3. On or about October 17, 1988, Defendants made. exccutcd and delivered a
Mortgage upon the premises, known as 329 Pulton Street, Rear, Enola, I' A 17025 (the
"Premises"), more particularly described in Exhibit "A," which is attached hereto and
ineorporated by reference herein as though fully set forth at length, to Plaintiff, hereinafter called
"Mortgagee," which Mortgage is rccorded in the Office of the Recorder of Deeds of the County
of Cumberland, in Mortgage Book No. 920, Page No. 226 , and the terms of which are
incorporated by reference herein as though fully set forth at length,
4. A description of the land and premises subject to the Mortgage is set forth in
Exhibit "A" attached hereto and incorporated by reference herein as though fully set forth at
length.
5. The Mortgage is in default because the monthly payments on account of
amortization of the principal of the Note secured by said Mortgage, interest on the Note secured
by said Mortgage and other items set forth in said Mortgage, such as fire insurance and mortgage
insurance, due on April I, 1996, and on the first day of each month thereafter, are due and have
not been paid, as a result of which the entire principal of said Note and all interest due thereon,
together with late charges, mortgage insurance premium, attorney's commission for collection.
and other items as set forth in said Mortgage and Note, are now due and payable. A true and
correct copy of said Note is attachcd hereto as Exhibit "B," the terms of which are incorporated
by reference hercin as though fully set forth at length,
6, On June 4, 1996, letters were sent to Defendants advising of Plaintiffs intent to
foreclose within thirty (30) days pursuant to 41 I',S. Section 403. A true and correct copy of said
letters are attached hereto as Exhibits "C-I" and "C-2".

Your house at 329 Fulton Street Rear, Enola, P A 19025 is scheduled to be sold at Sheriffs
Sale on Wednesday, June 4, 1997, at 10:00 a.m., in the Cumberland County Courthouse, South
Hanover Street, Carlisle, PA 17013, to enforce the court judgment of $48,291.20 obtained by
Dauphin Deposit Bank and Trust Company c/o Eastern Mortgage Services, Inc. against you.
NOTICE OF OWNER'S RIGHTS
YOU MAY BE ABLE TO PREVENT THIS SHERIFF'S SALE
To prevent this Sheriffs Sale you must take immediate action:
I, The sale will be canceled if you pay to the mortgagee the amount of the judgment plus costs,
the back payments, late charges costs and reasonable attorneys fees due. To find out how much you
must pay, you may call Elizabeth Silberman, Esquire at (215) 635-7200.
2. You may be able to stop the sale by filing a petition asking the Court to strike or open the
judgment, if the judgment was improperly entered. You may also ask the Court to postpone the sale
for good cause,
3. You may also be able to stop the sale through other legal proceedings.

I. If the Sherif!'s Sale is not stopped. your property will be sold to the highest bidder. You may
find out the bid price by calling Elizabeth Silberman, Esquire. at: (215) 635-7200,
2, You may be able to petition the Court to set aside the sale if the bid price was grossly
inadequate compared to the value of your property.
3, The sale will go through only if the buyer pays the Sheriff the full amount due in the sale.
To find out if this has happened. you may call Elizabeth Silberman. Esquire. at (215) 635-7200,
4, If the amount due from the buyer is not paid to the Sheriff, you will remain the owner of the
property as if the sale never happened.
5. You have a right to remain in the property until the full amount due is paid to the Sheriff and
the Sheriff gives a deed to the buyer. At that time, the buyer may bring legal proceedings to evict
you.
6, You may be entitled to a share of the money which was paid for your house, A schedule of
distribution of the money bid for your house will be filed by the Sheriff on July 3, 1997, This
schedule will state who will be receiving that money, The money will be paid out in accordance
with this schedule unless exceptions (reasons why the proposed distribution is wrong) are filed with
the Sheriff within ten (10) days after July 3,1997,
7 . You may also have other rights and defenses, or ways of gelling your house back, if you act
immediately after the sale.
