liability insurance company's r~irementS

(F) Tenant agrees not to permit any mechanic' s or other
lien to be filed either against the Leased Premises or the Shopping
Center or Tenant' s leasehold interest by reason of work, labor,
services or materials supplied to Tenant or anyone holding the
Leased Premises through Tenant. If any lien is filed, Tenant shall
....ithin ten (lO) days after notice of the filing, cause it to be
discharged of record. failing ....hich Landlord, in addition to any
other right or remedy, may (but shall not be obligated to) discharge
by deposit or by bonding proceedings. If Landlord so elects. it may
compel the prosecution of a foreclosure action by the lienor any pay
the amount of the judgment. and any amount so paid. ....ith interest
thereon at the rate of l2\ per annum or the highest legal rate
(....hichever is less) from the date of payment, shall be paid by
Tenant to Landlord on demand as additional rent, Nothing shall be
construed as the consent or request of Landlord. express or implied,
to any contractor. subcontractor. laborer or materialman for
performance of labor or furnishing of materials or as giving Tenant
the authority to contract for or permit the rendering of any service
or the furnishing of any material that ....ould give rise to the filing
of any lien.
(G) The Contractor shall furnish to both the Tenant and the
Landlord on completion of the work a guaranty for a period of one
(l) year that all work will be free from all defects and that all
apparatus ....ill develop capacities and characteristics specified in
the approved Plans. and that ....henever within one (1) year of' the
final acceptance of the work the Contactor is notified in writing by
either Landlord or Tenant that an item of equipment, material or
workmanship is defective or does not in some other ....ay meet the
specifications requirements. the contractor agrees to immediately
replace. repair or otherwise correct the defect or deficiency
without cost to Landlord. except that the following items of work
shall be guaranteed for periods in excess of the one (1) year
specified herein: Motor compressor Units: five (5) year: Exterior
Walls: tWO (2) year guaranty against air and moisture leakage:
Roofing: two (2) years.

Leased Premises. it shall. at its own cost and expen!ie. install an
Improved Risk Mutual (IRK) approved fire extinguishing system within
the hood and duct and to provide Landlord with a certificate

ASSUMPTION AGREEMENT
THIS ASSUMPTION AGREEMENT dated as of the 6th day of February, 1991 by and
between KIKO DEVELOPMENT OF GIANTS. INC. (hereinafter referred to as
"Landlord") and AMEDEO ClIWIO and HELEN KLlItGER (hereinafter referred to as
"Assignee"); which terms "Landlord" and "Assignee" shall include the successors
and assigns of the respective parties.
WITNESSETH:
WHEREAS, by Lease Agreement dated July 2. 1986. Landlord did lease and
demise unto Joseph Cumano d/b/a Two Guys Pizza certain premises therein more
particularly described in a Shopping Center located at Upper Allen, pennsylvnia
(said Lease Agreement is hereinater referred to as the "Lease"); and
WHEREAS, the parties hereto desire to amend the Lease.
NOW. THEREFORE. in consideration of Landlord consenting to the assiynment
and the SUII of Ten and no/100 (S10.00) Oollars and other good and va uable
consideration, in hand. paid by Assignee to Landlord. the receipt and
sufficiency of which is hereby acknowledged, it is IUtually agreed as follows:
1. The Assignee represents that by Slles Agreetll!nt dated Hay 2, 1989, it
is the successor to the interest of Joseph CUNno as tenant in and to the
Lease.
2. The Assi9nee hereby assUlleS the performance of all of the terms,
coverants and condttions of the leise, agrees to pay the Rent reserved by the
lease as and when the same shall be or becOle due and payable, and agrees to
perfprm all of the tenls. covenlnts and conditions of the Lease. in all
respects and with the same effect as though the Assignee had executed the lease.
3. The Assignee further agrees that the obllgltions hereby assUltd by it
shill inure jointly and severally to the Landlord under tht lene Ind to its
Issignor.
4. To Induce landlord to grant Its consent as provided herein, Assignee
hereby agrees, represents and warrants that It has no claia against landlord in
