for Plaintiff, and respectfully petitions this court as follows:
1. Petitioner herein is Kenneth A. Wise, Esquire, who is the
attorney for Plaintiff.
2. Respondents herein are Plaintiff Furnley Frisch and
Defendant steven J. Gutshall.
J. This action is a claim by Plaintiff against Defendant for
snow re.oval services Plaintiff supplied to Defendant.
4. Differences have arisen between petitioner and plaintiff
concerning prosecution of this case.
5. Differences have also arisen between Petitioner and
Plaintiff concerning payaent by Plaintiff of Petitioner's fees and
services, vhich are in substantial arrears.

This case is currently at the pleadings stage.

AND NOW, comes Plaintiff, Furnley Enterprises, Inc., by its
undersigned counsel and respectfully brings this Complaint setting
forth in support thereof as follows:
COUNT I
1. Plaintiff Furnley Enterprises, Inc., is a Pennsylvania
Corporation with a principal place of business at 291 Sawill Road,
Duncannon, Perry County, Pennsylvania.
2. Defendant Steven Gutshall, is an adult individual res1dinq
at 235 Ewe Road, Mechanicsburg, CUmberland County, Pennsylvania.
J. Plaintiff is in the business of leasinq and operatinq
pieces of heavy equipment, includinq front-end loaders and duap
trucks, both trucks and with operators.
4. Defendant Gutshall is or was in the business of
landscapinq and outside property maintenance, includlnq snov
reaoval froll parklnq lots of ~ercial custo_rs.
5. on January 14, 1996, Defendant had atteapted without
succass to reaove heavy anovs trOll the perklnq lot of cHents alonq
senate Avenue and other locations In the Caap Hill, hnnsylvanla,
area. Defendant thereupon noted heavy equlpaent belnq operated by
Plaintiff in the vicinity, and he thereupon approached an agent of
Plaintiff to have a crew of operators and snow removal equipment to
remove snow from the parking lot along Senate Avenue and several
other lots for which the Defendant was under contract to remove
snow.
6. Plaintiff and Defendant thereupon entered into an
aqreement, confirmed by several billinq receipts, attached as
Exhibit "A", one of which is siqned by Defendant, to provide a crew
of two front-end loaders with operators and dump trucks for snow
removal at various sites. Under this arrangement, Defendant was to
direct Plaintiff in removing snow and pushing snow aside.
7. The arranqement was to provide front-end loaders and
operators at the standard hourly rates of $135, $150, and $110,
toqether with operators.
a. Plaintiff performed the snow removal work at the direction
of Defendant, workinq approximately twelve (12) hours throuqh the
night and aorninq in order to accomplish the task.
9. Under the arranq_ents made, Defendant was to pay
Plaintiff for all of the work that was done.
10. Defendant refused to tender IIOnies for all of the work
done. Defendant paid Plaintiff only $2,000.00 towards the bill of
$4075.00 leavinq a balance due at the time of $1925.00.

U. Pursuant to the .CJr....nt, plaintiff 18 entitled to

WHEREFORE, Plaintiff respectfully requests judgement against
Defendant in the amount of $2,168.00 together with interest and
costs of suit, with interest to run at the rate of 1.5\ per month
until paid.
COUNT II
13. Paraqraphs 1-12 above are incorporated by reference
herein.
14. On or about March of 1996, Defendant brought suit against
plaintiff allegedly for damages which occurred to the job sites
where Plaintiff removed snow under the direction of Defendant.
15. This matter was heard before District Justice Manlove,
who entered a judgaaent in favor of Plaintiff on May 2, 1996. This
jUdge..nt vas not appealed.
16. This action was brought by Defendant without
ju.tification a. to either the underlying claim or the amount of
daaaqe. claiaed. It was brought in bad faith because:
A. Defendant had assumed responsibility for any daaaqes to
property when he undertook to direct the snow removal and to inform
Plaintiff'. operator. of obstructions .uch a. curbing, car .top.,

AND NOW, comes Plaintiff by its undersigned counsel and
respectfully brings the following preliminary objections:
I. MOTION TO STRIKE
1. The nature of this action is a claim by Plaintiff against
Defendant for snow removal services performed by Plaintiff to
certain customers of Defendant's.
2. In paragraphs 11, 12, 16, and 18 of his Answer, Defendant
raises a defense and a counter claim for supposed daaage done by
Plaintiff in the course of snow reaoval.
3. Thi. claim made by Defendant i. identical to a claim he
made against Plaintiff in a certain action brought in the office of
District Justice Manlove.
4. In the afore.aid action before the District Justice, the
District Justice rendered a deciaion on or aboUt April a, 1996, in
favor of Plaintiff and against Defendant.
S. Plaintiff made no counter claim or croaa claim for the
balance of lIOfties ~ in that action.
6. The U.. for Defenchnt to have fUed an Bppetl to the
aforesaid action before Oistrict Juetice Manlove haa lonq expired.

7. For the reasons set forth above, Defendant's claim in the
nature of the set off or counter claim has been previously decided,
and this court therefore lacks subject matter jurisdiction over
Defendant's claim.
8. WHEREFORE, Plaintiff respectfully requests that all
reference. and Defendant's Answer to a set off or counter claim
ba.ed allegations of damages resulting from snow removal be
stricken off and that Plaintiff's Demurrer to the counter claim be
sustained.
