Nor was he rclcu:-icd IhHn his rcspllll:-.ihility in the Quit Claim Deed lIgrecmcnl. 10, Thc plaintin'~ nlilurc to llIakc thc promi'"'' "'i1llgagc pIlYIll,'nts were a uircct result "fill<' necu {('I' u Quit Claim Deed. latc fees und pcnalt leS. 4 While the Respondent had made previous oft'crs to obtain the Quit Claim Deed that included an offer to remove the Plaintiff's name from the mortgage for two thousand dollars ($2,000 00) about February 1995 and another offer for three thousand dollars ($3,000 00) on or about March 1995, The Plaintiff rejected these offers 5, A subsequent offer by Respondent on April 26, 1995, for five thousand dollars ($5,000,00) for Quit Claim Deed did lli!1 include any provisions or promise regarding the mortgage because the Respondent lacked the financial resources to refinance the mortgage due to the Plaintiff's demand for higher payment, 6, On or about May I, 1995, the Plaintiff eounteroffered that he would provide the Quit Claim Deed if the Respondent paid him six thousand dollars ($6.000.00), The Plaintiff made no mention of removing his name from the Weyerhaeuser Mortgage, 7. Based upon the above information, the Respondent respectfully requests that the court deny the Plaintiff's request for specific performance (Paragraph 5) of the Complaint and deny the request for court costs and attorneys fees (final paragraph of complaint) because: (a) In the agreement of May of 1995, there was no promise regarding the Weyerhaeuser mortgage (see Attachment #1, agreement of May 15, 1995) and further..., (b) because this agreement related to the transfer of ownership interest in real property. the statute offrauds requires all agreements to be in writing. 2 (b) beeause this agreement related to the transfer of ownership interest in real propeny. the statute of frauds requires all agreements to be in writing COUNTER n_ CLAIM 8 Based upon the following information, the Respondent respectfully request that his honorable coun enter judgment againsllhe Plainliff for breach of contract and provide appropriate award of damages and other relief to the Respondent, 9. On August 25. 1993, the Plaintiff and Respondent jointly purchased a propeny at 537 Springhouse Road for the amount of one-hundred fifty-six thousand, nine hundred dollars ($156,900) and assumed the Weyerhaeuser mongage in the amount of one-hundred fony-one thousand, two-hundred dollars and no cents ($141,200.00), Each pany contributed an equal amount to the down payment and closing costs, 10, The panies verbally agreed to equally share the cost of mongage payments and utilities and other household expenses, II. From September 1993 through May 1994, each pany paid one-half of all the above expenses with the Respondent usually providing a check to the Plaintiff for her share and the Plaintiff writing the payment checks, 12, During May 1994, the Plaintiff vacated the 537 Springhouse Road house, The Plaintiff refused to discuss settlement of the financial matter and remained incognito, 3 \3 In June of 1994, the I'laintitl'rdused to pay his share, the-hundred and seventy- eight dollars and three cents ($578 03) of the monthly morlgage payment of eleven-hundred and liny-six dollars and six ccnts ($1,156 06) This brcach of his agrecmcnt by thc I'laintift. has rcsultcd in substantial fmancial and pcrsonal distress to the Rcspondcnt 14 Fcaring forcclosure and damagc to her crcdit record, thc Respondent paid the entire mortgage paymcnts for Junc, July and August of 1994 15 In September of 1994, the Respondcnt ceased making morlgage payments because of the Plaintiff's continuing unwillingness to address and settle their financial matters and realizing that the Plaintiff stood to benelit equally from equity in the property during any eventual sale, 16, On March 29,1995, the Respondent received a default/foreclosure notice from the mortgage company, 17. Upon obtaining the Quit Claim Deed from the Plaintiff on May 15, 1995, the Respondent paid to the mortgage company on May 30, 1995, the amount of eleven thousand five-hundred sixty-two dollars and sixty-two cents ($11,562, II) for past due mortgage payments, late fees and penalties of eleven hundred fifty- eight dollars and eight cents ($1,158,08), 18, At the time of purchase. the Plaintiff promised to pay one-half of all mortgage payments, This promise was not released by his decision to vacate the property, There was no release of their prior responsibility in the Quit Claim Deed agreement. 4 " 19 The need for a Quit Claim Deed. the lale fees and penalties were a direcl result of the Plaintiff's failure to make the promised mortgage payments 20 In order to have the above-menlioned Quit Claim Decd rccorded. city/counly/state tax/stamps are requircd equal to two pcrcent (2%) ofthc home's value for a total cost of three thousand onc hundrcd thirty-cighl dollars and no cents (2 x $1,569 = $3.133800), 21, The Respondent respectfully requests that this honorable court award to the Respondent damages in the following amounts as a direct result of the Plaintiff's breach of his promise to pay one-half of the above-mentioned mortgage payments: (a) Halfofthe mortgage payment from June 1994 through May 1995, (12 months x $1,156,06 x 50% = $6,936.36), (b) The total of all late fees and penalties, one thousand one-hundred and fifty-eight dollars and eight cents ($1,158,08) (c) The cost of recording the Quit Claim Deed, three thousand one-hundred thirty eight dollars and no cents ($3.138.00).
